Against this background, the EU has decided to include aviation in its Emission Trading System (ETS) from 2012. with this background, this book brings into focus the legality of EU aviation directive 2008/101 under GATT rules and the doctrine of sovereignty. Through analysis, the book addresses questions on whether EU aviation directive violates the doctrine of sovereignty reflected under Chicago Convention on International Civil Aviation Organization and the UN Charter, whether the unilateral and extraterritorial measure of EU can be justified under GATT rules and whether the GATT exceptions will be applicable to EU ETS scheme.

Book excerpt: This book provides a concise and convenient compilation of the EU directives and decisions concerning the inclusion of aviation into the existing greenhouse gas emission allowances trading scheme (ETS). An introduction has been added to set out the European and international context. Furthermore, some practical templates for reporting annual emissions and tonne-km data are included, as well as a list of useful contacts. The 2003 ETS Directive introduced emission trading for energy-intensive installations on a European level. Subsequently, the 2004 Linking Directive made further flexible mechanisms of the Kyoto Protocol available. In 2008, the Aviation Directive took EU ETS to the next level, as it included aviation in the scheme. This directive has been accompanied by the 2007 Monitoring and Reporting Guidelines (MRG), revised on April 16, 2009, which provides detailed guidance regarding determination of emissions and tonne-km data and streamlining the compliance cycle consisting of monitoring, reporting, and verification (MRV) duties. Book excerpt: The aviation industry will be included in the EU's emissions trading system (ETS) from 1 January 2012. Airlines will have to acquire and 'surrender' allowances for the carbon emissions produced by their flights. The scheme is comprehensive: it applies to EU and non-EU airlines (subject to a potential exemption), to passenger and cargo flights, and to flights between EU airports and between EU and non-EU airports. An airline that fails to surrender allowances is fined €100 per allowance and must make up the shortfall the following year. The EU's scheme has already given rise to legal action in connection with the EU's international civil aviation obligations. But, due to its impacts on trade in goods and services, the scheme also has implications for the EU's obligations under the WTO law: specifically, under the General Agreement on Tariffs and Trade (GATT) and the General Agreement on Trade in Services (GATS). In particular, this raises the question of the scope of application of the GATS Annex on Air Transport Services. As this article shows, it is challenging to design a carbon scheme that is both administratively feasible and justifiable under WTO law.

Most of the research laid its focus on specific industry levels such as the individual airline, the aviation industry in general or macroeconomic aspects. In this context, these studies tried to anticipate market reactions triggered by the EU-ETS by analyzing specific issues such as the financial impact on airlines, changes in competitive behavior or implications for the overall industry development. As a consequence, the existing studies took only a limited market view and made assumptions about expected developments in specific fields of the aviation industry. However, at the time of writing this thesis, conclusions about the scope of impact could hardly be drawn from existing impact assessments because of the wide range of issues that exceeded the scope of most impact studies. Hence, a broader research approach is needed which takes different analytical perspectives to describe the scope of impact of the EU-ETS and depict potential effects for the aviation industry.

While the plan is to request all airlines flying in the EU to buy emission certificates, most non-European carriers could still benefit from the international disputes going on at the moment. European-based airlines in turn fear a disadvantage against their non-european competitors, as the need for emission certificates will burden their already high cost structures even further. The paper should first explain the concept of emission trading schemes as well as the current plan of introducing emission trading in the European Union. The second part will then elaborate on the airline’s perspective on emission trading and the included risks/ disadvantages originating from an introduction of such a system. A third part will then analyze the correlation between announcements concerning the emission trading system and the performance of airline stock prices. The analysis shall be based on the stock performance of major European airlines, as they will be the ones facing major discrimination if the system gets introduced. Finally, the usefulness of an emission trading system is going to be discussed and alternatives to solve the climate change issue will be presented.

Book excerpt: The planned extension of the EU emissions trading scheme to non-EU carriers has provoked vociferous opposition and prompted debate among scholars and practitioners of international and environmental law. U.S. airlines challenged the relevant EU directive in the English High Court, arguing that it is incompatible with international law. The High Court made a preliminary reference to the Court of Justice of the European Union. Advocate General Juliane Kokott provided an advisory opinion in October 2011 that upheld the validity of the directive. On December 21, 2011, the Court issued a judgment that largely adopts the Advocate General's reasoning. The article contends that the Advocate General and the Court, in their juristic pronouncements regarding the novel legal issues in this case, exalt political concerns over adherence to traditional understandings of fundamental principles of international aviation law, notably sovereignty, extraterritoriality, and the applicability of the Chicago Convention. The authors conclude that the integrity of the international aviation system depends upon levels of international cooperation that are inconsistent with the unilateralist, interest-driven readings of legal principle evident in both the Opinion and Judgment.

Despite large resistance from countries and companies, aviation activities were included in the scope of the trading scheme. In Air Transport Ass'n of America v. Secretary of State for Energy & Climate Change, the Court of Justice of the European Union had to decide whether the scheme was contrary to international law. After long disagreement at an international level, the International Civil Aviation Organization decided to look into market-based models for international aviation. Therefore, the European Union decided to temporarily derogate from the enforcement of its scheme. Whether this will give rise to a global scheme by 2020 is yet to be revealed.This article shows what led the European Union to introduce its scheme for emission allowance trading in the field of aviation. Nevertheless, the main question is why the European Union decided to “stop the clock” on the application of aviation activities. Perhaps it could be as a result of large international concerns or a desire to create an international market-based model. The question remains whether the application of the emission allowance trading in the field of aviation is contrary to international agreements and customary international law, or whether the European Union wanted to take a leading role with its emission allowance trading scheme. The final question is if there is a future for the European Union emission trading scheme for aviation activities or whether the scheme will be substituted for a worldwide market-based measure.
