Para tanto, são objeto de análise institutos de justiça penal e infracional (infantojuvenil) destinados à reparação dos danos, mecanismos estatais e não-estatais de auxílio aos ofendidos e propostas de alteração legislativa que visam tutelar direitos das vítimas. O sistema de justiça criminal tradicional é marcado pelo protagonismo do Estado, com atuação voltada para promover o interesse público por meio da aplicação de pena ao ofensor. A vítima fica neutralizada e sofre, ainda, com ausência de informações sobre o processo e falta de assistência para recuperação dos prejuízos materiais e traumas psicológicos sofridos. A experiência estrangeira releva iniciativas que alcançaram resultados positivos na busca pela mitigação desses problemas. É o caso dos serviços de auxílio às vítimas e, ainda, de alterações legislativas pelas quais se passou a reconhecer novos direitos aos ofendidos, tal como o direito de realizarem declaração de impacto perante as cortes. Podem ser identificadas iniciativas semelhantes no Brasil. Cabe destacar, nesse sentido, o projeto do novo Código de Processo Penal (PL 8045/2010), que prevê título inovador a elencar rol de direitos dos ofendidos, bem como o modelo de justiça restaurativa a ser instituído no país. A proposta da justiça restaurativa recebe especial atenção nesta obra pelo seu potencial para oferecer tratamento mais adequado às vítimas de conflitos penais, tendo obtido resultados positivos em experiências estrangeiras. Há oportunidade de comunicação entre os envolvidos no conflito. Assim, há abertura para que a vítima possa expressar os sofrimentos suportados e para que o ofensor possa explicar as circunstâncias que desencadearam o ato ilícito, desculpar-se e assumir obrigações. Por meio do diálogo entre os envolvidos será obtido o senso de justiça do caso concreto. Com base em forte estímulo fornecido pelo Conselho Nacional de Justiça, desenvolveram-se iniciativas restaurativas no país, as quais sofrem com baixa adesão das vítimas. Contudo, é de se ressaltar que os programas restaurativos brasileiros estão em fase embrionária e carecem de regulamentação legal. Assim, os problemas identificados nas iniciativas restaurativas brasileiras devem ser vistos como desafios a serem superados porque a justiça restaurativa constitui ferramenta democrática essencial para transformação da justiça estatal e sua adoção é irreversível.

A leading international framework for debates on the subject of stereotypes, the Convention on the Elimination of All Forms of Discrimination against Women, was adopted in 1979 by the UN General Assembly and defines what constitutes discrimination against women. It also establishes an agenda to eliminate discrimination in all its forms in order to ensure substantive equality for women. Applying the Convention as the primary framework for analysis, this book provides essential strategies for eradicating gender stereotyping. Its proposed methodology requires naming operative gender stereotypes, identifying how they violate the human rights of women, and articulating states' obligations to eliminate and remedy these violations. According to Rebecca J. Cook and Simone Cusack, in order to abolish all forms of discrimination against women, priority needs to be given to the elimination of gender stereotypes. While stereotypes affect both men and women, they can have particularly egregious effects on women, often devaluing them and assigning them to subservient roles in society.
