This right is not only crucial for those who believe, but is also so for atheists, agnostics and sceptics who have no religious beliefs. It is also considered a cornerstone of a democratic society and is closely linked to pluralism, tolerance and open-mindedness. Turkey has been involved in an accession process in order to become a full member of the European Union (EU) since 2005. The Justice and Development Party (Adalet ve Kalkınma Partisi – AKP), which first formed a government after its election victory of 2002, pledged to introduce reforms and lift prohibitions. Hence, although the AKP has made significant progress towards meeting the political norms required for EU membership in its twelve years in power, there are many outstanding restrictions regarding the right to freedom of thought, conscience and religion which remain in place. This book provides an overview of recent developments pertaining to the protection of the right to freedom of religion and belief in Turkey, a country that in its constitution is defined as a democratic and secular state. As it is not feasible to examine all questions in one book, this study will confine itself to the most topical and urgent issues.

Book excerpt: The right to freedom of religion or belief, as enshrined in international human rights documents, is unique in its formulation in that it provides protection for the enjoyment of the rights "in community with others". This book explores the notion of the collective dimension of freedom of religion or belief with a view to advance the protection of this right. The book considers Turkey which provides a useful test case where both the domestic legislation can be assessed against international standards, while at the same time lessons can be drawn for the improvement of the standard of international review of the protection of the collective dimension of freedom of religion or belief. The book asks two main questions: what is the scope and nature of protection afforded to the collective dimension of freedom of religion or belief in international law, and, secondly, how does the protection of the collective dimension of freedom of religion or belief in Turkey compare and contrast to international standards? In doing so it seeks to identify how the standard of international review of the collective dimension of freedom of religion can be improved.

Book excerpt: As the geographical diversity of the Muslim world stretches from Europe to Africa, through the Middle East and into Asia, this region mirrors a central finding of this study - that predominantly Muslim countries include an array of constitutional measures addressing the role of Islam and the scope of the right to freedom of thought, conscience, and religion or belief, and other related human rights.THE RIGHT TO FREEDOM OF RELIGION & BELIEF analyzes these constitutional measures currently in place related to the relationship between religion and the state in addition to freedom of religion or belief in predominantly Muslim countries.Issued in March 2005 as The Religion-State Relationship and the Right to Freedom of Religion or Belief: A Comparative Textual Analysis of the Constitutions of Predominantly Muslim Countries, this report was originally prepared by Tad Stahnke, J.D., Deputy Director for Policy; and Robert C. Blitt, M.A., J.D., LL.M., Legal Policy Analyst of the United States Commission on International Religious Freedom (USCIRF).USCIRF is an independent federal commission created the International Religious Freedom Act of 1998 to monitor the status of freedom of thought, conscience, and relation or belief abroad and to give independent recommendations to the Secretary of State and Congress. The different aspects of this fundamental right are considered from the contents of freedom of religion, to the possible limitations of this freedom; and from the freedom of, or freedom from, conundrum to the question of the collective or individual right. This volume reflects legal, philosophical and international perspectives, addresses numerous unanswered questions and offers an effective overview of the current literature and debate in this aspect of the discipline of law and religion.

Book excerpt: In the rising momentum for new and reformulated cultural identities, the Turkish Alevi have also emerged on the scene, demanding due recognition. In this process a number of dramatic events have served as important milestones: the clashes between Sunni and Alevi in Kahramanmaras in 1979 and Corum in 1980, the incendiarism in Sivas in 1992, and the riots in Istanbul (Gaziosmanpasa) in 1995. Less evocative, but in the long run more significant, has been the rising interest in Alevi folklore and religious practices. Questions have also arisen as to what this branch of Islamic heterodoxy represents in terms of old and new identities. In this book, these questions are addressed by some of the most prominent scholars in the field.

Available in PDF, EPUB and Kindle. Book excerpt: Is religious freedom being curtailed in pursuit of equality, and the outlawing of discrimination? Is enough effort made to accommodate those motivated by a religious conscience? All rights matter but at times the right to put religious beliefs into practice increasingly takes second place in the law of different countries to the pursuit of other social priorities. The right to freedom of belief and to manifest belief is written into all human rights charters. In the United States religious freedom is sometimes seen as 'the first freedom'. Yet increasingly in many jurisdictions in Europe and North America, religious freedom can all too easily be 'trumped' by other rights. Roger Trigg looks at the assumptions that lie behind the subordination of religious liberty to other social concerns, especially the pursuit of equality. He gives examples from different Western countries of a steady erosion of freedom of religion. The protection of freedom of worship is often seen as sufficient, and religious practices are separated from the beliefs which inspire them. So far from religion in general, and Christianity in particular, providing a foundation for our beliefs in human dignity and human rights, religion is all too often seen as threat and a source of conflict, to be controlled at all costs. The challenge is whether any freedom can preserved for long, if the basic human right to freedom of religious belief and practice is dismissed as of little account, with no attempt to provide any reasonable accommodation. Given the central role of religion in human life, unnecessary limitations on its expression are attacks on human freedom itself.

Available in PDF, EPUB and Kindle. Book excerpt: As the world enters the 21st Century, the challenges in implementing freedom of religion or belief grow more complex and more acute. How can the internationally recognized norms regarding freedom of religion or belief be meaningful for all - women and men, majorities and minorities, established religions and new religious movements, parents and children? How can tolerance, mutual respect and understanding be globally expanded? How does freedom of religion or belief relate to other human rights? Launched by the Oslo Coalition on Freedom of Religion or Belief, this deskbook anthology is designed as a single-volume resource for all who are concerned with facilitating improved global compliance with international standards in this vital area. The varied and diverse topics addressed by over fifty global experts in the field provide a rich weave of many threads. The book addresses historical and philosophical background on religious human rights, applicable international norms and the international procedural mechanisms for safeguarding these norms. It surveys central areas of controversy, including registration of religious and belief organizations, emerging debates on religion and gender, parental and children's rights, new religious movements, proselytism, and conscientious objection. Other chapters describe practical approaches to promoting tolerance and understanding through education, inter-religious dialogue, joint religious efforts addressing shared social problems, and conflict resolution initiatives. The volume also provides practical information regarding networking and other background issues that can help translate understanding of the applicable norms and procedures into action. Appendices provide texts of major international instruments on freedom of religion or belief.
