A combination of factors influenced the emergence of the law and resulted in an authorizing system that included an effective set of policy entrepreneurs, a strong executive, and a key political opportunity. Ultimately Governor Pataki promoted charter school policy to high agenda prominence by deciding to use the issue as his desired policy in exchange for a legislative pay raise (agenda setting). The findings of the study suggest that the applicability of Kingdon's national-level model to the state level is valid and features a strong participation of the state executive branch.

Book excerpt: Against the backdrop of urban school politics, in which mayors play increasingly powerful and pivotal roles, the current study examines the origins and implications of mayoral control of charter school authorization and accountability in Indianapolis (see Henig & Rich, 2004; Wong & Shen, 2007). In contrast to analyses of mayoral takeovers of urban elementary education in cities such as Philadelphia, Chicago, and Baltimore, the study focuses on the advocacy coalitions and policy streams that made Indianapolis the first--and only--city with independent mayoral control over charter school authorization and accountability (see Bulkley, 2007; Kingdon, 1995; Orr, 1999; Sabatier & Jenkins-Smith, 1999; Shipps, 2006). The central research question of the study is: How (and why) did the policy landscape change to secure passage of the Indiana charter school law? To address this question, the author conducted more than 30 in-depth interviews with key stakeholders (e.g., charter and non-charter school leaders, school board members, business leaders, teachers union representatives, education foundation officers, former mayors of Indianapolis, and state legislators) involved in Indiana charter school law adoption and implementation. In addition, myriad documents were analyzed for descriptive evidence of the nature of governing coalitions and their members' educational and political values related to charter school policy. Key findings include: (1) The capacity to change the direction of education policy in Indianapolis was constituted by a public demonstration of collective action, trust among different institutions, and investment from partners external to the formal governance structures in the city; and (2) Civic capacity in Indianapolis coalesced measurably following charter school policy implementation and the establishment of the Mayor's Office of Charter Schools. As charter schools, continue to grow in popularity as defined by states authorizing their operations, total schools operated and total number of students served, issues of race threaten to plague the advancement of the charter school movement. Charter schools are seen as a civil rights boon to minority parents; however, this research discusses how charter schools may run counter to historical narratives of civil rights. Through a Voting Rights Act analysis under Section 2 of the Act, the researcher determines that charter schools threaten the political participation and voice of racial minorities. This study uses a statistical analysis embedded in a legal analysis of Section 2 of the Voting Rights Act to advance the argument that appointed charter school boards in New Orleans, Louisiana do not reflect the voting age population of the city. The study first examines case law to discover that Section 2 of the Voting Rights Act could be used a viable argument against the establishment, maintenance and/or expansion of charter schools. After finding that case law may support claims against appointed charter school boards under Section 2 of the Voting Rights Act, the study uses a Fisher Exact Test of Independence to prove that appointed charter school boards in New Orleans result in less descriptive representation for Black parents. The resultant p-value (0.0019528) for combined appointed charter school boards is significant at the .01 significance level. As disaggregated by charter school management type, the p-values are significant for both appointed charter school boards that operate one charter school or several charter schools. This study introduces a new discourse into the legality of the implementation of charter schools as well as the political and policy consequences of the implementation of charter schools. The study contributes to a broad array of literature on the subjects of the efficacy of appointed school boards to translate into representation for minorities and the legality of charter schools as related to the rights of minority parents. The results of this study are important as they introduce educational leaders, in their roles as educators, administrators or policymakers, to a counternarrative to theories of charter schools as a civil rights boon for minorities.

The academic and policy debate on charter schools largely focuses on the effect of a state's charter school statutes, specifically the degree of statutory discretion for charter schools, on charter school growth and student achievement. However, we rarely consider the politics in the state capitals that account for the content of a state's charter school statutes in the first place. I argue that a state's legislative institutional capacity affects charter school growth by the degree of statutory and regulatory discretion that state lawmakers grant to local school boards of education. In order to verify this argument, I create new quantitative measures of statutory and regulatory discretion to compare the contents of charter school authorization, renewal, and revocation statutes and regulations within and across forty-one U.S. states with charter school laws from 1991 to 2013. The first chapter argues that legislative term limits has a negative effect on statutory discretion. The second chapter demonstrates the interaction of a state's teacher union strength and the legislative regulatory veto has a positive effect on regulatory discretion. The third chapter argues that statutory discretion has a negative effect on the percent of operating charter schools. Overall, this dissertation demonstrates the effect of legislative institutions on the percent of operating charter schools, the percent of public school students enrolled in charter schools, and the percent of black and Hispanic public school students enrolled in charter schools in a given state.
