Book excerpt: Excerpt from The Trustee Act, 1893, and Other Recent Statutes Relating to Trustees: With Notes Some general rules for the guidance of trustees in selecting mortgage securities will be found on pp. 20 and 21. The authorities upon which those rules are based are discussed in Appendix A, pp. 225 - 234. The jurisdiction to make vesting orders became of diminished importance on the passing of section 30 of the Conveyancing and Law of Property Act, 1881, but is still far from obsolete. Great pains have been taken to classify the decisions dealing with this subject. Included in the volume are the Trustee Act, 1888, the Amending Act of 1894, the Judicial Trustees Act, 1896, the Colonial Stock Act, 1900, the Trustee Act Rules, 1893 (O. 54A), and the Judicial Trustee Rules. The authors originally intended to add an appendix containing a complete list of the securities authorised as investments by section 1 of the Trustee Act, 1893. They found, however, that besides entailing much additional labour, the adoption of such a course would unduly increase the size of the volume. They were glad, therefore, to avail themselves of the offer of their friend, Mr. Herbert Ellissen, of the Inner Temple and of the Stock Exchange, to publish such a list, uniform with and supplemental to the present work. Mr. Ellissen's supplemental volume is now in the press, and numerous references to it will be found in the present volume.
