Book excerpt: Under union shop agreements, labor unions must establish strict safeguards and procedures for ensuring that non-membersâ€TM dues are not used to support certain political and ideological activities which are outside the scope of normal collective bargaining activities. The “union shopâ€ŗ or “agency shopâ€ŗ agreement essentially provides that employees do not have to join the union, but must support the union in order to retain employment by paying dues to defray the costs of collective bargaining, contract administration, and grievance matters. In a line of decisions, the Supreme Court has addressed this issue and has concluded that compulsory union dues of non-members should not be used for political and ideological activities which are outside the scope of the unionsâ€TM collective bargaining and labor-management duties when non-members object to such use. Seven Supreme Court decisions have held that such union dues exacted from dissenting non-members were not to be used for political and ideological purposes and would have to be refunded in an expedited way to dissenting nonmembers in accordance with proper procedural safeguards: (1) International Association of Machinists v. Street, 367 U.S. 740 (1961); (2) Railway Clerks v. Allen, 373 U.S. 113 (1963); (3) Abood v. District Board of Education, 431 U.S. 209 (1977); (4) Ellis v. Brotherhood of Railway Clerks, 466 U.S. 435 (1984); (5) Chicago Teachers Union v. Hudson, 475 U.S. 292 (1986); (6) Communications Workers of America v. Beck, 487 U.S. 735 (1988); and Lehnert v. Ferris Faculty Association, 500 U.S. 507 (1991). In the 105th Congress, bills have been introduced which would allow labor organizations to use these dues and fees for political purposes only when the employee affirmatively, in writing, so authorizes. Other bills provide that labor organizations disclose the amount of union dues and agency fees used for political purposes and other specified activities. Finally, there are some bills that would repeal those provisions that require an employee join a union as a condition of employment.

Book excerpt: The National Labor Relations Board's (NLRB)seeming powerlessness to process dues objector cases has led to a proliferation of state sponsored "paycheck protection" laws and popular referenda devised to ensure that workers will not be obliged to pay dues for non-germane purposes. Recently, California captured national attention as the site of a richly contested paycheck protection referendum. Such proposals have electrified union advocates and have enlivened the debate over the proper use of union dues. In addition, recent attempts to reform campaign finance have run aground on the thorny issue of union political contributions (both in-kind and in cash). Concurrently, private sector unions continue to decline in significance as agents of change within the workplace. On the other hand, union influence within the political sector may be ascendant. This article inspects attempts to reclaim the labor movement and to enhance worker solidarity through expansive interpretations of the social and political meaning of union dues. By investigating whether the interests and identities of individuals or subgroups of workers are necessarily congruent with those of either the union majority or union leadership and by disputing dominant free-rider assumptions embedded in the Taft-Hartley Act, this approach, delegitimizes coerced transfers from union members and dues payers for political and other purposes. Methodologically, the article deploys postmodern insights, group cooperation theory and public choice theory to contest the prevailing view that individuals and identifiable subgroups of workers must sacrifice their particular interests and identities to the "greater totalizing goals of the working class." While postmodernism has its critics, the author argues that an expansive deployment of union dues to revitalize the union movement is inconsistent with the notion that the individual has the right to decide the proper ends of her life. Accordingly, the application of union dues to a variety of union efforts that are unrelated to collective bargaining, must inescapably be seen as a form of subservience to authoritarian unionist who seek to submerge both individual, ethnic, and gender identity and ideological diversity in support of hierarchical aims.

Book excerpt: Labor Unions are nonprofit organizations that provide laborers a voice before their employer and governments. They are classic interest groups. United States federal tax policy exempts labor unions from the income tax, but effectively prohibits labor union members from deducting union dues from the individual income tax. Because these two policies directly impact the political voice of laborers, I consider primarily the value of political fairness in evaluating these tax policies rather than the typical tax critique of economic fairness or efficiency. I apply a model that presumes our democracy should aim for one person, one political voice. For the model, political voice means the ability of citizens to participate in setting and discussing the political agenda and to vote on any final decision. In a modern democratic state, citizens largely depend upon organized interest groups to fulfill this role of political voice. In the Article, I demonstrate that tax policy applicable to labor unions likely modestly harms political voice equality. We allow almost all nonprofit interest groups to obtain tax exemption whether they face collective action challenges or not. This subsidizes interests that would organize without government assistance and fails to provide much support to those politically weak interests. A more neutral treatment would be to end tax exemption for both business interests and labor interests. Additionally, although the case is weak, we could maintain tax exemption for labor interests alone in order to modestly correct a political voice inequality associated with labor. Finally, we should allow union members to deduct union dues above the line to offer parity with the treatment of a businessman's dues.
