Book excerpt: Excerpt from The Law of Wills and the Administration of Estates This volume is a revision and an enlargement of Notes on the Law of Wills and the Administration of the Estates of Deceased Persons published by me seven years ago. That work was the publication in book form of lectures on the sub ject which I had delivered yearly to the senior class of the Kansas City School of Law. It was confined in its citations mainly to the law of Missouri and Kansas. It proved a very useful book both for students and practitioners. The present volume is an enlargement of that work by in cluding all of the leading cases in this country and in Eng land on the subject. It is intended to make this the best one volume work on the subject. It contains a concise statement of all the principles, in language supported by authority. It contains also an exposition of the reason and relative bearing of the rules. In other words, it is designed to be what the lawyer and student need - a text book which places them in possession of the subject, and not a running digest of ill assorted cases. It will be found of especial value to the Western lawyer and student, as it cites every case and discusses every rule em bodied in the common or statute law of the following group of states: Missouri, Arkansas, Nebraska, Kansas, Oklahoma, Texas, Wyoming, Colorado, New Mexico, Arizona, Utah, Ne vada, and California. It cites, also, every case bearing upon the subject decided in the Federal Courts, including the Su preme Court of the United States, the Circuit Courts of Ap peals, the Circuit and District Courts, the territorial courts, and the courts of the District of Columbia. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Decedents' Estates, Including Wills: An Abridgement for the Use of Law Students of J. G. Woerner's Great Treatise for Practitioners on "the American Law of Administration" This book, specially designed for use as a text-book in law schools, is an abridgment and condensation into a single volume of Judge J. G. Woerner's monumental work on The American Law of Administration. The editors, in lecturing upon the subject of wills and administration of decedents' estates, respectively in the law departments Of Washington and St. Louis Universities, found no suitable text-book for students covering this field, which is Of such practical and grow ing importance in a law course. The best plan devised was to lecture from Judge Woerner's book. But that great treatise is adapted to the' needs of the practising lawyer and the courts, not to students. Though containing the fundamentals neces sary to a proper understanding of the subject by the student, it contains also a tremendous amount of matter, nicety of detail, and citation of authorities, all Of which is indispensably valuable to the practitioner, but is only a source of confusion to the beginner. In the light of their experiences in teaching this subject, these editors therefore conceived the idea of elim inating all matter not essential from the elementary viewpoint, and otherwise so modifying the main treatise as to make it of special adaptation to the needs Of the beginner and properly to ground him in this field of the law. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Wills, Estates, and Trusts: A Manual of Law, Accounting, and Procedure, for Executors, Administrators, and Trustees The purpose oi this book is to provide a working manual for executors, administrators, and trustees, and for all others who hold property in trust. It is estimated that everything held in private possession changes ownership by reason of death, approximately three times each century. On its way, the greater part of this property passes through the hands of some executor, administrator, or personal representative of the former owner, and a very large proportion is held for a time in trust for the benefit of dependents or of those to whom it is later to go. These trusts are created most frequently perhaps when property intended to furnish support for widows and minor children is left for long terms to trustees, to hold, manage, and pay over the income. There are excellent reasons, as set forth in the present work, why such trust estates are surer and safer than any other arrangement that can be made to provide for the welfare of a man's family. As it becomes more widely known how readily property may be placed in trust and its income devoted to particular ends, without fear of loss or diversion to other purposes, this method of providing for one's family or for other dependents will increase in favor. The law relating to trusts will then take a proportionately more important place, and a knowl edge oi the rules which govern will become more essential. The present volume is intended to supply this in non-technical form. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from The Law of Wills, Vol. 3: Embracing the Probate of Wills and the Settlement of Estates; The Duties of Executors, Administrators, and Other Testamentary Trustees The work on Wills is now as complete as we could make it, within any reasonable compass and we believe it will be found to contain all which could fairly be expected in such a work, and in a form not obnoxious to just complaint. And it is a great satisfaction to have been able to leave the work in a shape which we have reason to believe will be satisfactory to our professional brothers, for whom we have labored so perseveringly through a very long professional life, and from whom we have received so many tokens of confidence and respect for all which we here tender them our most sincere, most grateful thanks. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Probate and Administration for Nebraska: Including Guardianship and Adoption of Children, With Forms The many new questions in regard to wills and settle ments of estates that have been decided by our supreme court during the last thirteen years, as well as changes in statutory law, seem to demand a new edition of Pro bate and Administration. With but one exception these cases merely apply old and well-established rules to new conditions without overruling earlier cases. The courts have made no radical changes in probate law. The legislature has made some sweeping changes providing for dispensing with administration in some cases, abolishing dower and curtesy, and substituting an interest in fee by virtue of the marital relation in place of such estates. The latter act has been pretty thoroughly construed by the supreme court. The first edition has been cited and approved by the courts of other states as well as of Nebraska. The entire work has been revised and rewritten and much new matter added. A few changes in arrange ment will be noticed, particularly in Chapter II, which has been given a more appropriate title, Preparation Of Wills, and forms of clauses most frequently used in drafting wills added. Book excerpt: Excerpt from The Law of Wills, Vol. 1: Embracing the Jurisprudence of Insanity, the Making and Construction of Wills, and the Effect of Extrinsic Evidence Upon Such Construction; With Forms and Instructions for Preparing Wills The Second Part of the work, which is confined to the practical detail of the Settlement of Estates, and the crea tion, construction, and administration of Testamentary Trusts, including Devises and Legacies, is nearly ready for the press, and may be expected in a few months. Some few of the topics discussed in Jarman will more naturally fall into this portion of the work. It is scarcely necessary for the author to say much of the character of his work, since that must depend more upon-the work itself, than upon any. Thing which may be said of it, even by the most disinterested. But it may not be improper to give an outline of what has been attempted. It has been the purpose of the writer to refer to all the leading or important English cases upon the several topics discussed, and to give the precise point determined, either in the text or the notes. And where there was any con ict in the decisions, it has been his purpose to give the history of the different classes of authorities, in such a manner, as to present the true principle to be ex tracted from all the cases bearing upon the point. And upon every point to bring the cases down to the latest moment, so as to give the true state of the English and American law at the time of publication. In this way, it is believed, the work will be found to present in a compact and perspicuous form, the elementary principles involved; and at the same time such a digest of the decided cases, as to become a useful commentary upon the subjects discussed, and a reliable guide, both for the student and the practitioner.
