Airlines will have to acquire and 'surrender' allowances for the carbon emissions produced by their flights. The scheme is comprehensive: it applies to EU and non-EU airlines (subject to a potential exemption), to passenger and cargo flights, and to flights between EU airports and between EU and non-EU airports. An airline that fails to surrender allowances is fined €100 per allowance and must make up the shortfall the following year. The EU's scheme has already given rise to legal action in connection with the EU's international civil aviation obligations. But, due to its impacts on trade in goods and services, the scheme also has implications for the EU's obligations under the WTO law: specifically, under the General Agreement on Tariffs and Trade (GATT) and the General Agreement on Trade in Services (GATS). In particular, this raises the question of the scope of application of the GATS Annex on Air Transport Services. As this article shows, it is challenging to design a carbon scheme that is both administratively feasible and justifiable under WTO law.

European-based airlines in turn fear a disadvantage against their non-european competitors, as the need for emission certificates will burden their already high cost structures even further. The paper should first explain the concept of emission trading schemes as well as the current plan of introducing emission trading in the European Union. The second part will then elaborate on the airline’s perspective on emission trading and the included risks/ disadvantages originating from an introduction of such a system. A third part will then analyze the correlation between announcements concerning the emission trading system and the performance of airline stock prices. The analysis shall be based on the stock performance of major European airlines, as they will be the ones facing major discrimination if the system gets introduced. Finally, the usefulness of an emission trading system is going to be discussed and alternatives to solve the climate change issue will be presented.

Book excerpt: The planned extension of the EU emissions trading scheme to non-EU carriers has provoked vociferous opposition and prompted debate among scholars and practitioners of international and environmental law. U.S. airlines challenged the relevant EU directive in the English High Court, arguing that it is incompatible with international law. The High Court made a preliminary reference to the Court of Justice of the European Union. Advocate General Juliane Kokott provided an advisory opinion in October 2011 that upheld the validity of the directive. On December 21, 2011, the Court issued a judgment that largely adopts the Advocate General's reasoning. The article contends that the Advocate General and the Court, in their juristic pronouncements regarding the novel legal issues in this case, exalt political concerns over adherence to traditional understandings of fundamental principles of international aviation law, notably sovereignty, extraterritoriality, and the applicability of the Chicago Convention. The authors conclude that the integrity of the international aviation system depends upon levels of international cooperation that are inconsistent with the unilateralist, interest-driven readings of legal principle evident in both the Opinion and Judgment.

Despite large resistance from countries and companies, aviation activities were included in the scope of the trading scheme. In Air Transport Ass'n of America v. Secretary of State for Energy & Climate Change, the Court of Justice of the European Union had to decide whether the scheme was contrary to international law. After long disagreement at an international level, the International Civil Aviation Organization decided to look into market-based models for international aviation. Therefore, the European Union decided to temporarily derogate from the enforcement of its scheme. Whether this will give rise to a global scheme by 2020 is yet to be revealed.This article shows what led the European Union to introduce its scheme for emission allowance trading in the field of aviation. Nevertheless, the main question is why the European Union decided to “stop the clock” on the application of aviation activities. Perhaps it could be as a result of large international concerns or a desire to create an international market-based model. The question remains whether the application of the emission allowance trading in the field of aviation is contrary to international agreements and customary international law, or whether the European Union wanted to take a leading role with its emission allowance trading scheme. The final question is if there is a future for the European Union emission trading scheme for aviation activities or whether the scheme will be substituted for a worldwide market-based measure.
