Book Synopsis The Human Right to Property by : Douglas Maxwell
Download or read book The Human Right to Property written by Douglas Maxwell and published by Bloomsbury Publishing. This book was released on 2022-07-14 with total page 469 pages. Available in PDF, EPUB and Kindle. Book excerpt: “This is an excellent work. It is deeply researched, and the analysis of case law will prove very valuable to practitioners and academics seeking a synthesis of the law on an issue”. The Rt. Hon. Lord Justice Green, Judge of the Court of Appeal of England and Wales and Chair of the Law Commission “A valuable contribution to the jurisprudence on Article 1 Protocol No.1 and of much interest to both property and human rights lawyers” Professor Sarah Nield, University of Southampton “The pervasiveness of A1P1 through contemporary property law makes this a serious and comprehensive study. This book masterfully interweaves theory and doctrinal law. It is both timely and necessary for academics and practitioners working in this area.” David Sawtell, 39 Essex Chambers and Cambridge University This book provides a highly detailed, practical analysis of Article 1 of Protocol No.1 (A1P1) and its implications in the United Kingdom. A1P1 prescribes a qualified right to the peaceful enjoyment of 'possessions'. This right corresponds to a negative limit on legislators and public authorities to rationalise interferences with possessions and, where necessary, to strike a fair balance, often requiring just compensation. Through lively and rigorous commentary on the latest advances made by the European Court of Human Rights and domestic courts, The Human Right to Property enriches current understanding of the peaceful enjoyment of property since the enactment of the Human Rights Act 1998. Exploring the theoretical and political foundations of A1P1, the book guides the reader through the relevant case law from the earliest developments in Strasbourg to the present day. The Human Right to Property concludes that the most significant impacts of A1P1 are that it: forces States to justify interferences; limits radical redistributions of property; and casts a wider shadow over legislative choice and public body decision-making.

Download or read book Contract Law written by Neil Andrews and published by Cambridge University Press. This book was released on 2011-05-26 with total page 797 pages. Available in PDF, EPUB and Kindle. Book excerpt: This textbook takes a fresh approach to contract law; as a first edition it reflects the subject in the 21st century more accurately than other texts. Comprehensive and scholarly, it maps the curriculum perfectly but detailed references and further reading sections encourage students to explore the subject further. Understanding is paramount and chapter introductions clearly guide students through the material. The textbook takes an innovative approach to case law: breaking down and discussing individual elements of a case and selecting short key extracts it gives students the tools to read cases independently and with confidence. An examination of the historical and theoretical foundations of the subject and a concluding chapter tracking emerging fields ensure the broadest possible perspective. Discussion of key recent cases such as Durham Tess Valley Airport (2010) and Chartbrook (2009) make this important new text a must for contract law students.
Book Synopsis Capital in the Twenty-First Century by : Thomas Piketty
Download or read book Capital in the Twenty-First Century written by Thomas Piketty and published by Harvard University Press. This book was released on 2017-08-14 with total page 817 pages. Available in PDF, EPUB and Kindle. Book excerpt: What are the grand dynamics that drive the accumulation and distribution of capital? Questions about the long-term evolution of inequality, the concentration of wealth, and the prospects for economic growth lie at the heart of political economy. But satisfactory answers have been hard to find for lack of adequate data and clear guiding theories. In this work the author analyzes a unique collection of data from twenty countries, ranging as far back as the eighteenth century, to uncover key economic and social patterns. His findings transform debate and set the agenda for the next generation of thought about wealth and inequality. He shows that modern economic growth and the diffusion of knowledge have allowed us to avoid inequalities on the apocalyptic scale predicted by Karl Marx. But we have not modified the deep structures of capital and inequality as much as we thought in the optimistic decades following World War II. The main driver of inequality--the tendency of returns on capital to exceed the rate of economic growth--today threatens to generate extreme inequalities that stir discontent and undermine democratic values if political action is not taken. But economic trends are not acts of God. Political action has curbed dangerous inequalities in the past, the author says, and may do so again. This original work reorients our understanding of economic history and confronts us with sobering lessons for today.

Book Synopsis Charles I (Penguin Monarchs) by : Mark Kishlansky
Download or read book Charles I (Penguin Monarchs) written by Mark Kishlansky and published by Penguin UK. This book was released on 2014-12-04 with total page 125 pages. Available in PDF, EPUB and Kindle. Book excerpt: The tragedy of Charles I dominates one of the most strange and painful periods in British history as the whole island tore itself apart over a deadly, entangled series of religious and political disputes. In Mark Kishlansky's brilliant account it is never in doubt that Charles created his own catastrophe, but he was nonetheless opposed by men with far fewer scruples and less consistency who for often quite contradictory reasons conspired to destroy him. This is a remarkable portrait of one of the most talented, thoughtful, loyal, moral, artistically alert and yet, somehow, disastrous of all this country's rulers.

Download or read book A Higher World written by Michael Fry and published by Casemate Publishers. This book was released on 2014-11-01 with total page 419 pages. Available in PDF, EPUB and Kindle. Book excerpt: “Engaging and very readable . . . an essential read for those wanting to get under the skin of modern Scottish history” from the author of Glasgow (Scottish Field). Michael Fry here applies his uniquely wide-ranging procedures of Scottish historical analysis to the eighteenth century, which gave this small nation its one era of truly global significance. He adds: “Never again was it to be so exemplary: unless, perhaps, in the twenty-first century.” In his journey from the Union of 1707 to its centenary and beyond, Fry takes in vivid scenes from all over the country, ranges up and down the social scale from peeresses to prostitutes, from lairds to lunatics, and covers every major aspect of national life from agriculture to philosophy. Most other Scottish histories published in recent times concentrate on social and economic history, but Fry insists that any true understanding of the nation, in the past as in the present, needs to pay at least as much attention to politics and culture. The social history and the economic history show us how Scotland was integrated into Britain. The political history and the cultural history show us why the integration was never complete. In this book readers will see both sides surveyed. In that way they will come also to understand how the nation’s rebirth in our own day remained possible. “Has the usual Fry merits of being elegantly written and the product of an incisive and original mind.” —The Herald “Ambitious and well produced.” —The Scotsman
Book Synopsis Memory and Identity by : Linda Pillière
Download or read book Memory and Identity written by Linda Pillière and published by Taylor & Francis. This book was released on 2022-10-24 with total page 191 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the ways in which ghosts haunt and shape cultural identities and memory, considering the manner in which the fluctuations of such identities sometimes imply the rethinking or rewriting of the past. Drawing on case studies in historical, political, literary and linguistic studies, it explores the narratives that produce imagined communities and identities and the places in which cultural identities are constructed through memory, asking how far these identities and memories disinherit or exclude otherness, and how far ghosts disturb orderly narratives, inviting multiple readings of the past. Thematically organized to consider the persistence of ghosts within present memory and identity, the creation of new identities through intertwining narratives of the past, and the reclamation of identities in postcolonial contexts, Memory and Identity: Ghosts of the past in the English-speaking world offers a multi-disciplinary examination of the concept of haunting. Memory and Identity will appeal to scholars of sociology, anthropology, cultural studies and history with interests in memory and identity.
