Book excerpt: When Suing Foreign Governments and Their Corporations was first published in 1988, one reviewer predicted that it would become the bible for all attorneys litigating such cases. Since then, the book has become the standard work on the intricacies of litigation under the Foreign Sovereign Immunities Act. In the most recent Supreme Court decision applying the Foreign Sovereign Immunities Act, both the majority and the dissent cited the book as the definitive work on the topic.

Available in PDF, EPUB and Kindle. Book excerpt: In Republic of Argentina v. Weltover the United States Supreme Court granted unprecedented access to U.S. courts for persons seeking to file suit against a sovereign state. In particular, the Court held that the commercial activity exception under the Foreign Sovereign Immunities Act of 1976 (FSIA) permitted the Court to exercise jurisdiction over the Republic of Argentina for refusing to repay its bonds. In a broader sense, the Court's interpretation of the FSIA may spur additional litigation by significantly restricting when sovereign states can assert a defense of sovereign immunity. Under the Court's interpretation of the FSIA and the commercial activity exception, a sovereign state cannot assert sovereign immunity when it acts as a market participant, and its actions directly affect the United States. A foreign government can only assert sovereign immunity when it engages in acts peculiar to sovereigns, such as the regulation of capital markets. Implicit in Republic of Argentina is the conclusion that if a sovereign state participates in private capital markets, its actions are not peculiar to sovereigns, and thus it cannot claim sovereign immunity.First, this article identifies the issues presented in Republic of Argentina. Second, this article examines the historical development and definition of the foreign sovereign immunity doctrine. Third, this article discusses the disparate approaches of the circuit courts in defining the commercial activity exception prior to Republic of Argentina. It explains why the Second Circuit came closest to Congress' intentions, in light of the legislative history of the FSIA. Fourth, this article contends that in Republic of Argentina the Court failed to clearly and satisfactorily define "commercial activity" in a manner certain to resolve the circuit conflict. As a result, what constitutes "commercial activity" is still in a state of evolution. This article concludes that the failure to more clearly define "commercial activity" will cause more sovereign states to be brought before American courts, particularly developing sovereign states, because of their greater need to intervene in their domestic economies.

Book excerpt: "This book recognizes the need for a unique international dispute resolution forum that addresses intricate political and diplomatic considerations and issues of state sovereignty, issues that typically arise from disputes regarding state contracts between national governments and private foreign parties. The work addresses several problematic private and public international law issues in sovereign debt litigation, including the state immunity theory, the act of state doctrine, forum non conveniences, and the difficulty in enforcing foreign judgements. It offers a comprehensive survey of the many choices open to a foreign bank operator in planning a dispute resolution strategy in China, analyzing the strengths and weaknesses of each process, and examining a series of case studies by way of illustration." -- BACK COVER.

Bainbridge In the early decades of the 21st century, concentrated efforts can unify science based on the unity of nature, thereby advancing the combination of nanotechnology, biotechnology, information technology, and new technologies based in cognitive science. With proper attention to ethical issues and societal needs, converging in human abilities, societal technologies could achieve a tremendous improvement outcomes, the nation's productivity, and the quality of life. This is a broad, cross cutting, emerging and timely opportunity of interest to individuals, society and humanity in the long term. The phrase "convergent technologies" refers to the synergistic combination of four major "NBIC" (nano-bio-info-cogno) provinces of science and technology, each of which is currently progressing at a rapid rate: (a) nanoscience and nanotechnology; (b) biotechnology and biomedicine, including genetic engineering; (c) information technology, including advanced computing and communications; (d) cognitive science, including cognitive neuroscience. Timely and Broad Opportunity. Convergence of diverse technologies is based on material unity at the nanoscale and on technology integration from that scale.

Book excerpt: Analytical Microbiology focuses on the processes, methodologies, developments, and approaches involved in analytical microbiology, including microbiological, antibiotic, and amino acid assays and dilution methods. The selection first offers information on the theory of antibiotic inhibition zones, microbiological assay using large plate methods, and dilution methods of antibiotic assays. Discussions focus on serial dilution assay, requirements for accurate assay, microbiological assay of riboflavin, laws of adsorption and partition, mechanisms of antibiotic action, and biological considerations affecting the use of statistical methods. The text then ponders on the elements of photometric assaying and automation of microbiological assays. The manuscript elaborates on antibiotic substances, vitamins, and amino acids. Topics include assay organisms, validity, specificity, reliability, and calculation of results of amino acid assays, bacitracin, chloramphenicol, dihydrostreptomycin, erythromycin, neomycin, and streptomycin. The selection is a dependable reference for researchers interested in analytical microbiology.

Available in PDF, EPUB and Kindle. Book excerpt: Originally published in 1985, this volume presents the proceedings of the 11th International Symposium on Attention and Performance. With few exceptions, the central emphasis in previous meetings of the Attention and Performance Association was on the information-processing approach to normal human cognition. This emphasis had been supplemented, on occasion, by studies employing EEG methods, but there had not been systematic attempts to relate the information-processing approach to work in the neurosciences. This volume seeks to emphasize the search for mechanism with such methods of approach as the following: anatomical, physiological, neuropsychological, behavioral, and computational. The editors believed that this was in accord with recent developing trends in cognition and particularly with developments in the study of attention at the time.
