Book excerpt: The Tibetan Policy Act of 2002 (TPA) is a core legislative measure guiding U.S. policy toward Tibet. Its stated purpose is "to support the aspirations of the Tibetan people to safeguard their distinct identity." Among other provisions, the TPA establishes in statute the State Department position of Special Coordinator for Tibetan Issues and defines the Special Coordinator's "central objective" as being "to promote substantive dialogue" between the government of the People's Republic of China and Tibet's exiled spiritual leader, the Dalai Lama, or his representatives. The Special Coordinator is also required, among other duties, to "coordinate United States Government policies, programs, and projects concerning Tibet"; "vigorously promote the policy of seeking to protect the distinct religious, cultural, linguistic, and national identity of Tibet"; and press for "improved respect for human rights." While the Special Coordinator coordinates Tibet-related U.S. government programs, congressional mandates and earmarked appropriations for most such programs are contained in legislation other than the TPA. The programs include assistance for nongovernmental organizations to work in Tibetan communities in China; an educational and cultural exchange program with "the people of Tibet"; Voice of America and Radio Free Asia Tibetan-language broadcasting into Tibet; assistance for Tibetan refugees in South Asia; a scholarship program for Tibetans outside Tibet; and National Endowment for Democracy programs relating to Tibet. Congress has shown a strong interest in Tibet since the 1980s, passing dozens of laws and resolutions related to Tibet, speaking out about conditions in Tibet, and welcoming visits by the Dalai Lama and, more recently, the political head of the India-based Central Tibetan Administration. Such actions have long been a source of friction in the U.S.-China relationship. China charges that they amount to support for challenges to Chinese rule in Tibet.

Book excerpt: These views include assessments on the nature of the objectives the TPA sets forth for U. S. policy; the attainability of those objectives; the achievements of the Special Coordinators; and the manner of the Act's implementation. [...] Its provisions on Tibet stated that U. S. policy toward China should be explicitly linked with the situation in Tibet, specifically to include lifting of martial law in Lhasa and other parts of Tibet; opening Tibet to foreigners, including the press and international human rights organizations; release of political prisoners; and the conduct of negotiations between representatives of the Dalai Lam [...] Provisions to create a Special Envoy for Tibet also were introduced as sections of authorization bills in the 104th and the 105th Congresses.18 In each case, the provision called for the Special Envoy to have ambassadorial rank and to actively promote negotiations between the Dalai Lama and the Chinese government. [...] Implementation Various views exist on how effective the Tibetan Policy Act has been since its enactment, including different views on the objectives the TPA sets forth for U. S. policy; the attainability of those objectives; the achievements of the Special Coordinators; and the manner of the Act's implementation. [...] According to observers, an official at the Under-Secretary level is in a position to have more avenues of input in U. S. policy issues, including regular access to the Secretary of State, participation in senior- level U. S. government meetings, and the opportunity to travel to China with the President and sit in on his meetings with the Dalai Lama.

Into Tibet is the incredible story of a 1949–1950 American undercover expedition led by America’s first atomic agent, Douglas S. Mackiernan—a covert attempt to arm the Tibetans and to recognize Tibet’s independence months before China invaded. A Nepal-based American journalist reveals how the clash between the State Department and the CIA, as well as unguided actions by field agents, hastened the Chinese invasion of Tibet. A gripping narrative of survival, courage, and intrigue among the nomads, princes, and warring armies of inner Asia, Into Tibet rewrites the accepted history behind the Chinese invasion of Tibet. “A gripping tale.” —The Washington Post

U.S. concern over human rights in China has been a central issue in U.S.-China relations, particularly since the Tiananmen crackdown in 1989. In recent years, human rights conditions in China have deteriorated, while bilateral tensions related to trade and security have increased, possibly creating both constraints and opportunities for U.S. policy on human rights.

Book excerpt: This bipartisan report from the staff of the Senate Foreign Relations Comm. (SFRC) presents their findings from a visit to Tibet from Sept. 719, 2010. Four staff members, accompanied by officials from the U.S. Embassy in Beijing, traveled to the Tibet Autonomous Region (TAR) and Tibetan regions of Western China. It was the first trip to Tibet by SFRC staff since Aug. 2002. The delegation was the first Senate staff delegation permitted by Chinese authorities to travel to Tibet since largescale peaceful protests and some riots shook the region in March 2008. While our delegation was in Lhasa, the Chinese granted formal approval for U.S. Ambassador Jon Huntsman to visit Tibet. The staff delegation was the result of more than a year of planning, including extensive consultations with the Chinese government and representatives of His Holiness the Dalai Lama and other Tibetan exiles, with human rights advocacy groups, nongovernmental organizations, Tibetan activists inside China, and Chinese and Western academics. The itinerary was designed to provide a glimpse into the lives of Tibetans from many walks of life - herders, monks, pilgrims, small business operators, teachers. It was also designed to provide access to both rural and urban areas. Includes recommendations for U.S. Tibet policy. Color photos. This is a print on demand report.

Book excerpt: Why Tibetan monks are setting themselves on fire Since the 2008 uprising, nearly 150 Tibetan monks have set fire to themselves in protest at the Chinese occupation of their country. Most have died from their injuries. Author Tsering Woeser is a prominent voice of the Tibetan movement, and one of the few Tibetan authors to write in Chinese. Her stirring acts of resistance have led to her house arrest, where she remains under close surveillance to this day. Tibet On Fire is her account of the oppression Tibetans face and the ideals driving those who resist, both the self-immolators and other Tibetans like herself. With a cover image designed by Chinese dissident artist Ai Weiwei, Tibet on Fire is angry and cogent: a clarion call for the world to take action.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.
