À l'inverse, la transmission implique le plus souvent une transformation. This book resolves these problems by applying ethical and sociological theories of food and analysing food education in two pioneering countries: Japan and France. The book focuses on taste education and gastronomy as two key concepts which have great potential to positively impact food education. Taste education is a promising alternative to nutrition-centred pedagogy which foregrounds the experience and pleasure of eating food, creating an environment for taste sensibility and food curiosity. From taste education, the picture can be broadened to examine the role and impact of gastronomy in food education. Examining the cultural traditions of France and Japan reveals how gastronomy can impact eating habits and food cultures and how these criteria should be an intrinsic part of food education. Conçue hier comme un mode de règlement exclusif des conséquences patrimoniales du fait juridique que constitue le décès d'une personne physique, celle-ci a progressivement conquis le droit des sociétés. En ce domaine, la transmission universelle constitue un mode exceptionnel d'appropriation des biens, obligations et actions d'une personne morale dissoute sans liquidation. En droit des successions, la transmission globale de patrimoine produite par le décès demeure sous tendue par la fiction de la continuation de la personne du défunt par ses ayants cause. En droit des sociétés, la question du fondement de la transmission universelle reste incertaine. Notamment, dans le but de marquer les différences existant avec le décès, la doctrine affirme le plus souvent que la transmission de patrimoine ne se justifie qu'en raison de la continuité de l'entreprise du groupement dissoute par le dévolutaire de ses biens. La proposition est séduisante. Toutefois, elle ne paraît pas pouvoir jouer le rôle explicatif que de nombreux auteurs veulent lui prêter aujourd'hui. Notamment, son opportunité résiste difficilement à une confrontation avec les solutions acquises par le droit positif. Ainsi, la continuité de l'entreprise ne permet pas de justifier l'ensemble des effets attachés à la dissolution sans liquidation. Aussi, faut-il chercher ailleurs la justification des effets de la transmission universelle en droit des sociétés. Le principe de continuation de la personne de l'entité dissoute par le bénéficiaire de ses biens remplit de manière satisfaisante cette fonction. Ainsi à l'image de l'ayant cause universel d'une personne physique, l'ayant cause universel d'une personne morale dissoute sans liquidation n'est rien d'autre que le continuateur de la personnalité juridique de l'entité dissoute. La proposition justifie notamment également la transmission des dettes omises ou virtuelles de l'entité dissoute. Elle conditionne enfin le domaine de l'effet substitutif attaché par la loi et la jurisprudence à la transmission de patrimoine.
