Book excerpt: Excerpt from The Present Law of Abuse of Legal Procedure This book is supplementary to the author's History of Conspiracy and Abuse of Legal Procedure published this year by the Cambridge University Press in the series entitled Cambridge Studies in English Legal History. As was pointed out in the Preface to that book, the scope of the series made it necessary to split into two books what was originally intended to be one volume. In general, the line of cleavage between the history and the present law was tolerably well marked, but in Embracery, Misconduct of Jurors, and Frivolous Arrests, it was so blurred as to make separation impracticable. The present law relating to these topics w therefore be found in Chapters VII and VIII of the History of Co zracy and Abuse of Legal Procedure. The law relating to Perjury is so easily accessible in the text books ou Criminal Law, and Contempt of Court has been so thoroughly explored by Mr Oswald, that the inclusion of them in this book would have added nothing to it except bulk. The law relating to Perjury is so easily accessible in the textbooks on Criminal Law, and Contempt of Court has been so thoroughly explored by Mr Oswald, that the inclusion of them in this book would have added nothing to it except bulk. The time will come when the law reformer will lay his hand upon abuse of legal procedure, and the author would respectfully suggest that a little extension of the law of Conspiracy would suffice to cover all the ground occupied by Embracery, Common Barratry, and (at least on their criminal side) Maintenance and Champerty. Indeed, it would be merely harking back to the original idea of Conspiracy, which at its birth was implicated almost exclusively with abuse of legal procedure; and it would also be in keeping with the modern tendency to widen the law of Conspiracy. Reform would thus take the line of least resistance with respect both to the past and to the present, and the happy despatch would be given to some cataleptic parts of the law, whose very names are unfamiliar to many practitioners. Book excerpt: Excerpt from The History of Conspiracy and Abuse of Legal Procedure It is hoped, then, that the Cambridge Studies in English Legal History, by making some contribution to the knowledge of the history of English law as a world-wide and not merely as an insular system, may be an agency in the fulfilment of the several functions of legal history. Fortunate it is that there are already in progress other series of publications of texts and of essays which have as their purpose the encouragement of the study and the advancement of the knowledge of English legal history. The series inaugurated by the publication of the present volume will not conflict with the valuable work of the Selden Society nor with that of other societies and scholars. On the contrary, the aim is to supplement the work that is being done by other agencies. Any success which this series of Cambridge Studies in English Legal History may have in making its own special contribution to learning must be due to the scholarly labours of the writers of monographs and the editors of texts. From scholars who value the studies to which this series is devoted and who em visage the useful functions which such studies should serve may there come, therefore, both guidance and co-operation. Only by these means can the high standard set by Dr Winfield in this first volume Of the series be maintained. In the work it is hoped that everything needed by the practical lawyer, both in the prosecution and defense of ao tions for the wrongs under consideration, will be found satis factorily discussed and amply illustrated by adjudicated cases. Book excerpt: Excerpt from A Treatise on the Law of Damages The general plan Of this work is as follows: The first chapter contains a general survey Of the subject; the nine chapters following, a statement and illustration Of elements, principles and rules relating to it; the next ten chapters the law Of damages applicable in cases Of breaches of con tracts; the following fourteen chapters the law of damages in all the various classes of torts; the succeeding one relates to damages under various statutes; the next chapter discusses the subject of nominal damages; and the last treats Of the power and discretion of the court to set aside verdicts for excessiveness or inadequacy. It has been my aim to furnish the practitioner with a useful and convenient treatise, embracing the latest statement Of the law and the most recent authorities; and I entertain a hope that its general usefulness may be largely augmented by the system and method I have pursued. Book excerpt: Excerpt from Essentials to the Law of Damages Today, as is well known, the situation is altogether dif ferent. In contract, and as to pecuniary elements of dam age in-tort, the court can, and does, exercise rather a close control over the amount of damages; but, as to non-pecuniary elements of damage in torts, the jury may exercise a discretion of considerable breadth, for it is, as to such elements, exceedingly difficult, in most cases, to say that a verdict is excessive or inadequate, and it is altogether impossible to lay down practically complete general rules as in contract. Book excerpt: Excerpt from Principles of the Law of Damages The general purpose of this new book on the law of Damages is like the purpose of the book on the law of Contracts by the same author, to give a complete treatise on the subject in a small volume. All the fundamental principles of the law of Damages are summarized in rules, or propositions of law. Explanations are given for these propositions of law, with reasons therefor, together with criticisms thereof, whenever in the judgment of the author the rules are the subject of criticism. In order to further elucidate the propositions, copious illustrations are given, showing the application of the same. Under such a plan it is hoped that anyone reading the book will obtain a thorough understanding of the law of Damages. Our work is an assem blage of facts and principles, and it would be wonderful, if, in so great a number, some errors had not escaped vigilance. Of errors of intention we know we are guiltless; of those which have originated in the inaccuracy of the official returns and other sources of information on which we have relied, we cannot be so confident.
