The new Land Acquisition Amendment Bill does go some way to correct the anti-democratic and imperial provisions of the old 1894 Act. Other regulatory restraints stand in the way of fair compensation to sellers whether the deal is a sale or an acquisition using eminent domain. Urban planning being based on the "Ricardian Model" and on top of asymmetrically applied regulatory constraints further depresses the benefit to land owners. As a result very little land is obtainable without dispute and high risk for infrastructure development. In this paper we provide an analytical critique of the law and restrictions as also of the framework of urban planning and provide a justification for why major change is required in the approach to land markets, land acquisition and urban planning. We also provide the key elements of a reformed approach that can create a win-win framework for development. We also present our suggestions on how the proposed Amendment to the Land Acquisition Act can be changed to make the Act functional and remove the residual perversities therein.

Instead of re-engaging in the rich transition debate in which the transformation of agriculture is seen as a necessary historical step to usher in dynamic capitalist (or socialist) development, this collection critically examines the centrality of land in contemporary development discourse in India. Consequently, the focus is on the role of the state in pushing a process of dispossession of peasants through direct expropriation for developmental purposes such as acquisition of land by (local) states for infrastructure development and to support accumulation strategies of private business through industrialization. Land in India is sought for non-agricultural purposes such as purchasing land to reduce risk and real estate development. Land is also central to tribal communities (adivasis), whose livelihoods depend on it and on a moral economy that is independent of any price-driven markets. Adivasis tend to hold on to such property, not as individual owners for profit, but for collective security and to protect a way of life. Thus land, notwithstanding its role in the accumulation process, has been, and continues to be, a turbulent arena in which classes, castes, and communities are in conflict with each other, with the state, and with capital, jockeying to determine the terms and conditions of land transactions or their prevention, through both market and non-market mechanisms. The volume goes beyond the traditional political economy of the agrarian transition question, and deals with, inter alia, distributional conflicts arising from acquisition of land by the state for capital accumulation on the one hand and its commodification on the other. It provides new analytical insights into the land acquisition processes, their legal-institutional and ethical implications, and the multifaceted regional diversity of acquisition experiences in India.

Book excerpt: Over the next 20 years, it is projected that India will make the transition from a primarily rural economy to one in which more than half of its 1.1 billion strong population will live in urban areas. As this demographic shift occurs, the Indian Government is tasked with providing the necessary urban and regional infrastructure to accommodate this growth. At present, existing urban infrastructure systems are operating well above capacity so that any response must address both the existing shortfall and impending demand. To meet its massive infrastructure requirements, India must mobilize resources at an unprecedented scale and speed. This thesis examines the use of land-based public finance as one avenue through which a significant portion of this financing might be obtained. In particular, I focus on one type of land-based public financing recently undertaken in India - a land-incentivized joint venture. I suggest that this 'tool' is premised on a set of assumptions or enabling preconditions that are largely necessary for its success. Thus I use this thesis first to outline what I have come to understand the main set of these assumptions to be. I then briefly examine the case of the Bangalore International Airport that was built in 2008 under a land-incentivized joint venture. As I am constrained by my lack of in-depth information on many aspects of the case, I use the case merely as a tool to illustrate how a number of the implicit assumptions might be compromised in actual implementation. It is hoped that identifying possible sources of complication can begin to help policy makers and future researchers think about accompanying reform that can facilitate the future use of land-incentivized joint ventures in the broader Indian context. In particular it appears that addressing some existing distortions and structural inefficiencies, particularly in land markets, might lead to better land-based finance outcomes.

Book excerpt: Infrastructure is crucial for development, yet it is chronically under-provided. This dissertation focuses on a key obstacle to infrastructure development: conflict over land acquisition. Using the case of India, this study aims to understand why and when resistance to the state's use of eminent domain powers arises, and investigates two key questions: 1) what prevents mutually-beneficial bargains between landowners and the state, and 2) under what conditions can the state enforce land acquisition? Chapter 1 argues that bargaining breakdown is not solely explained by state capacity, but rather by the strength of commitment problems between state and landowners. First, landowners with a high value for land cannot credibly commit not to use protests to extract additional resources from the state. Second, the state cannot commit to compensating all landowners fairly in an environment where land records are outdated and property rights are weak. Chapter 2 uses infrastructure project announcements as a proxy for land acquisition and analyzes the impact of a reform that improved landowners' collective action capacity and worsened their commitment problem. It provides empirical evidence that variation in landowners' commitment problems explains conflict prevalence. Chapter 3 explores the impact of the state's commitment problem on infrastructure investment and project implementation. Examining a land record digitization reform, the chapter shows that stronger property rights enhance the state's ability to implement infrastructure. Chapter 4 focuses on state responses to resistance and argues that bureaucrats with local ties can improve the state's internal coherence and penetration of society, thus reducing conflict around land acquisition. This chapter shows that infrastructure projects implemented with the involvement of local bureaucrats are less likely to face conflict and stall, due to bureaucrats' effective coordination of coercion with local politicians. Overall, this dissertation contributes to the understanding of land acquisition conflicts, the importance of property rights, and the role of embedded bureaucrats in policy enforcement. The findings hold implications for policymakers seeking to address the infrastructure deficit and mitigate conflicts over land acquisition in developing countries.

Land Acquisition for major economic projects has shot to national attention lately capturing media space and invading the language of informed discourse. Suddenly the votaries of a liberal economic policy are not so sure anymore, and traditionalists skeptical of the inevitability of the new economy feel vindicated. Design & Methodology. As with most contentious questions of public interest and political economy, it helps to go back to basics, the laws of the land and their underpinning, the Constitution. My research will examine the public law and public policy issues relating to land assembly and acquisition for infrastructure mega projects in India: process, policy and politics. Using qualitative empirical evidence drawn from land hungry infrastructure projects in India, and cross country comparisons, it will look at the land acquisition process as laid out in the Act and policy documents; and focus on legal principles: viz. Right to Property, Eminent Domain and Public Purpose. Approach and Findings. The research postulates that the paper is that the law of land acquisition is time tested, but requires fresh application and interpretation in the light of the dynamic context of an emerging economy and a nation in transition. Land Acquisition has emerged as the most contentious among the issues relating to infrastructure megaprojects that are now in public debate. This is natural in a predominantly agricultural economy, yet also ironical because land acquisition as a state activity has been practised for decades, and the act governing land acquisition is among the oldest in the land. It points out to the essentiality of inclusive growth, that India cannot leave Bharat far behind without risking major conflict. It also shows us that certain laws and principles that we have practised and abided by so long are now inadequate for our purposes. Central to this research is the identification of the public policy elements and the role of the executive, polity, judiciary and civil society in achieving the fine balance between equity and efficiency in this vexatious question of our political economy.
