La obra pretende dar cuenta de estas transformaciones, si perder al propio tiempo el bagaje adquirido por la institución en todos los ordenes hasta hacer de la misma-particularmente en el medio internacional- un modo normal de solución de controversias. En este lapso de tiempo se ha asistido a una expansión y a un perfeccionamiento constante del arbitraje como institución de Derecho, ganando ámbitos, mejorando su técnica, aumentando su nivel de autonomía y suficiencia, adquiriendo, en definitiva, eficacia, en pro de una mayor seguridad en las operaciones jurídicas. El hecho de que esta nueva edición se haya retrasado en más de dos años su publicación con respecto a la entrada en vigor de la Ley 60/2003, obedece al propósito deliberado de los autores de observar -aunque la referencia temporal sea breve- el grado de aceptación que la norma ha tenido en los diversos comentarios doctrinales que se han venido haciendo a partir de esa fecha, la problemática que su observancia ha tenido entre los operadores y la respuesta que la jurisprudencia ha generado en este breve lapso de tiempo sobre su aplicación y su progresiva inserción en las tendencias mas corrientes del arbitraje hoy en día. Esta es la razón por la que, el libro que se ofrece a los lectores no puede calificarse sin más de ser una 3a edición del Tratado de Arbitraje Privado Interno e Internacional, que vio por primera vez la luz bajo los auspicios de la Editorial Cívitas en 1978, pues no se trata de una simple puesta al día de la anterior edición, sino que constituye en muchos aspectos una obra prácticamente nueva por la profunda revisión que ésta ha sufrido, aunque se mantenga el mismo método y sistema expositivo, por parecer el más adecuado al contenido de la misma, y aunque se deje suficiente constancia del nivel de contenido adquirido por la institución. Subsiste el empeño en mostrar el arbitraje de la forma mas completa y sistemática posible, propiciando una visión de conjunto tanto mas necesaria cuanto que mas crece y se desarrolla. Precisamente, como resultado de la profunda e intensa evolución sufrida por la institución arbitral en estos últimos años, ha parecido conveniente a los autores sustituir el título de su obra (Tratado de Arbitraje privado interno e internacional) por el más simple y al propio tiempo más apropiado a la realidad actual de Tratado de Derecho arbitral. Este cambio no es producto del capricho, sino que simplemente responde a que el término privado predicado del arbitraje actual ha acabado perdiendo todo su significado, de aquí su supresión. Lo mismo puede decirse respecto a los términos interno e internacional, que en la realidad actual no son contrapuestos ni responden a ámbitos antitéticos, por el contrario tienden a fundirse gracias a la autonomía institucional de arbitraje como un todo.
