Taking its chief terms, it is represented by long strips Of land, expanded here and there for the location of switches, station yards, city terminals, etc. On this land is Constructed the roadbed with its cuttings, embankments, viaducts, bridges and tunnels, and these carry the track with its ties, rails, switch ing and Signal systems, etc. There are also the station build ings, freight sheds, elevators, machine shops, round houses, coaling stations and the costly city terminals and offices. Then there is the vast amount of rolling stock of all kinds and its equipment. To maintain and operate this great array of property there is employed an army of men, from general managers to porters, involving a heavy payroll. I leave out of account all the secondary enterprises in which a railroad com pany may be involved, in the way of hotels, parks, mines, timber limits, mills, lands, etc., as being not strictly essential to the functions of a railway as a public service corporation. It has been, at any rate, treated as such from the start, until it has rather come to be admitted as something impossible of settlement, and to be left in the class of economic questions which are not really to be settled, but rather to be dismissed as unsettled, and to some extent, insolvable. This characterization may or may not be strictly accurate in particular cases, but it perhaps represents pretty fairly the feeling that exists generally, and will at least serve the purpose of the writer as a starting point. Under the conditions above suggested, the question might be treated as the purely theoretical one of how these corporations might properly he assessed, looked at from the economic standpoint; and how, if you please, they should be assessed in order to make the burden upon them, "equal and uniform," as the expression is, with the burden upon other forms of property. Again, the question might be discussed by the assumption of some particular method as being capable of application so as to reach fair and just results. Book excerpt: Excerpt from Taxation of Corporations and Personal Income in New York In June, 1918, the author in his preface to The New York Franchise Tax on Manufacturing and Mercantile Corporations, made the statement in calling attention to the adoption by the states of the federal plan of income taxation, that we may there fore look forward to the extension of the principle of net income taxation as a permanent feature of our state revenue system. At that time, there had been in successful operation for more than a year, in the State of New York, the act taxing manufacturing and mercantile corporations on net income based on their return to the United States Treasury Department. This law has now been ex tended by the New York Legislature of 1919 so as to apply to all business corporations, including personal service corporations, and the rate has been increased from three to four and one-half per cent. The same Legislature acting upon the recommendations of the Joint Legislative Committee on Taxation, headed by Senator Fred erick M. Davenport and Assemblyman Franklin W. Judson, passed a law taxing personal incomes modeled on the federal plan (article 16 of the Tax Law), which, together with Articles 9 and 9a gov erning the taxation of public service corporations, banks, insurance companies and business corporations, forms the subject of the pres ent volume. Parts I, II and III cover the taxation of corporations and the remedy by certiorari. Part IV treats of the tax on per sonal incomes. These subjects may not appear at first glance to be closely related, and yet, the general scheme of both New York acts is taken from the federal income tax laws. In their state administration they are closely allied by reason of the fact that the common remedy of certiorari is applied generally to the cor poration taxes as well as to the personal income tax. Book excerpt: Excerpt from Taxation of Corporations: Report on Systems Employed in Various States; Prepared Under the Direction of the Industrial Commission To the Industrial Commission: I have the honor to submit herewith a report or compendium of the systems of taxation with especial reference to corporations in each of the following States, viz: Massachusetts, Connecticut, New York, New Jersey, Pennsylvania, Ohio, Indiana, Michigan, Illinois, Wisconsin, Iowa, and Texas. These States were selected, as directed by the Commission., because of their industrial prominence and the varied character of the systems of corporate taxation therein. It was found that one feature common to all these States, and running through all systems, namely, the general property tax, or as it has been designated, the "American system," applies not only to individual properties, but also, directly or indirectly, to a greater or less extent, to corporate property as well. This observation is doubtless true of all States in the Union. For this reason it was deemed necessary to set forth the distinctive features of the Entire system of taxation in each State applicable to general as well as corporate property, not only as a matter of information, but in order to present an intelligent and comprehensive view of the various methods for the assessment and taxation of corporations, the reasons and principles upon which they are based, and their comparative merits and results. While in some States there is a marked tendency toward the segregation of corporate property from the general property tax, and its subjection to special methods better adapted to property of that peculiar character and reducing the taxation thereof to a rational and harmonious system, thus far the separation is nowhere complete. An effort has been made therefore to present the characteristic features, the merits and defects, of the system in vogue in each State, and in some instances the efforts made to reform it and the difficulties encountered, giving especial attention to the taxation of corporations. In each instance it has been necessary to examine the taxation laws, the work of legislative committees and appointive tax commissions, and a mass of public reports and records in order to present intelligently the system of taxation existing, that your Commission might in the end have a basis for suggestions and recommendations as to changes and reforms in the State systems, and as to interstate action with a view to uniformity of taxation methods applied to corporations. This investigation has necessarily been somewhat tedious and laborious, and this report, in view of the limitation in the time allotted therefor, is submitted with the consciousness that it is not as thorough and complete as the writer would have desired and not devoid of imperfections.
