In effect, this could lock U.S. firms out of billions of euros worth of European defense procurement over the coming years--despite long-standing reciprocal agreements under which the U.S. and its European allies agreed to open their defense markets. The fund was announced quietly last year and now, in the shadow of a trade war launched by the Trump administration, has evolved into a substantial potential barrier in the transatlantic defense market, and potentially another brick in a rising wall of protectionism between the U.S. and Europe.

One of the fundamental differences between the two is their composition of purchases: whereas in U.S. federal procurement 70-80% of purchases are military, defense composes less than .3% of the purchases of Members States' purchases covered under any of the EU's procurement directives. This disparity explains the two systems' distinct procurement procedures. Each is designed to purchase different types of goods and services -- the former defense equipment, and the latter products that can be distinguished on the basis of price. This has ramifications beyond defense, and a better understanding of this question would enable more liberal procurement trade between the U.S. government and the European Union.

Book excerpt: EU governments are gradually coming around to the idea that they need to open up their defence markets, especialy at a time when growing budgetary constraints clash with the increasing need for sophisticated equipment. Governments have alreadyi agreed to the Code of Conduct on Defence Procurement introduced by the European Defence Agency in July 2006, but the EDA cannot force governments to comply with the code. Also, the protectionist attitude of Member States derives from the fact that they regard defence procurement as an area that overlaps with national sovereignty. The European Commission is currently proposing new procurement and trade directives aimed at streamlining defence market legislation, and it is to be hoped that Member States will respond positively to this initiative. The proposed directives would open up the defence market, improve European cooperation on armaments and lead to a more competitive European defence industry. Plus, in the ongoing debate about the European defence market, the transatlantic defence market should not be forgotten, especially given the increasingly important role that American and European companies play in this arena on both sides of the pond--P. Book excerpt: Opportunities for the construction of a transatlantic defense sector are tangible, but significant obstacles may accelerate the formation of a bipolar industrial base. While market forces played a key role in the transformation and consolidation of these sectors in recent years, political considerations are largely responsible for a restructuring process that has been almost entirely among U.S. firms in the United States and among European Union companies in Europe. In this monograph, Dr. Terrence Guay examines the forces that have shaped the restructuring of the U.S. and European defense industries since the end of the Cold War, and presents factors that will influence further restructuring and consolidation in the short- and medium-terms. He contends that a transatlantic defense industrial base is preferable to a bipolar one, and recommends that the U.S. Government open its defense equipment market to more European firms, and that European governments reciprocate. Additionally, military forces should put greater effort into coordinating procurement requirements and needs, and firms should explore expanding transatlantic links.

See, e.g.,EU Adopts New Defense and Security Procurement Directive, 6 IGC ¶ 65. Previously, most European defense procurement was considered exempt from the European procurement directives that have harmonized procurement, with greater transparency and competition, across Europe. Under the new defense directive, all but the most sensitive defense and security procurements in Europe will have to be conducted under rules consistent with the new directive. From an American vantage point, however, it is not yet clear how the new directive will be implemented. If the defense directive merely brings new competition and transparency to the European procurement markets, the directive will be a welcome improvement in what was traditionally a closed and uncompetitive market. But if, in practice, the directive is used as an excuse to discriminate against U.S. exporters - or if it is perceived as a tool of discrimination - the directive threatens to trigger serious trade frictions in the transatlantic defense markets.

Sue Arrowsmith has observed that the unfamiliarity of a foreign government's public procurement regimes can create "structural restrictions" and Steve Schooner and Chris Yukins have in turn observed that such structural restrictions can "raise practical barriers to entry as foreign vendors run headlong into dense and alien procurement regimes." This essay diagnoses some of these subtle barriers and prescribes remedies to foster greater cross-border competition in transatlantic defense procurement.

Book excerpt: The EU-US Summit on 26 March will mark eight months since the partners decided to formally launch negotiations on a Transatlantic Trade and Investment Partnership (TTIP). The aim of the TTIP - if finalised - is to remove tariffs, align regulatory standards and open up government procurement. Born out of the need to boost economic growth on both sides of the Atlantic and to respond to the rise of emerging markets, the Partnership will add an extra €120 billion to the EU economy annually, according to estimates by the European Commission. While President Obama's first visit to Brussels will likely be dominated by an agenda focusing on Ukraine and economic recovery, it is also worth thinking about some of the more sensitive areas involved in the TTIP discussions.One such area relates to defence industry and markets. Back in June 2013, public procurement of defence and security goods was included in the Commission's negotiating mandate. Given the sensitive nature of defence procurement, however, both sides have, for the time being, agreed to drop a 'defence TTIP'. This situation is indicative of a broader negotiating environment that has seen a moratorium on including an investment chapter in the Partnership and other sectoral exclusions. Therefore, at first glance, the TTIP's overarching aims of abolishing tariffs, enhancing the compatibility of the EU and US regulatory environment and ensuring a greater flow of goods, services and investments in the transatlantic space will not apply to the defence sector. But is this necessarily the end of the story?
