Participants negotiated every major issue of ocean use: jurisdiction in the coastal and contiguous zones, the territorial sea, and the new two-hundred-mile exclusive economic zone (EEZ); transit and overflight through straits and archipelagos; fisheries management in the EEZs and high seas; ocean environmental obligations; the right to conduct ocean science; and the management of deep seabed mineral exploitation. Negotiating the treaty required more than fifteen years and the consent of more than one hundred and fifty nations. The resulting treaty, composed of three hundred and twenty articles plus seven major annexes, represents the final product of the largest, longest, and most complex formal negotiation in modern times. Negotiating the New Ocean Regime analyzes both the substance of the problems at hand - what should be done about the oceans - and the process of the bargaining and negotiating. With law and history as a background, Robert Friedheim uses regime theory and resource economics to analyze ocean problems and bargaining/cooperation theory of negotiation. The number of undelimited international maritime boundaries is much larger than the number of agreed lines. The two boundaries that define the marine domain of coastal states are examined. First, the baselines along the coast may consist of low-water lines or straight lines or a combination of both. When straight lines are used they define the seaward limit of the state's internal waters. Second, the outer limits of claims to territorial seas, contiguous zones and exclusive economic zones are measured from the baselines. All states will have to delimit at least one international boundary with a neighbouring state, whether adjacent or opposite. In confined seas no state can claim the full entitlement and must negotiate international boundaries with all neighbours. Many states bordering oceans can claim the full entitlement seawards, although they will need to delimit national boundaries with adjacent neighbours.

Book excerpt: The climate and other characteristics of the polar regions have been major factors in shaping the legal regime applicable to the polar oceans. In Antarctica, states have had to grapple with the question of how to account for developments in the Law of the Sea, while preserving the compromise over sovereignty contained in the Antarctic Treaty. The Arctic also has presented challenges for the Law of the Sea, as illustrated by the continued attention given to special rules for polar shipping. The 1982 United Nations Convention on the Law of the Sea has led to substantial agreement on the legal regime of ocean spaces. The present volume explores the impact the Convention has had on the polar regions in this respect, including after its entry into force in 1994. To this end, it looks at a number of issue areas in the field of maritime delimitation (baselines, maritime zones, delimitation of maritime zones betweenm neighboring states) and jursidiction (environmental protection, navigation and fisheries) from a bipolar perspective. It is strongly suggested that the legal regime of the polar oceans will be further elaborated to more effectively deal with existing activities or to accommodate new activities. It is likely that the United Nations Convention of the Law of the Sea will continue to provide the basic legal framework for this exercise and that states will be careful not to unravel the delicate balance contained in it.
