Book excerpt: U.S. trade obligations derive from international trade agreements, including the General Agreement on Tariffs and Trade (GATT), the other World Trade Organization (WTO) agreements, and additional bilateral and regional trade agreements, as well as domestic laws intended to implement those agreements or effectuate U.S. trade policy goals. This report provides an overview of both sources of U.S. trade obligations, focusing on a select group of agreements, provisions, and statutes that are most commonly implicated by U.S. trade interests and policy. This report is not intended as a comprehensive review of trade law. It is an introductory overview of the legal framework governing trade-related measures.

Book excerpt: Monitoring and enforcing trade agreements is a key element of the U.S. government's efforts to boost exports of U.S. goods and services. The vast majority of U.S. exports, which totaled $2.26 trillion in 2015, are covered by at least one trade agreement to which the United States is a party. These agreements include multilateral World Trade Organization agreements and bilateral or regional FTAs with 20 countries. The Office of the U.S. Trade Representative and several other federal agencies share responsibility for monitoring and enforcing partner countries' compliance with trade agreements. The U.S. government also provides trade capacity-building assistance, which includes goals to help partner countries meet their obligations under trade agreements. This report (1) examines agencies' resources and activities for monitoring and enforcing international trade agreements in fiscal year 2016 and (2) identifies agencies' trade capacity-building projects, active in fiscal year 2016, to assist FTA partner countries in meeting their obligations under these agreements. GAO is making no recommendations in this report.

This book was released on 2008-02-19 with total page 504 pages. Available in PDF, EPUB and Kindle. Book excerpt: With the intensified focus on antiterrorism in US trade policy — and the transfer of the Customs Service from the US Treasury Department to the Department of Homeland Security as the Bureau of Customs and Border Protection — traditional ways of thinking about customs and trade law are now out of date. In light of the war on terrorism and the emphasis on border security, businesses engaged in the cross-border exchange of goods face a multitude of new laws and initiatives — in addition to the traditional array of responsibilities required by the US Bureau of Customs and Border Protection and Immigration and Customs Enforcement. While these regulations are intended to strengthen border security, without careful planning they may have the unfortunate result of hindering the efficient movement of goods. In addition to updated customs forms and helpful appendices, this third edition covers the burgeoning area of free trade agreements between the US and countries around the globe. These agreements are a critical aspect of US bilateral trade relations, affecting not only duty rates but also rules of origin and policies on investment, trade in services and access to Government procurement markets. In sum, this book is an invaluable tool for a host of international trade professionals including in-house counsel dealing with import-export issues, corporate logistic managers, regulatory and compliance managers, and import-export specialists.

Available in PDF, EPUB and Kindle. Book excerpt: This important new book deals with the formation and regulation of regional trade agreements in the context of the WTO legal regime and Eastern and Southern African countries, specifically those nations that make up the Common Market for Eastern and Southern Africa (COMESA). Despite a poor track record, regional integration has for a long time been, and remains, the preferred path to economic development and poverty alleviation among developing countries in Africa. Regional integration undoubtedly holds great promise for developing nations in Africa. Many African countries stand to gain from pooling their meager resources and thus being able to participate more meaningfully in the international arena. However, the rhetoric surrounding integration has not been matched by actions and the record of trade liberalization has been weak. Substantive action appears to be taking a back seat to formal statements and declarations. This book consequently addresses four related critical issues: (1) compliance with rules and regime design, (2) the relationship between regionalism and multilateralism, (3) the legal regime created by Article XXIV and the Enabling Clause of the General Agreement on Tariffs and Trade, and (4) the COMESA legal regime. Product highlights Provides readers with expert perspective on regional trade agreements, an area of growing concern to practitioners, academics, and government officials. Will squarely address a current lack of actionable analysis, applying an international relations perspective to the analysis of regional trade integration.

Available in PDF, EPUB and Kindle. Book excerpt: The book examines trade agreements in the context of the current world economic crisis and the uncompleted World Trade Organization (WTO) Doha Round of trade negotiations. With economies shrinking and protectionism on the rise, many fear a protracted global recession. This raises important questions as to what role trade agreements – multilateral, plurilateral, and bilateral – should be playing in the current climate of uncertainty, and how best to plan for a more stable economic future. Previous assumptions are now being questioned, making this an opportune time to critically examine the WTO, free trade agreements, bilateral investment treaties, and other international economic law instruments. Furthermore, participants in international agreements are concerned with emerging issues that have the potential to strengthen or weaken the global trading system, including matters of treaty interpretation; terms of new agreements; and effects of existing provisions. This book provides a timely addition to the international economic law literature, as its submissions have been prepared during a time of unusual uncertainty and economic change; individuals interested in international economic law will seek scholarship that recognizes the current international economic climate. This book should be of interest to a wide range of academics and student researchers, as well as policymakers and practitioners.

Available in PDF, EPUB and Kindle. Book excerpt: The intersection of insurance regulation and trade agreements is of obvious significance to international competitiveness and, thereby, to national welfare. Yet until this masterful study the subject has remained virtually unexplored. Insurance Regulation in North America, far from merely addressing this important area of theory and practice, superbly balances a world of detailed analysis and commentary with deeply insightful interpretation and debate. The book's focus on insurance regulation in three countries allows the authors to approach the subject in an extraordinary depth that could not be achieved in a more global account. In the course of their treatment the authors offer the reader the following invaluable insights, among many others:analysis of the political dimension of reaching agreements and of implementing them;comparison of the three major trade agreements that apply in the North American insurance market'NAFTA, WTO agreements on financial services, and MEUFTA (the Mexico-European Union Free Trade Agreement)'with emphasis on the relationship between GATS and NAFTA principles;investigation of the clear convergence of regulatory schemes and the probable limits to harmonization;discussion of the arbitrage by which companies get around regulatory restrictions and exploit opportunities created by loopholes;clarification of the crucial issues surrounding the role of customary international law principles in investor protection obligations;discussion of the level of government and which government agencies a company must turn to in order to satisfy legal requirements;analysis of the jurisprudence of the Supreme Court of Mexico regarding legal effects of treaties on domestic law;commentary on the effects of demutualization and of mergers and acquisitions;discussion of the effect of the entrenchment of U.S. State regulations and the federal government's lack of clear power to force State compliance; anddescription of dispute settlement procedures between governments. Although important issues arising in each of the three countries are all covered, there is an emphasis on the Mexican market in recognition of Mexico's greater future growth potential and of the relative paucity of relevant literature in English. Major case studies that reveal processes of compliance or conflict are analyzed in detail. For insurance professionals'lawyers, business executives, and policymakers'who want to understand what international trade agreements contain, how they work, and how they affect domestic insurance regulation and business strategy in what is rapidly becoming a global market for insurance and other financial services, this book is a gold mine. Scholars and academics in insurance law and international economic law will also find here a fresh new treatise of great significance.
