This book was released on 2014-08 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: On 25 March 2014, the Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (Corps) jointly proposed a rule defining the scope of waters protected under the Clean Water Act (CWA). The proposal would revise regulations that have been in place for over 25 years. This book describes the proposed rule and includes a table comparing the existing regulatory language that defines "waters of the United States" with the proposal. In 2006, the Supreme Court decided Rapanos v. United States, the most recent and well-known of three Supreme Court decisions wrestling with the question of which wetlands are covered by the wetlands permitting program in the Clean Water Act. This book also provides background including the pre-Rapanos Supreme Court opinions, then moves on to Rapanos itself and the Corps/EPA guidance documents.

Book Synopsis The Clean Water Act Jurisdictional Handbook by : Roxanne Thomas
Download or read book The Clean Water Act Jurisdictional Handbook written by Roxanne Thomas and published by . This book was released on 2007-01-01 with total page 77 pages. Available in PDF, EPUB and Kindle. Book excerpt: In June 2006 the Supreme Court, in a decision that split 4-1-4, produced a result in Rapanos v. United States that makes federal Clean Water Act jurisdiction over the wetlands, streams, and other waters of the United States confusing and uncertain for citizens, landowners, and regulators alike. Members of Congress have introduced new legislation to restore jurisdiction over many of the waters cast into doubt by the decision; and the Environmental Protection Agency and Army Corps of Engineers (the federal regulatory agencies) issued a joint guidance document in June 2007 attempting to guide their respective staffs. Numerous federal courts have attempted to apply the uncertain teachings of Rapanos as well. With the support of the Turner Foundation, and the assistance of numerous experts in wetlands science and law, the Environmental Law Institute has prepared a handbook that analyzes the case law, compiles the relevant scientific studies, and provides a set of jurisdictional checklists. The Handbook will assist anyone faced with a jurisdictional question involving a wetland or stream to understand what factors will allow them to find Clean Water Act jurisdiction.
Book Synopsis Identifying Waters Protected by the Clean Water Act (CWA) by : Barry Leonard
Download or read book Identifying Waters Protected by the Clean Water Act (CWA) written by Barry Leonard and published by DIANE Publishing. This book was released on 2011-08 with total page 39 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the past decade, interpretations of Supreme Court (SC) rulings removed some critical waters from Fed. protection, and caused confusion about which waters and wetlands are protected under the CWA. As a result, important waters now lack clear protection under the law. This draft guidance clarifies how the EPA and the U.S. Army Corps of Engineers (ACE) will identify waters protected by the CWA and implement the SC¿s decisions concerning the extent of waters covered by the Act. It clarifies how the EPA and the ACE understand existing requirements of the CWA and provides guidance to agency field staff in making determinations about whether waters are protected by the CWA. This is a print on demand report.

Book excerpt: Recent Supreme Court rulings have called into question federal Clean Water Act coverage for certain wetlands and streams. Legislation recently introduced in the House of Representatives would amend the Act to restate and clarify Congress intent to regulate the waters of the United States to the fullest extent of its legislative power. The Environmental Law Institute has issued a new white paper that identifies which constitutional powers Congress can rely on to protect the Nations waters, and explains in straightforward language what the Supreme Court has said about these powers. The Supreme Court rulings in question (Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers, 2001, and Rapanos v. United States, 2006) were limited to interpreting Congressional intent in 1972, when Congress used the terms "navigable waters" and "waters of the United States" to assert federal jurisdiction under the Act. The Court has never decided the underlying constitutional question: what is the scope of Congresss constitutional authority to protect the Nations waters? ELIs legal analysis is intended to inform this debate.

Book Synopsis Water Policy in Minnesota by : K. William Easter
Download or read book Water Policy in Minnesota written by K. William Easter and published by Routledge. This book was released on 2014-04-23 with total page 337 pages. Available in PDF, EPUB and Kindle. Book excerpt: Minnesota has a unique role in U.S. water policy. Hydrologically, it is a state with more than 12,000 lakes, an inland sea, and the headwaters of three major river systems: the St Lawrence, the Red River of the North, and the Mississippi. Institutionally, Minnesota is also unique. All U.S. states use Total Maximum Daily Load (TMDL) approaches to addressing impaired waters. Every TMDL requires a substantial investment of resources, including data collection, modeling, stakeholder input and analysis, a watershed management plan, as well as process and impact monitoring. Minnesota is the only state in the union that has passed legislation (the 2007 Clean Water Legacy Act) providing significant resources to support the TMDL process. The book will be an excellent guide for policymakers and decision makers who are interested in learning about alternative approaches to water management. Non-governmental organizations interested in stimulating effective water quality policy will also find this a helpful resource. Finally, there are similarities between the lessons learned in Minnesota and the goals of water policy in several other states and nations, where there are competing uses of water for households, agriculture, recreation, and navigation.

Book Synopsis The Western Range Revisited by : Debra L. Donahue
Download or read book The Western Range Revisited written by Debra L. Donahue and published by University of Oklahoma Press. This book was released on 1999 with total page 404 pages. Available in PDF, EPUB and Kindle. Book excerpt: Livestock grazing is the most widespread commercial use of federal public lands. The image of a herd grazing on Bureau of Land Management or U.S. Forest Service lands is so traditional that many view this use as central to the history and culture of the West. Yet the grazing program costs far more to administer than it generates in revenues, and grazing affects all other uses of public lands, causing potentially irreversible damage to native wildlife and vegetation. The Western Range Revisited proposes a landscape-level strategy for conserving native biological diversity on federal rangelands, a strategy based chiefly on removing livestock from large tracts of arid BLM lands in ten western states: Arizona, California, Colorado, Idaho, Nevada, New Mexico, Oregon, Utah, Washington, Wyoming. Drawing from range ecology, conservation biology, law, and economics, Debra L. Donahue examines the history of federal grazing policy and the current debate on federal multiple-use, sustained-yield policies and changing priorities for our public lands. Donahue, a lawyer and wildlife biologist, uses existing laws and regulations, historical documents, economic statistics, and current scientific thinking to make a strong case for a land-management strategy that has been, until now, "unthinkable." A groundbreaking interdisciplinary work, The Western Range Revisited demonstrates that conserving biodiversity by eliminating or reducing livestock grazing makes economic sense, is ecologically expedient, and can be achieved under current law.
