But the United States has done almost nothing to prosecute past abuses or prevent future violations. Tracing this knotty contradiction from the 1950s to the present, historian Alfred W. McCoy probes the political and cultural dynamics that have made impunity for torture a bipartisan policy of the U.S. government. During the Cold War, McCoy argues, the U.S. Central Intelligence Agency covertly funded psychological experiments designed to weaken a subject’s resistance to interrogation. After the 9/11 terrorist attacks, the CIA revived these harsh methods, while U.S. media was flooded with seductive images that normalized torture for many Americans. Ten years later, the U.S. had failed to punish the perpetrators or the powerful who commanded them, and continued to exploit intelligence extracted under torture by surrogates from Somalia to Afghanistan. Although Washington has publicly distanced itself from torture, disturbing images from the prisons at Abu Ghraib and Guantanamo are seared into human memory, doing lasting damage to America’s moral authority as a world leader.

Book excerpt: This book examines selected legal complexities of the notion of torture and the issue of the proper foundation for legally characterizing certain acts as torture, especially when children are the targeted victims of torture. ICC case law is used to highlight the International Criminal Court’s reluctance in practice to prosecute as a separable offence the crime of torture as set out in one or more of the relevant provisions of the Rome Statute where children are the particularized targets as part of a common plan during armed conflict. Also addressed is the failure of the ICC to consider that the young age of the victims of torture (i.e. children) should be an aggravating factor taken into account in determining the ICC sentence for those convicted of the torture of civilians, including children, in the context of armed conflict as part of a common plan. The six UN-designated grave crimes against children (including child soldiering for State or non-State forces perpetrating mass atrocities, and sexual violence perpetrated on a systematic and widespread basis against children including child soldiers), it is argued, are also instances of the torture of children as part of a common plan such that separate charges of torture are legally supportable (along with the other charges relating to additional Rome Statute offences involved in such circumstances). Useful legal perspectives on the issue of the torture of children in its various manifestations gleaned from the case law of other international judicial forums such as the Inter-American Court of Human Rights and the ICTY are also examined.

By investigating in detail the imagery of the Vietnamese landscape recreated by American authors and directors, the volume explores the proposition that Vietnam has been turned into an American myth, demonstrating that the process resulted in a dehistoricization and mystification of the conflict that obscured its historical and political realities. Against this background, representations of the war’s victims—Vietnamese civilians and American soldiers—are then considered in light of their ideological meanings and uses. The afflictions of religious minorities are a day to day affair. In the society, a privileged class is making mountains with money. On the other side, majority people, not less than 95%, are becoming poorer everyday. Religious minorities and the indigenous people are deprived of constitutional rights. Including the father of the nation, hundreds of politicians, journalists, lawyers, judges, members and common people have been killed. Different state-controlled armed cadres have created an extreme fearful and inhuman situation by their killings of innocent people, tortures and oppressions. Within 38 years of independence, the country was under the military rulers for long 17 years. People were pushed to the dark-wild-administration and its persecutions.
