Modern day transport offers a considerable array of possibilities; possibilities that are for the most part taken for granted by the general public that enjoys their benefits. The average European would not be surprised to learn that the fruit on offer in the local supermarket originates from another continent for instance. The idea that most of the things we use in our daily routine stem from a distant source, such as a cell phone from Japan, a trendy pair of designer jeans made in China or a glass of Australian wine, seems completely natural to us. Clearly the contemporary transport industry offers us a lot of benefits besides such discomforts as congestion and pollution. In earlier times, before machinery such as the steam engine had been invented it was hardly cost effective or even feasible when it came to perishables to carry goods halfway around the world if they were not at least valuable and extraordinary2. The limitations set on trade by the transport structures available did more however than simply curtail the range of affordable products on offer for the public. They also had a negative effect on the location of the industry, limited transport possibilities and forced production to take place near or in heavily populated areas to secure the necessary workforce and market possibilities. Book excerpt: The main rationale of the conventions on international transport law is to limit the liability of the carrier. However, an aspect common to these conventions is that in cases of "wilful misconduct" the carrier is liable without any financial limitation. "Wilful misconduct" denoting a high degree of fault is an established term in English law. The Convention for the Unification of Certain Rules relating to International Carriage by Air (Warsaw Convention) of 1929 was the first international convention on transport law where the term was employed. A definition of "wilful misconduct", which can be found in later conventions regarding carriage of goods and passengers as well, was implemented in the Hague Protocol of 1955, amending the Warsaw Convention. However, the question as to exactly which degree of fault constitutes "wilful misconduct" has to date remained controversial and unanswered. This work seeks to answer this question. To this end, the historical background of the term, together with its function and role in marine insurance law, case law and international transport law, are examined from a comparative perspective.

In German and international literature and jurisprudence, such clauses have largely been regarded as a posing an agency problem. Further, German case law has considered identity of carrier clauses as an issue relating to the incorporation of terms and mostly viewed such clauses as insignificant. This article looks at the issue from a different angle and examines whether the clause could have justified imposing joint and several liability on shipowners and time charterers/carriers under the contract of carriage, and in so doing closed the legal gap that existed until the 2013 entry into force of § 509 of the German Commercial Code (HGB). The inquiry concludes that the prohibition against partial retentions would not be violated if identity of carrier clauses were understood as imposing joint and several liability and that such an approach would withstand an appropriateness test under § 307 (1) and (2) BGB.

This means that, in the future, long-distance buses may operate on routes where they were previously not allowed, to protect the interest of the railways. Following the opening up of the market in 2013, more and more long-distance bus companies have penetrated the market and a major price war has ensued. The Deutsche Bahn AG had initially underestimated the competition, and is now trying to regain passengers through elaborate mar-keting ploys. The aim of this thesis is to compare two very different modes of transport, namely railbound long-distance transport and long-distance bus transport. Various criteria that affect the subjective trip perception of an average passenger are listed. To complete the comparison, domestic air transport is also briefly discussed, as this is also a mode of long-distance transport. The comparison yields a differentiated view of the modes of transport and various positive and negative features can be highlighted. Nevertheless, a recommendation for or against a party is not possible in this work, as it is highly dependent on the personal preferences of the passenger. But the fact is that the various providers do not share the same competitive conditions. Till this situation is not regulated by law, a fair comparison cannot take place in any case.
