Book Synopsis Towards a "second Generation" in Environmental Laws in the Asian and Pacific Region by : Lin Heng Lye
Download or read book Towards a "second Generation" in Environmental Laws in the Asian and Pacific Region written by Lin Heng Lye and published by IUCN. This book was released on 2003 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: Laws in the twentieth century were based on economic growth and development. This new century calls for the reassessment of all laws from an environmental perspective in consideration of such looming environmental concerns as global warming, degradation of biodiversity and pollution. This book captures some provoking thoughts raised during a symposium on second generation environmental laws held in Japan in 2002. The wide range of articles will promote greater understanding of what has been achieved with the first generation of environmental laws, what is needed for the second generation, and how to bridge the two.
Book Synopsis Global Environmental Constitutionalism by : James R. May
Download or read book Global Environmental Constitutionalism written by James R. May and published by Cambridge University Press. This book was released on 2015 with total page 427 pages. Available in PDF, EPUB and Kindle. Book excerpt: Reflecting a global trend, scores of countries have affirmed that their citizens are entitled to healthy air, water, and land and that their constitution should guarantee certain environmental rights. This book examines the increasing recognition that the environment is a proper subject for protection in constitutional texts and for vindication by constitutional courts. This phenomenon, which the authors call environmental constitutionalism, represents the confluence of constitutional law, international law, human rights, and environmental law. National apex and constitutional courts are exhibiting a growing interest in environmental rights, and as courts become more aware of what their peers are doing, this momentum is likely to increase. This book explains why such provisions came into being, how they are expressed, and the extent to which they have been, and might be, enforced judicially. It is a singular resource for evaluating the content of and hope for constitutional environmental rights.
Download or read book Dignity Rights written by Erin Daly and published by University of Pennsylvania Press. This book was released on 2020-10-09 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: Originally published in 2012, Dignity Rights is the first book to explore the constitutional law of dignity around the world. In it, Erin Daly shows how dignity has come not only to define specific interests like the right to humane treatment or to earn a living wage, but also to protect the basic rights of a person to control his or her own life and to live in society with others. Daly argues that, through the right to dignity, courts are redefining what it means to be human in the modern world. As described by the courts, the scope of dignity rights marks the outer boundaries of state power, limiting state authority to meet the demands of human dignity. As a result, these cases force us to reexamine the relationship between the individual and the state and, in turn, contribute to a new and richer understanding of the role of the citizen in modern democracies. This updated edition features a new preface by the author, in which she articulates how, over the past decade, dignity rights cases have evolved to incorporate the convergence of human rights and environmental rights that we have seen at the international level and in domestic constitutions.
Book Synopsis Modern Environmental Law by : James May
Download or read book Modern Environmental Law written by James May and published by . This book was released on 2023-07-14 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The need for environmental protection is all around: air and water pollution; severe weather; sea level rise; loss of species, wetlands, glaciers and biodiversity; water and food shortages; disease and pandemics; and food and water insecurity. It's also close at hand: the water from the tap; the local air quality index; local land use and development; flooding and storm damage. There are also constant reminders, as young people demand, and future generations deserve, continued vigilance in the face of environmental challenges and the climate crisis. Modern Environmental Law is a current casebook that examines signature federal, state, international and global laws, including common law and public trust, the National Environmental Policy Act, the Endangered Species Act, the Clean Water Act, the Clean Air Act, climate change, environmental rights, water rights, international environmental law, and environmental justice. The contents are torn from the headlines, including recent decisions from the 2021-2022 and 2022-23 Terms of the United States Supreme Court (e.g., West Virginia v. EPA; Sackett v. EPA, etc.). The casebook also integrates many related concepts, including separation of powers, federalism and individual rights, and interacts with other areas of law, including constitutional law, administrative law, property and civil procedure, and land use law.
Book Synopsis Constitutions and the Commons by : Blake Hudson
Download or read book Constitutions and the Commons written by Blake Hudson and published by Routledge. This book was released on 2014-03-26 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constitutions and the Commons looks at a critical but little examined issue of the degree to which the federal constitution of a nation contributes toward or limits the ability of the national government to manage its domestic natural resources. Furthermore it considers how far the constitution facilitates the binding of constituent states, provinces or subnational units to honor the conditions of international environmental treaties. While the main focus is on the US, there is also detailed coverage of other nations such as Australia, Brazil, India, and Russia. After introducing the role of constitutions in establishing the legal framework for environmental management in federal systems, the author presents a continuum of constitutionally driven natural resource management scenarios, from local to national, and then to global governance. These sections describe how subnational governance in federal systems may take on the characteristics of a commons – with all the attendant tragedies – in the absence of sufficient national constitutional authority. In turn, sufficient national constitutional authority over natural resources also allows these nations to more effectively engage in efforts to manage the global commons, as these nations would be unconstrained by subnational units of government during international negotiations. It is thus shown that national governments in federal systems are at the center of a constitutional 'nested governance commons,' with lower levels of government potentially acting as rational herders on the national commons and national governments potentially acting as rational herders on the global commons. National governments in federal systems are therefore crucial to establishing sustainable management of resources across scales. The book concludes by discussing how federal systems without sufficient national constitutional authority over resources may be strengthened by adopting the approach of federal constitutions that facilitate more robust national level inputs into natural resources management, facilitating national minimum standards as a form of "Fail-safe Federalism" that subnational governments may supplement with discretion to preserve important values of federalism.
Book Synopsis Oxford Handbook of Comparative Environmental Law by : Emma Lees
Download or read book Oxford Handbook of Comparative Environmental Law written by Emma Lees and published by Oxford Handbooks. This book was released on 2019-04 with total page 1316 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Handbook is the first comprehensive account of comparative environmental law. It examines in detail the methodological foundations of the discipline as well as the substance of environmental law across countries from four vantage points: country studies from all continents, responses to common problems (including air pollution, water management, nature conservation, genetically modified organisms, climate change and energy, chemicals, waste), foundational components of environmental law systems (including principles, property rights, administrative and judicial organisation, command-and-control regulation, market mechanisms, informational techniques and liability mechanisms), and common interactions of environmental protection with the broader public, private, and criminal law contexts. 0The volume brings together the foremost authorities in this field from around the world to provide a concise, self-contained, and technically rigorous account of environmental law as a single overall system.

Book Synopsis Science, Technology, Policy and International Law by : Justo Corti Varela
Download or read book Science, Technology, Policy and International Law written by Justo Corti Varela and published by Taylor & Francis. This book was released on 2024-10-02 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents innovative insights into the intersections between science, technology, and society, and particularly their regulation by the law. Departing from the idea that law and science have similar methods and objectives, the book deals with problems, and solutions, that source from these interactions: concerns on how to integrate scientific evidence into trials, how to best regulate new technologies, or whether technological innovations could improve democratic legitimacy, create new regulatory tools or even new spaces of regulation, and what is the impact on the society. The edited collection, by building on a functionalist and comparatist approach, offers answers to how to best integrate law, science, and technology in policy-making and reviews the current attempts made at the transnational and international levels. Case studies, ranging from emerging technologies via environmental protection to statistics, are complemented by a solid theoretical framework, all of which seek to provide readers with tools for critical thinking in the reassessment of the relationship among theory, practice, political goals, and international regulation.

Book Synopsis Regulating from the Inside by : Cary Coglianese
Download or read book Regulating from the Inside written by Cary Coglianese and published by Routledge. This book was released on 2010-09-30 with total page 287 pages. Available in PDF, EPUB and Kindle. Book excerpt: Environmental Management Systems (EMSs) offer an approach to regulatory policy that lies somewhere between free-market and traditional command-and-control methods. Worldwide, hundreds of thousands of private firms have adopted or are considering adopting these internally managed systems for improving environmental performance. In the United States, the Environmental Protection Agency has established a special recognition for firms that adopt EMSs. Already, numerous state agencies have proposed or adopted 'green-tier systems' that allow firms with EMSs to be exempted from otherwise applicable requirements. Yet while private- and public-sector interest in EMSs is booming, limited empirical evidence is available about the efficacy of EMSs. To close the gap between advocacy and analysis, Regulating from the Inside brings together cutting-edge work of leading scholars, providing the most comprehensive analysis to date of environmental management systems. Intended to frame the future policy and the research agenda about EMSs, the discussions are organized around two critical questions: How have EMSs worked in firms that have already adopted them? What potential and limitations do they have as policy tools in the future? Addressing the arguments of both advocates and skeptics, the chapters examine why firms adopt EMSs; how firms implement EMSs; how EMSs answer concerns about fairness, corporate social responsibility, and sustainability; and what kind of impact EMSs may have on the global economy.

Book Synopsis The National Environmental Policy Act by : Lynton Keith Caldwell
Download or read book The National Environmental Policy Act written by Lynton Keith Caldwell and published by Indiana University Press. This book was released on 1999-02-22 with total page 233 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The National Environmental Policy Act has grown more, not less, important in the decades since its enactment. No one knows more about NEPA than Lynton Caldwell. And no one has a clearer vision of its relevance to our future. Highly recommended." —David W. Orr, Oberlin College What has been achieved since the National Environmental Policy Act was passed in 1969? This book points out where and how NEPA has affected national environmental policy and where and why its intent has been frustrated. The roles of Congress, the President, and the courts in the implementation of NEPA are analyzed. Professor Caldwell also looks at the conflicted state of public opinion regarding the environment and conjectures as to what must be done in order to develop a coherent and sustained policy.
