Available in PDF, EPUB and Kindle. Book excerpt: Few thinkers have had more impact on English-speaking culture in the twentieth century than the late F.R. Leavis (1895-1978). Paradoxically, his literary-critical studies and the cultural ideas associated with them have become pervasive influences, whilst losing none of their power of provocation. Yet amidst the extremes of admiration and hostility that his name attracts-in academic circles and beyond, on Left and Right alike-little serious attention has been given to what was his most audacious and significant venture: the journal, Scrutiny, whose chief editor he was for twenty years, until its closure in 1953. The specific history of this fascinating cultural enterprise is now studied for the first time in The Moment of 'Scrutiny'. Beginning with an analysis of Scrutiny's emergence in the complex historical conditions of inter-war England, Francis Mulhern goes on to recount the work of the journal. Elucidating the logic of of the project that it served, he demonstrates its coherence of purpose, while at the same time tracing the successive mutations that its discourse underwent in the changing politico-cultural conjunctures of its lifetime. A final chapter situates Scrutiny comparatively in the context of early-twentieth-century European thought, considers its specific function in the cultural history of mid-century England and the enigmas of its last years and after-life, and moves finally to an assessment of its significance today.

This book was released on 2015-03-25 with total page 53 pages. Available in PDF, EPUB and Kindle. Book excerpt: When the Committee published the Scrutiny Reform Report 18 months ago asked the Government to ensure that it responded to the Report within the customary two-month deadline. This did not happen, the Government response was received on the day the House rose for the summer recess, 22 July 2014, eight months after the Report's publication. Moreover, the tone of the Government's response to the key recommendations was overwhelmingly negative and did not sufficiently address our proposals, including those relating to the introduction of a form of national veto and the disapplication of EU law. In this Report the Committee first consider in more detail the background to, possible causes of and the implications of the Government's failure to schedule EU document debates, before turning to some of the other outstanding issues covered in the Scrutiny Reform Report, in particular papers deposit, limitâ documents, and the coverage of EU scrutiny and wider EU issues by the BBC. The Committee also sets out some outstanding scrutiny issues which the successor Committee may wish to consider, in particular scrutiny of the proposed EU-US Transatlantic Trade and Investment Partnership.

Book excerpt: The volume of EU legislation and the significance of its impact means that it is essential for the House to have an effective means of scrutiny. Although the current system has its strengths, there are weaknesses in that it tends to be seen as a minority activity, of interest to only a few members. The Committee hope that the recommendations of this report will reinvigorate the consideration of EU business. They want to see a system that: examines the negotiating stance adopted by the UK Government; examine EU proposals at an early stage; provide a free flow of information; be well integrated with the other activities of Parliament.

Available in PDF, EPUB and Kindle. Book excerpt: To what extent have parliaments a responsibility to monitor how laws are implemented as intended and have the expected impact? Is the practice of Post-Legislative Scrutiny emerging as a new dimension within the oversight role of parliament? What approach do parliaments apply in assessing the implementation and impact of legislation? These are the fascinating questions guiding this book. Case studies offer an in-depth look at how particular countries and the European Union conduct Post-Legislative Scrutiny. The analysis puts Post-Legislative Scrutiny in the context of parliamentary oversight and parliaments’ engagement in the legislative cycle. The purpose of this book is to demonstrate the value of Post-Legislative Scrutiny as a public good, benefiting the executive, legislature and the people in ensuring that law delivers what is expected of it, as well as to respond to the need for greater clarity as to what is meant by the term. In this way, the publication can assist legislatures to think more clearly as to what precisely they understand, and seek to achieve, by Post-Legislative Scrutiny. This book is the result of the co-operation between the Centre for Legislative Studies at the University of Hull and the Westminster Foundation for Democracy. The chapters were originally published as a special issue of The Journal of Legislative Studies.

Book excerpt: Power Beyond Scrutiny uncovers the forces which distort and limit public debate in the media. From the misuse of politician's expenses to recent phone hacking scandals, establishment corruption has never been more in the headlines. Yet amidst the din of scandal, there have been seismic silences. Justin Schlosberg interrogates these silences - why did a plea bargain which allowed Britain's biggest arms company to escape bribery prosecution, go almost entirely unchallenged in television news? Why did journalists routinely endorse the official explanation of how intelligence analyst David Kelly died, while all but ignoring mounting evidence which undermined it? Why, in 2010, did broadcasters offer an unchallenged platform to critics of Wikileaks but not its supporters? These are some of the questions and imbalances that Schlosberg seeks to address as he explains the nature of public debate in the digital age. In doing so he uncovers a range of news blockages that are more than just accidents of a fragmented, chaotic mediascape. They are ultimately ideological forces which ensure that contestability and dissent remain within definable limits.

This book was released on 2013-11-28 with total page 138 pages. Available in PDF, EPUB and Kindle. Book excerpt: The depth and pace of EU integration has demonstrated the need for effective democratic parliamentary scrutiny and accountability of Government at Westminster. This is the first major inquiry into the European scrutiny system in the House of Commons for eight years. There is more that the Committee could do to look at the impact of new proposals. There should be a new requirement to appoint ’Reporters' to take the lead within Committees on EU issues, as well as a more coordinated approach to the Commission Work Programme. Whilst the system need not be scrapped as some have said, it must be enhanced. Many problems arise from the fact that new Members are appointed for each document. The Committee argues forcefully for a return to the permanent membership system, new powers and a change of name to reflect the Committees' core purpose: EU Document Debate Committees. The Committee also examined how EU business is taken on the floor of the House, and the procedures which apply to it. They set out a series of recommendations about the way debates are scheduled and conducted and put the case for a new session of ’EU Questions'. They also review working practices and the visibility of the House's scrutiny of the EU in the media. It concluded that now is the time to propose the introduction of a form of national veto over EU legislative proposals, and then to explore the mechanics of disapplication of parts of existing EU obligations, notwithstanding the European Communities Act 1972

Available in PDF, EPUB and Kindle. Book excerpt: The constitutional background of both legislatures and their procedures are described and where possible compared. Currently unsolved problems often have much in common, in vexed areas such as ethics requirements or how procedural rules permit minorities fair access to legislative time before majorities prevail. British successes include the enhanced authority and effectiveness of select committees and the acquisition of more debating time by the creation of a parallel Chamber. Unsolved problems at Westminster begin with the powers and status of the Lords, and go on through the search for more effective review of EU activities, adapting parliamentary scrutiny to more sophisticated government financial information, and making better use of legislative time without diminishing back-bench rights. The accelerated pace and extent of procedural changes in Congress is problematic. Constant pursuit of campaign funds, increased party exploitation of Members' ethical shortcomings, and partisan reapportionments, have diminished collegiality and compromise. Business is conducted with greater predictability, with fewer quorum calls, postponement and clustering of votes, and by utilization of ad hoc special orders, often in derogation of openness and minority rights in the House. Minority complaints have been frequent and occasionally extreme. Conversely constant filibuster threats in the Senate have enhanced minority party power there. An 'inverse ratio' between the greater complexity, importance, and urgency of pending legislation on the one hand, and diminution of deliberative capacity, fairness. and transparency on the other, has been repeatedly demonstrated, especially at the stage of final compromises between the Houses.

Available in PDF, EPUB and Kindle. Book excerpt: In this unique approach to the field of body studies, author, scholar, and educator Victoria Kannen explores what it means to exist in a body that is constantly on display and subjected to public scrutiny. Kannen examines the interplay of many ways our bodies express identity, such as gender, race, body size, sexuality, disability, body modification, and age, and how public scrutiny of those expressions can impact our public and private selves. Intertwining personal narratives of self-identified “odd and awed” women with theoretical chapters that help to elucidate the role of social power, this volume tackles the stares, comments, and questions that are directed towards bodies in public space through original research, personal narratives, and artistic expression. As readers encounter the narratives and images throughout the book, they will be supported by scholarly chapters on embodiment, identity, resistance, and power to help analyze, reflect on, and critically engage with the content. Through stories, theory, and art, this timely new resource will engage students and scholars of women’s and gender studies, sociology, critical disability studies, and body studies. FEATURES: - Offers a unique understanding of interpretation and what it means to have a body that causes curiosity, discrimination, and lifelong interactions - Accessible and engaging for students and scholars, as well as those outside of academia - Provides creative and non-traditional opportunities for critical engagement with various embodiments

This book was released on 2014-06-11 with total page 48 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Joint Committee on Human Rights welcomes the provision in the Criminal Courts and Justice Bill, carried over from the last Session of this Parliament, which extends the current offence of possession of extreme pornography to include possession of pornographic images depicting rape and other non-consensual sexual penetration. The Committee considers this provision to be human rights enhancing, given the evidence of cultural harm done by such pornography, and acknowledges the strong justification provided for this proportionate restriction on individual rights. However, some of the provisions of the Bill cause concern. The Committee is disappointed that the Government has not examined the provisions of the Bill against all the relevant international standards relating to the rights of children. It urges the Government to provide further information in relation to SEN provision in secure colleges; and recommends that the Bill be amended to make explicit that secure college rules can only authorise the use of reasonable force on children as a last resort. The Committee also reports on the Deregulation Bill. It expresses its concern that application of the economic growth duty in that Bill to the Equality and Human Rights Commission (EHRC) risks the possibility of that body's UN accredited 'A' status being downgraded and could put the UK in breach of its obligations under EU equality law. It recommends that this duty not be applied to the EHRC unless that body is satisfied that it can be done in a way that will not restrict its independence.

Book excerpt: Much has changed in European constitutional law after the Lisbon Treaty, not least the efforts to increase democratic legitimacy by engaging national legislatures and introducing a stricter subsidiary review process, namely the Early Warning Mechanism (EWM). This collection looks at how national parliaments have adapted to their new roles and looks at how the new system has impacted on relations between the EU legislative bodies and national parliaments. A team of experts from across Europe explore the effect of the EWM on the national constitutional orders; analyse the regional impact of EWM and evaluate the new system of scrutiny.
