Book Synopsis Transformative Constitutionalism in Latin America by : Armin von Bogdandy
Download or read book Transformative Constitutionalism in Latin America written by Armin von Bogdandy and published by Oxford University Press. This book was released on 2017-06-16 with total page 465 pages. Available in PDF, EPUB and Kindle. Book excerpt: This ground-breaking collection of essays outlines and explains the unique development of Latin American jurisprudence. It introduces the idea of the Ius Constitutionale Commune en América Latina (ICCAL), an original Latin American path of transformative constitutionalism, to an Anglophone audience for the first time. It charts the key developments that have transformed the region and assesses the success of the constitutional projects that followed a period of authoritarian regimes in Latin America. Coined by scholars who have been documenting, conceptualizing, and comparing the development of Latin American public law for more than a decade, the term ICCAL encompasses themes that cross national borders and legal fields, taking in constitutional law, administrative law, general public international law, regional integration law, human rights, and investment law. Not only does this volume map the legal landscape, it also suggests measures to improve society via due legal process and a rights-based, supranational and regionally rooted constitutionalism. The editors contend that with the strengthening of democracy, the rule of law, and human rights, common problems such as the exclusion of wide sectors of the population from having a say in government, as well as corruption, hyper-presidentialism, and the weak normativity of the law can be combatted more effectively in future.
Book Synopsis The Handbook of Electoral System Choice by : J. Colomer
Download or read book The Handbook of Electoral System Choice written by J. Colomer and published by Springer. This book was released on 2016-01-05 with total page 571 pages. Available in PDF, EPUB and Kindle. Book excerpt: The topic of electoral reform is an extremely timely one. The accelerated expansion of the number of new democracies in the world generates increasing demand for advice on the choice of electoral rules; at the same time, a new reformism in well established democracies seeks new formulae favouring both more representative institutions and more accountable rulers. The Handbook of Electoral System Choice addresses the theoretical and comparative issues of electoral reform in relation to democratization, political strategies in established democracies and the relative performance of different electoral systems. Case studies on virtually every major democracy or democratizing country in the world are included.
Book Synopsis Routledge Handbook of Political Advertising by : Christina Holtz-Bacha
Download or read book Routledge Handbook of Political Advertising written by Christina Holtz-Bacha and published by Routledge. This book was released on 2017-02-24 with total page 574 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Handbook provides the most comprehensive overview of the role of electoral advertising on television and new forms of advertising in countries from all parts of the world currently available. Thematic chapters address advertising effects, negative ads, the perspective of practitioners and gender role. Country chapters summarize research on issues including political and electoral systems; history of ads; the content of ads; reception and effects of ads; regulation of political advertising on television and the Internet; financing political advertising; and prospects for the future. The Handbook confirms that candidates spend the major part of their campaign budget on television advertising. The US enjoys a special situation with almost no restrictions on electoral advertising whereas other countries have regulation for the time, amount and sometimes even the content of electoral advertising or they do not allow television advertising at all. The role that television advertising plays in elections is dependent on the political, the electoral and the media context and can generally be regarded as a reflection of the political culture of a country. The Internet is relatively unregulated and is the channel of the future for political advertising in many countries

Book Synopsis UN Interventions and Democratization by : Carina Barbosa Gouvêa
Download or read book UN Interventions and Democratization written by Carina Barbosa Gouvêa and published by Springer Nature. This book was released on 2023-07-21 with total page 210 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyzes United Nations (UN) interventions in the process of constitution making in states undergoing political change. It combines theoretical considerations of democracy and constitutionalism with empirical experiences and takes a critical perspective on the interventions developed by the United Nations in the processes of re-democratization. Presenting new empirical evidence on the substantive and procedural way in which the UN undertakes constitution building in Cambodia, Bosnia and Herzegovina, Afghanistan, and East Timor, the book illustrates difficulties of these practices such as the promotion of popular participation, as well as an increasing Westernization, and to meet local needs. In consequence, the authors call for reforms of the actions and structural methods the UN to better align a legitimate constitutional order with the rule of law and democratic values. This book is aimed at scholars and students of politics and law who are interested in the prerequisites and conditions for further democratization in states undergoing political transformation.
Book Synopsis Political Parties in Conflict-prone Societies by : Ben Reilly
Download or read book Political Parties in Conflict-prone Societies written by Ben Reilly and published by Brookings Institution Press. This book was released on 2008 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: Well-functioning political parties are essential components of democracy. They organize voters, aggregate and articulate interests, craft policy alternatives, recruit and socialize new candidates for office, set policy-making agendas, integrate disparate groups and individuals into the democratic process, and provide the basis for coordinated electoral and legislative activity. But political parties in many developing democracies remain weak and underdeveloped, often being based around personal, ethnic or regional ties rather than national interests. Today, with more states deciding their leaders through multiparty elections than ever before, many developing democracies seek to shape the development of political parties and party systems by regulating the way parties can form, organize and behave. Most of these ambitious initiatives and innovations emanate from new democracies rather than established Western examples. This volume examines this growing trend in conflict-prone societies towards promoting stable and inclusive political parties via political party regulation and engineering in developing democracies around the world.

Download or read book The Oxford Handbook of Constitutional Law in Latin America written by Conrado Hübner Mendes and published by Oxford University Press. This book was released on 2022 with total page 970 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constitutional law in Latin America embodies a mosaic of national histories, political experiments, and institutional transitions. No matter how distinctive these histories and transitions might be, there are still commonalities that transcend the mere geographical contiguity of these countries. This Handbook depicts the constitutional landscape of Latin America by shedding light on its most important differences and affinities, qualities and drawbacks, and by assessing its overall standing in the global enterprise of democratic constitutionalism. It engages with substantive and methodological conundrums of comparative constitutional law in the region, drawing meaningful comparisons between constitutional traditions. The volume is divided into two main parts. Part I focuses on exploring the constitutions for seventeen jurisdictions, offering a comprehensive country-by-country critique of the historical foundations, institutional architecture, and rights-based substantive identity of each constitution. Part II presents comparative analyses on the most controversial constitutional topics of the region, exploring central concepts in institutions and rights. The Oxford Handbook of Constitutional Law in Latin America is an essential resource for scholars and students of comparative constitutional law, and Latin American politics and history Written by leading experts, it comprehensively examines constitutions, controversies, institutions, and constitutional rights in Latin America.

Book Synopsis Supervising Electoral Processes by : European Commission for Democracy through Law
Download or read book Supervising Electoral Processes written by European Commission for Democracy through Law and published by Council of Europe. This book was released on 2010-01-01 with total page 114 pages. Available in PDF, EPUB and Kindle. Book excerpt: This publication contains the reports presented at the seminar entitled "Supervising Processes", organised in Madrid on 24 and 25 April 2009 by the European Commission for Democracy through Law (Venice Commission) in co-operation with the Centre for Political and Constitutional Studies (CEPC). This was the first UniDem (Universities for Democracy) seminar which compared the legal situation in Europe with that of the United States and Latin America. The aim of the seminar was to study the ways of making electoral legislation effective. It addressed electoral disputes from a procedural as well as from a substantive point of view. It also demonstrated the different approaches taken in Europe, where disputes are generally dealt with by constitutional or ordinary courts, and Latin America, where specialised courts have been established. The seminar dealt with the role of international judicial instances, such as the European Court of Human Rights and the Inter-American Court of Human Rights, in guaranteeing the quality of the electoral process, as well as with the control of electoral campaign financing.
