Download or read book Copyright Law written by Brian Fitzgerald and published by Routledge. This book was released on 2017-07-05 with total page 604 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume reproduces writings, social teachings, testimonies and reports of figures as diverse as Karl Marx, Victor Hugo, Charles Dickens and Mark Twain, and bodies such as the US Congress. Extracted material charts the development of an international system of copyright regulation, and the growth, in the 20th century, of copyright industries benefitting from new copyright laws. In the second half of the 19th century, many writers and thinkers, like Marx, attacked capital, and its corollary, property rights. Some writers, such as Victor Hugo, while exposing the horrors of poverty and social alienation, demanded for authors rights of property. The modern system of copyright substantially originates from the efforts of Hugo and others. Articles by leading US copyright scholars such as Jessica Litman and Tim Wu explain the development of copyright law in the 20th century, and are complemented by reproduction of key copyright cases in the US and UK, as well the primary copyright legislation in those countries. Contributors examine critically whether copyright law in the 20th century developed to encourage information dissemination or enable producers to control the supply of information for super profit.

Book excerpt: Professor Litman's work stands out as well-researched, doctrinally solid, and always piercingly well-written.-JANE GINSBURG, Morton L. Janklow Professor of Literary and Artistic Property, Columbia UniversityLitman's work is distinctive in several respects: in her informed historical perspective on copyright law and its legislative policy; her remarkable ability to translate complicated copyright concepts and their implications into plain English; her willingness to study, understand, and take seriously what ordinary people think copyright law means; and her creativity in formulating alternatives to the copyright quagmire. -PAMELA SAMUELSON, Professor of Law and Information Management; Director of the Berkeley Center for Law & Technology, University of California, BerkeleyIn 1998, copyright lobbyists succeeded in persuading Congress to enact laws greatly expanding copyright owners' control over individuals' private uses of their works. The efforts to enforce these new rights have resulted in highly publicized legal battles between established media and new upstarts. In this enlightening and well-argued book, law professor Jessica Litman questions whether copyright laws crafted by lawyers and their lobbyists really make sense for the vast majority of us. Should every interaction between ordinary consumers and copyright-protected works be restricted by law? Is it practical to enforce such laws, or expect consumers to obey them? What are the effects of such laws on the exchange of information in a free society?Litman's critique exposes the 1998 copyright law as an incoherent patchwork. She argues for reforms that reflect common sense and the way people actually behave in their daily digital interactions. This paperback edition includes an afterword that comments on recent developments, such as the end of the Napster story, the rise of peer-to-peer file sharing, the escalation of a full-fledged copyright war, the filing of lawsuits against thousands of individuals, and the June 2005 Supreme Court decision in the Grokster case.Jessica Litman (Ann Arbor, MI) is professor of law at Wayne State University and a widely recognized expert on copyright law.

Book Synopsis Copyright and the Challenge of the New by : Brad Sherman
Download or read book Copyright and the Challenge of the New written by Brad Sherman and published by Kluwer Law International B.V.. This book was released on 2012-08-01 with total page 458 pages. Available in PDF, EPUB and Kindle. Book excerpt: Copyright is not, as is often thought, something that is periodically ‘extended’ to cover a new field or medium; rather, copyright redefines itself whenever its efficacy is challenged. While many factors have contributed to this process, the most consistent has been the challenges created by new technologies. The contributing authors build upon this insight to show that copyright law is, and has always been, a creature of technology. Each chapter focuses on a specific technology or group of technologies – photography, telegraphy, the phonogram, radio, film, the photocopier, the tape player, television, and computer programs – emphasizing the changes that each technology instigated and the challenges and opportunities it created. Perhaps the most profound insight of this extraordinary book is the authors’ claim – ably supported in a series of intriguing chapters – that the way the law responds and reacts to new technologies is always mediated by the political, social, economic, and cultural environment in which the interaction occurs. For example, these chapters describe and explain how: statutory schemes of remuneration arose from failures to effectively police new forms of piracy; persistent litigation and lobbying by copyright owners forces legislatures and courts to devise new laws; content (e.g., sporting events) generates new rules of access to broadcasts; and ‘fair copying’ (e.g., by libraries) is the necessary exception that proves the rule. As well as providing insight into the ways that copyright law interacted with old technologies when they were new, the book also offers important insights into problems and issues currently confronting copyright law and policy such as the appropriate scope of copyright and the relation between copyright and the public interest. With the broad perspectives opened by these essays, academics, practitioners and policymakers in the field will find themselves well equipped to deal with the problems that will inevitably be created by technologies in the future.

Download or read book The Hollywood Trust written by Kia Afra and published by Rowman & Littlefield. This book was released on 2016-06-22 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: As the film industry was establishing itself at the start of the twentieth century, trade associations played a pivotal role in the emergence of the studio system. These producer-distributor trade associations were forums for internal and external conflicts, as well as the true sources of influence and power in early Hollywood. In The Hollywood Trust: Trade Associations and the Rise of the Studio System, Kia Afra provides a detailed account of three successive trade organizations from 1915 to 1928. By examining the Motion Picture Board of Trade, the National Association of the Motion Picture Industry (NAMPI), and the Motion Picture Producers and Distributors of America (MPPDA), Afra outlines the relationships of power in Hollywood’s early years, asking questions such as: How and why did the studio system come about, and what were the industrial and institutional forces that impacted Hollywood’s development? In order to answer these crucial questions, The Hollywood Trust explores the role played by film industry trade associations in navigating important issues facing the burgeoning studio system, including censorship, public relations, trade practices, government regulation, film distribution, labor conflicts, taxes and tariffs, and exhibitor opposition. A vital look at an under-reported aspect of the studio system, this volume fills a gap in the history of the American film industry. As such The Hollywood Trust will be of particular interest to scholars of film history, as well as those concerned with cultural history and the political economics of entertainment.
