Book excerpt: This monograph analyses the historical evolution of the laws of occupation as a special branch of international humanitarian law (IHL), focusing on the extent to which this body of law has been transformed by its interaction with the development of international human rights law. It argues that a large part of the laws of occupation has proved to be malleable while being able to accommodate changing demands of civilians and any other persons affected by occupation in modern context. Its examinations have drawn much on archival research into the drafting documents of the instruments of IHL, including the aborted Brussels Declaration 1874, the 1899/1907 Hague Regulations, the 1949 Geneva Conventions and the 1977 Additional Protocol I. After assessing the complementary relationship between international human rights law and the laws of occupation, the book examines how to provide a coherent explanation for an emerging framework on the rights of individual persons affected by occupation. It engages in a theoretical appraisal of the role of customary IHL and the Martens clause in building up such a normative framework.

Book excerpt: This absorbing book draws upon new research and works that, in some cases were held out of public view in Picasso's own collection, to explore the critically important--but still under-studied--period of his life from the Spanish Civil War through World War II and the Nazi occupation of France. This span of years is marked by some of the most intensely personal and expressive work of his career. The subjects he painted changed dramatically in direct response first to the horrors of war and then the dangers and privations of life in occupied Paris, where, though branded a degenerate artist by the Nazis, he chose to remain until the Liberation.

Available in PDF, EPUB and Kindle. Book excerpt: The laws are not silent in war, but what should they say? What is the moral function of the law of armed conflict? Should the law protect civilians who do not fight but help those who do? Should the law protect soldiers who perform non-combat functions or who may be safely captured? How certain should a soldier be that an individual is a combatant rather than a civilian before using lethal force? What risks should soldiers take on themselves to avoid harming civilians? When do inaccurate weapons become unlawfully indiscriminate? When does "collateral damage" to civilians become unlawfully disproportionate? Should civilians lose their legal rights by serving, voluntarily or involuntarily, as human shields? Finally, when should killing civilians constitute a war crime? These are the questions that Law and Morality at War answers, contributing to a cutting-edge international debate. Drawing on the concepts and methods of contemporary moral and legal philosophy, the book develops a normative framework within which the laws of war and international criminal law can be evaluated, criticized, and reformed. While several philosophical works critically examine the moral status of civilians and combatants, this book fills a gap, offering both an account of the laws of war and war crimes, and proposing how the law could be improved from a moral point of view. Finally, it explores when, if ever, the emotional pressures under which soldiers act should partially or wholly excuse their wrongful actions.

Buis examines the sources of classical Greece to challenge both the state-centeredness of mainstream international legal history and the omnipresence of war and excessive violence in ancient times. Making ample use of epigraphic as well as literary, rhetorical, and historiographical sources, the book offers the first widespread account of the narrative foundations of the (il)legality of warfare in the classical Hellenic world. In a clear yet sophisticated manner, Buis convincingly proves that the traditionally neglected study of the performance of ancient Greek poleis can contribute to a better historical understanding of those principles of international law underlying the practices and applicable rules on the use of force and the conduct of hostilities.

Available in PDF, EPUB and Kindle. Book excerpt: While scholars recognize both museums and films as sites where historical knowledge and cultural memory are created, the convergence between their methods of constructing the past has only recently been acknowledged. The essays in Exhibiting the German Past examine a range of films, museums, and experiences which blend the two, considering how authentic objects and cinematic techniques are increasingly used in similar ways by both visual media and museums. This is the first collection to focus on the museum–film connection in German-language culture and the first to approach the issue using the concept of “musealization,” a process that, because it engages the cultural destruction wrought by modernization, offers new means of constructing historical knowledge and shaping collective memory within and beyond the museum’s walls. Featuring a wide range of valuable case studies, Exhibiting the German Past offers a unique perspective on the developing relationship between museums and visual media.

Available in PDF, EPUB and Kindle. Book excerpt: This is a history of how twentieth-century Britons came to view themselves and their world in psychological terms, and how this changed over time. It examines the extent to which psychological thought and practice could mediate, not just understanding of the self, but also a wide range of social and economic, political, and ethical issues that rested on assumptions about human nature. In doing so, it brings together high and low psychological cultures; it focuses not just on health, but also on education, economic life, and politics; and it reaches from the start of the century right up to the 1970s.Mathew Thomson highlights the intense excitement surrounding psychology at the start of the century, and its often highly unorthodox expression in thought and practice. He argues that the appeal of psychological thinking has been underestimated in the British context, partly because its character has been misconstrued. Psychology found a role because, rather than shattering values, it offered them new life. The book considers the extent to which such an ethical and social psychologicalsubjectivity survived the challenges of an industrial civilization, a crisis in confidence regarding human nature wrought by war and political extremism, and finally the emergence of a permissive society. It concludes that many of our own assumptions about the route to psychological modernity - centred onthe rise of individualism and interiority, and focusing on the liberation of emotion, and on talk, relationships, and sex - need substantial revision, or at least setting alongside a rather different path when it comes to the Britain of 1900-70.

Book excerpt: A history of the steel and arms maker that came to symbolize the best and worst of modern German history The history of Krupp is the history of modern Germany. No company symbolized the best and worst of that history more than the famous steel and arms maker. In this book, Harold James tells the story of the Krupp family and its industrial empire between the early nineteenth century and the present, and analyzes its transition from a family business to one owned by a nonprofit foundation. Krupp founded a small steel mill in 1811, which established the basis for one of the largest and most important companies in the world by the end of the century. Famously loyal to its highly paid workers, it rejected an exclusive focus on profit, but the company also played a central role in the armament of Nazi Germany and the firm's head was convicted as a war criminal at Nuremberg. Yet after the war Krupp managed to rebuild itself and become a symbol of Germany once again—this time open, economically successful, and socially responsible. Books on Krupp tend to either denounce it as a diabolical enterprise or celebrate its technical ingenuity. In contrast, James presents a balanced account, showing that the owners felt ambivalent about the company's military connection even while becoming more and more entangled in Germany's aggressive politics during the imperial era and the Third Reich. By placing the story of Krupp and its owners in a wide context, James also provides new insights into the political, social, and economic history of modern Germany.
