The present article aims to analyze and clarify the importance of the impacts that can generate the Colombia-US free trade agreement on tourism and hospitality sector in Colombia; although, it was not an issue directly addressed in the free trade agreement, it will have effects in short and long term. Furthermore, tourism is an open discipline, and the changes in national and international economy may come to affect both positively and negatively. The main objective is to identify how the free trade agreement with the U.S. will affect the tourism and hotel industry in Colombia.

The U.S. FTA model become an instrument of integration “ideal” to enhance its geopolitical and geo-economic interests in the Americas, since it facilitates the construction of small blocks that will improve the U.S. weight on the international scene and in some sectors international trade. In this context, the aim of this paper is to analyze this model “made to order” by the U.S. to regulate and deepen trade liberalization, without considering in any way a greater degree of integration with Latin American countries.

Available in PDF, EPUB and Kindle. Book excerpt: The slow pace of the Doha Round has boosted the proliferation of regional and bilateral trade agreements. Paradoxically, the more powerful actors, the US and the European Union, who at the same time have benefited the most from the multilateral system, have also been engaged in bilateral and regional negotiations in order to sign WTO-plus agreements with developing countries. Combining a clear theoretical exposition with systematic cross-regional analysis, 'Asymmetric Trade Negotiations' offers a coherent picture of strategic, design and political economy aspects of North-South trade negotiation processes, from African, Asian and Latin American perspectives. Skilled area specialists gather to provide negotiators and policy makers in the South with recommendations, best practices, and benchmarks and contribute to the understanding of these recent processes.

Available in PDF, EPUB and Kindle. Book excerpt: In 2004, the United States, five Central American countries, and the Dominican Republic signed the Central American Free Trade Agreement (CAFTA), signaling the region's commitment to a neoliberal economic model. For many, however, neoliberalism had lost its luster as the new century dawned, and resistance movements began to gather force. Contesting Trade in Central America is the first book-length study of the debate over CAFTA, tracing the agreement's drafting, its passage, and its aftermath across Central America. Rose J. Spalding draws on nearly two hundred interviews with representatives from government, business, civil society, and social movements to analyze the relationship between the advance of free market reform in Central America and the parallel rise of resistance movements. She views this dynamic through the lens of Karl Polanyi's "double movement" theory, which posits that significant shifts toward market economics will trigger oppositional, self-protective social countermovements. Examining the negotiations, political dynamics, and agents involved in the passage of CAFTA in Costa Rica, El Salvador, and Nicaragua, Spalding argues that CAFTA served as a high-profile symbol against which Central American oppositions could rally. Ultimately, she writes, post-neoliberal reform "involves not just the design of appropriate policy mixes and sequences, but also the hard work of building sustainable and inclusive political coalitions, ones that prioritize the quality of social bonds over raw economic freedom."

Available in PDF, EPUB and Kindle. Book excerpt: Collecting and synthesizing a series of essays on the political economy of trade and development policy, this book explores the following research questions: to what extent is the global trading regime reducing the ability of nation-states to pursue policies for financial stability and economic growth; and what political factors explain such changes in policy space over time, across different types of trade treaties and across nations? Gallagher presents intriguing findings on the policy constraints on the Uruguay Round, as well as the significant restrictions that the USA places upon the ability of developing nations to deploy a range of development strategies for stability and growth. Analyzing the factors that have led to twenty-first-century trade politics being characterized by a “clash of globalizations,” this volume explores the role of economic power, institutional structure, domestic politics, currency fluctuations and ideas about globalization in effecting changes to global trade policies.

Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this monograph provides a survey and analysis of the rules concerning Intellectual Property Law in Colombia. It covers every type of intellectual property right in depth – copyright and neighbouring rights, patents, utility models, trademarks, trade names, industrial designs, plant variety protection, chip protection, trade secrets, and confidential information. Particular attention is paid throughout to recent developments and trends. The analysis approaches each right in terms of its sources in law and in legislation, and proceeds to such legal issues as subject matter of protection, conditions of protection, ownership, transfer of rights, licences, scope of exclusive rights, limitations, exemptions, duration of protection, infringement, available remedies, and overlapping with other intellectual property rights. The book provides a clear overview of intellectual property legislation and policy, and at the same time offers practical guidance on which sound preliminary decisions may be based. Lawyers representing parties with interests in Intellectual Property Law in Colombia will welcome this very useful guide, and academics and researchers will appreciate its value in the study of comparative intellectual property law.
