Book excerpt: Concerned about the capacity of the on-line industry to collect, store, and analyze vast amounts of data about consumers visiting commercial web sites, the FTC reported in May 2000 on its most recent privacy survey of commercial web sites. The survey's objective was to assess the on-line industry's progress in implementing four fair information principles which FTC believes are widely accepted. Notice. Data collectors must disclose their information practices before collecting personal information from consumers. Choice. Consumers must be given options with respect to whether and how personal information collected from them may be used for purposes beyond those for which the information was provided. Access. Consumers should be able to view and contest the accuracy and completeness of data collected about them. Security. Data collectors must take reasonable steps to ensure that information collected from consumers is accurate and secure from unauthorized use. in addition, the survey looked at the use of third-party cookies by commercial web sites. Although FTC noted improvement over previous surveys, ft nonetheless concluded that the on-line industry's self-regulatory initiatives were falling short. As a result, a majority of the FTC commissioners, based on a 3 to 2 vote, recommended legislation to require commercial web sites not already covered by the Children's Online Privacy Protection Act (COPPA) to implement the four fair Information principles.

These best practices include making privacy the “default setting” for commercial data practices and giving consumers greater control over the collection and use of their personal data through simplified choices and increased transparency. Implementing these best practices will enhance trust and stimulate commerce. This Report follows a preliminary staff report that the Federal Trade Commission (“FTC” or “Commission”) issued in December 2010. The preliminary report proposed a framework for protecting consumer privacy in the 21st Century. Like this Report, the framework urged companies to adopt the following practices, consistent with the Fair Information Practice Principles first articulated almost 40 years ago:

On May 30, 2012, the FTC held a workshop entitled “In Short: Advertising and Privacy Disclosures in a Digital World.” The concluding panel at that workshop explored how privacy disclosures on mobile devices could be short, effective, and accessible to consumers.Based on more than a decade of work on mobile privacy issues and recent data obtained through panel discussions and comments, the Commission offers this staff report providing recommendations for best practices on mobile privacy disclosures. First, the report reviews the benefits and privacy risks of mobile technologies. Second, it discusses the FTC's efforts to address mobile privacy, as well as its research on disclosure issues generally. It then summarizes general themes raised by panel participants. Finally, it sets forth recommendations for best practices to key commercial players involved in the mobile arena – platforms, app developers, third parties such as ad networks and analytics companies, and trade associations. The recommendations are intended to promote more effective privacy disclosures.
