Available in PDF, EPUB and Kindle. Book excerpt: Regionalism in International Investment Law provides a multinational perspective on international investment law. In it, distinguished academics and practitioners provide a critical and comprehensive understanding of issues in a field which has grown exponentially in its importance particularly over the last decade, focusing on the European Union, Australia, North America, Asia, and China. The book approaches the field of foreign direct investment from both academic and practical viewpoints and analyzes different bilateral, regional, and multinational agreements, often yielding competing perspectives. The academic perspective yields a strong conceptual foundation to often misunderstood elements of international investment law, while the practical perspective aids those actively pursuing foreign direct investment in better understanding the landscape, identifying potential conflicts which may arise, in more accurately assessing the risk underlying the issues in conflict and in resolving those issues. Thorny issues relating to global commerce, sovereignty, regulation, expropriation, dispute resolution, and investor protections are covered, depicting how they have developed and are applied in different regions of the world. These different treatments ensure that readers are able grasp the subject matter at multiple levels and provide a comprehensive overview of developments in the field of foreign direct investment.

Available in PDF, EPUB and Kindle. Book excerpt: The world is changing rapidly. The former People's Republic of Germany and the Republic of Germany have been reunited. Others, such as Czechoslovakia, Yugoslavia and, of course, the former Soviet Union, have split apart. The consequences of such changes are not relegated only to the spheres of geopolitics and strategic planning; they are equally important to the international business and investment communities. As a country becomes geographically larger or smaller, so does its ability to attract foreign dollars either in terms of portfolio or direct investment. Governmental stability, surely one of the most important considerations of foreign investors when international alternatives are reviewed, also plays an important role. The information needed to enter new or changing markets and control risk is difficult to obtain and expensive to compile. Now available in one source, The Global Trade and Investment Handbook is the first comprehensive source of available information on business practices, regulations, foreign trade and investment law written for foreign investors. This volume triumphs in providing in one, country-by-country reference format, a complete and readily accessible overview of foreign trade and investment law for 155 countries. For every country included, from Albania to Zimbabwe, the reader will find a complete review of relevant topics, including Political Environment, Foreign Investment Policy, Permitted Business Organizations, Environmental Protection, Rights and Obligations of Foreign Investors, and Labor Laws; Accounting Requirements, Currency Controls, Taxation, Legal System, Customs and Duties, Protection of Intellectual Property, Immigration and Residence, andWhere to Find Investment Assistance.

Book excerpt: This document provides an overview of trade relations between Asia and the Pacific and Latin America and explores the possibilities for expanding the trade relations between the two regions. The analysis covers 12 regions in Asia and Oceania and 11 members of the Latin American Integration Association (LAIA). Present economic relations do not reflect the potential for interregional trade and investment. The Governments of both regions have increasingly recognised the need to institutionalise the mechanism of consultation and to possibly implement joint actions in order to strengthen bi-regional economic relations. This document analyses the present level of, and future potential for interregional trade and investment flows and makes recommendations in five areas: mechanisms for consultation on issues related to trade and investment; information creation and exchange; guidelines for trade facilitation action plan and investment promotion action plan; business community participation and, economic and technical co-operation.

Book excerpt: Substantial increases in agricultural investments in developing countries are needed to combat poverty and realize food security and nutrition goals. There is evidence that agricultural investments can generate a wide range of developmental benefits, but these benefits cannot be expected to arise automatically and some forms of large-scale investment carry risks for host countries. Although there has been much debate about the potential benefits and risks of international investment, there is no systematic evidence on the actual impacts on the host country and their determinants. In order to acquire an in-depth understanding of potential benefits, constraints and costs of foreign investment in agriculture and of the business models that are more conducive to development, FAO has undertaken research in developing countries. This publication summarizes the results of this research, in particular through the presentation of the main findings of case studies in nine developing countries. It presents case studies on policies to attract foreign investment in agriculture and their impacts on national economic development in selected countries in Africa, Asian and Latin America.

Book excerpt: The Committee on Foreign Investment in the United States (CFIUS) is comprised of nine members, two ex officio members, and other members as appointed by the President representing major departments and agencies within the federal executive branch. While the group generally has operated in relative obscurity, the proposed acquisition of commercial operations at six U.S. ports by Dubai Ports World in 2006 placed the group's operations under intense scrutiny by Members of Congress and the public. Prompted by this case, some Members of the 109th and 110th Congresses questioned the ability of Congress to exercise its oversight responsibilities given the general view that CFIUS's operations lack transparency. Other Members revisited concerns about the linkage between national security and the role of foreign investment in the U.S. economy. Some Members of Congress and others argued that the nation's security and economic concerns have changed since the September 11, 2001, terrorist attacks and that these concerns were not being reflected sufficiently in the Committee's deliberations. In addition, anecdotal evidence seemed to indicate that the CFIUS process was not market neutral. Instead, a CFIUS investigation of an investment transaction may have been perceived by some firms and by some in the financial markets as a negative factor that added to uncertainty and may have spurred firms to engage in behavior that may not have been optimal for the economy as a whole. On July 12, 2016, Senator Charles Grassley introduced S. 3161 to include the Secretary of Agriculture as a permanent member of the CFIUS and to include the national security impact of foreign investments on agricultural assets as part of the criteria the Committee uses in deciding to recommend that the President block a foreign acquisition.

Book excerpt: During the 1990s, the governments of South Asian countries acted as ‘facilitators’ to attract FDI. As a result, the inflow of FDI increased. However, to become an attractive FDI destination as China, Singapore, or Brazil, South Asia has to improve the local conditions of doing business. This book, based on research that blends theory, empirical evidence, and policy, asks and attempts to answer a few core questions relevant to FDI policy in South Asian countries: Which major reforms have succeeded? What are the factors that influence FDI inflows? What has been the impact of FDI on macroeconomic performance? Which policy priorities/reforms needed to boost FDI are pending? These questions and answers should interest policy makers, academics, and all those interested in FDI in the South Asian region and in India, Pakistan, Bangladesh, Sri Lanka and Pakistan.
