Available in PDF, EPUB and Kindle. Book excerpt: State authority and power have become diffused in an increasingly globalized world characterized by the freer trans-border movement of people, objects and ideas. As a result, some international law scholars believe that a new world order is emerging based on a complex web of transnational networks. Such a transnational legal order requires sufficient dialogue between national courts. This 2010 book explores the prospects for such an order in the context of refugee law in Europe, focusing on the use of foreign law in refugee cases. Judicial practice is critically analysed in nine EU member states, with case studies revealing a mix of rational and cultural factors that lead judges to rarely use each others' decisions within the EU. Conclusions are drawn for the prospects of a Common European Asylum System and for international refugee law.

Available in PDF, EPUB and Kindle. Book excerpt: The Refugee in International Law is widely acknowledged to be the most authoritative discussion of this important and challenging subject. In this completely revised and updated edition, Professor Goodwin-Gill analyses all the major developments in the field of refugee law since the appearance of the first edition in 1983. This new edition will develop more fully the international law aspects of refugee problems, taking into account moves to forestall movements, as in the case of Northern Iraq, and to prevent the necessity for flight, which was the declared rationale for some at least of the international involvement in the former Yugoslavia.

Book excerpt: In an age of ethnic nationalism and anti-immigrant rhetoric, the study of refugees can help develop a new outlook on social justice, just as the post-war international order ends. The global financial crisis, the rise of populist leaders like Trump, Putin, and Erdogan, not to mention the arrival of anti-EU parties, raises the need to interrogate the refugee, migrant, citizen, stateless, legal, and illegal as concepts. This insightful Research Handbook is a timely contribution to that debate.

Available in PDF, EPUB and Kindle. Book excerpt: This work comprises 24 linked essays by leading transatlantic scholars in international law and the social sciences examining the sociolegal aspects of multi-jurisdictional legal techniques and trans-jurisdictional social phenomena. The contributors bring a range of disciplinary expertises including anthropology, economics, law and sociology to bear on key questions raised by transnational legal processes. The pieces explore legal developments in multiple territories including Africa, Asia, Latin America and the United States. The volume is designed as a general reader for courses on law and globalisation and related studies. The collection is made up of four parts, each addressing a central theme in transnational law and legal action (law-making and compliance), human rights, commerce and governance. The essays discuss such diverse problems as: the role of foreign actors in the ethnic conflicts of Kosovo and Rwanda; the power the United States and the UK wield over international capital markets; and the adaptability of existing public international law to deal with the challenges wrought by globalisation.

Available in PDF, EPUB and Kindle. Book excerpt: This book is a collection of ethnographies of transnational migration and border crossings in Asia. Interdisciplinary in scope, it addresses issues of mobility and Diaspora from various vantage points. Unique to this volume is an emphasis of studying globalisation from below, privileging the narratives and views of “people on the move” – or the transnational underclass – and their sense of belonging to places and communities. The collection is further distinguished by its focus on the sources of authority and the social configurations that are created in the intersections between legality and illegality across Asia. Though previous studies on transnational flows have deconstructed the notion of nation-states as having fixed political boundaries, and have engaged in spaces beyond the nation-states, seldom has an entire region, Asia, been privileged in one integrated volume. We emphasize hitherto marginalized debates that have significant policy relevance. Other than a serious academic interest from lecturers and students, we are confident that book will be of significant interest for development practitioners and NGOs.
