Book excerpt: The mission of the "The Italian Yearbook of International Law" is to make available to the English speaking public the Italian contribution to the literature and practice of international law. It is fitting with this mission that this Volume XXIV opens with a focus on the controversial Judgment No. 238/2014 of the Italian Constitutional Court on the unconstitutionality of State immunity for international crimes. The five contributions by Francioni, Pisillo Mazzeschi, Bothe, Cataldi, and Palchetti provide a variety of opinions on the timely issue of how traditional doctrines of State immunity may be reconciled with the need to protect victims of international crimes and what kind of alternative forms of protection may be available when immunity prevents access to judicial remedies.

Book excerpt: The mission of The Italian Yearbook of International Law is to make accessible to the English speaking public the Italian contribution to the practice and literature of international law. Volume XIX (2009) features a series of contributions arising from a Symposium on "International Law in Italian Courts: Ten Years of Jurisprudence" held in April 2010 at the European University Institute. Following a general article on the substantive and methodological issues arising from the Italian jurisprudence relating to international law in the past decade, this section focuses on four specific areas of jurisprudential development which have attracted widespread interest as well as criticism. These areas are: i) jurisdictional immunities of foreign States and international organizations; ii) international terrorism; iii) treatment of migrants; iv) execution of human rights obligations flowing from the ECHR. Each of these is dealt with by way of a general article followed by comments from leading scholars in the respective fields (e.g. Reinisch, Nollkaemper, Scheinin). The general coordination of the Symposium has been ensured by Riccardo Pavoni. The doctrinal section of the volume is complemented by a variety of notes covering such significant topics as reparations for wartime damage, the legal basis of Security Council Chapter VII resolutions, and the status of military sunken vessels. Surveys on the activities of the ICJ, the ITLOS, the ECtHR, ICSID, and international criminal courts and tribunals occupy the rest of this section. The second section of the volume covers the Italian practice in the areas of i) judicial decisions; ii) diplomatic and parliamentary practice; iii) treaty practice; and iv) national legislation. The third section contains a systematic bibliographical index of Italian literature in the field of international law and reviews of recent books. The volume ends with an analytical index for ready consultation which includes the main judicial cases and legal instruments cited throughout the Yearbook.

Book excerpt: In 2014, the global economic system celebrates two anniversaries: Seventy years ago, on 22 July 1944 at Bretton Woods, New Hampshire, the Articles of Agreement of the International Monetary Fund (IMF) and the Articles of Agreement of the International Bank for Reconstruction and Development (Worldbank) were adopted. Since then the global financial and monetary system underwent significant policy changes, but the institutional framework remained the same. More recently, twenty years ago, on 15 April 1994, the Final Act of the Uruguay Round of Multilateral Trade Negotiations was signed and its key component, the Agreement establishing the World Trade Organization, entered into force on 1 January 1995. Even though the beginning of the multilateral trading system dates back to the late 1940s, the founding of the WTO constitutes a significant institutional reform which marks the beginning of a new era. Anniversaries are usually moments of celebration. However, even a superficial observer will notice that neither the current international financial and monetary regime nor the international trade regime is in a stage which invites celebration. Instead, both are facing difficult and fundamental challenges to their very existence from the outside but also from within. So while there may be no time to celebrate, anniversaries are also often used for reflection about the past and the future. Hence, EYIEL 5 (2014) considers these two anniversaries ample moments to reflect on the legacy and the current status of the main two pillars of International Economic Law in its Part one. Part two of EYIEL 5 (2014) brings together contributions on the EU’s Deep Trade Agenda, on Current Approaches to the International Investment Regime in South America, on the Multilayered System of Regional Economic Integration in West Africa and on the Tripartite Free Trade Area, as well as on India and her Trade Agreements. Part three contains treatises of developments in the World Customs Organization, the World Intellectual Property Organization and in International Investment Law. After the book reviews in Part four, EYIEL 5 (2014) is complemented with an Annex containing the Case (on exchange-rate manipulation and crisis-caused guarantees to financial institutions) and the Best Submissions of the 11th EMC2 ELSA WTO Moot Court Competition (of the Harvard team for the complainant and the Leuven team for the respondent). The case not only addresses issues of current interest but also links the subjects of our two special focusses nicely together.

Book excerpt: The mission of The Italian Yearbook of International Law is to make the Italian contribution to the practice and literature of international law accessible to the English speaking public. Volume XXI (2011) features a Symposium on the international law questions arising from the Libyan crisis. The Symposium addresses: i) issues of jus ad bellum and jus in bello, such as the legality and limits of the NATO's intervention; ii) the recognition of the Libyan National Transitional Council; iii) the implementation of economic and financial sanctions in Italy; and iv) the problem of prosecuting international crimes committed in Libya by both the Gaddafi forces and the insurgents. The first part of the Volume also features a "focus section" analysing and discussing certain aspects of the ICJ Judgment in Jurisdictional Immunities of the State (Germany v. Italy), namely i) the ICJ consideration of the Italian argument concerning the absence of alternative remedies for the victims of the Nazi crimes at stake; ii) the treatment of United States practice on State immunity by the ICJ; iii) the ICJ's rejection of the jus cogens argument advanced by Italy; and iv) the effects of the ICJ judgment in the Italian legal system. The "Notes and Comments" section contains contributions covering such topical issues as the protection of religious rights and freedoms by the European Court of Human Rights and collective actions in ICSID arbitration. Surveys on the activities of the ICJ, ITLOS, ICSID, and international criminal courts and tribunals occupy the remaining part of this section. The second part of the Volume covers the 2011 Italian practice in the areas of i) judicial decisions; ii) diplomatic and parliamentary practice; iii) treaty practice; and iv) national legislation. Book excerpt: The mission of The Italian Yearbook of International Law is to make accessible to the English speaking public the Italian contribution to the practice and scholarship of international law. Volume XX (2010) features a cluster of contributions arising from a Symposium on "The Future of the ECHR System" hosted in April 2011 by the University of Napoli "L'Orientale" on the island of Procida. The symposium addressed the current challenges facing the European Convention on Human Rights and the European Court of Human Rights. Following a general presentation of the symposium, the contributions to this section of the volume are grouped around two broad themes: "The ECHR System and International Law" and "General Aspects of the Functioning of the ECHR System". The contributions cover: i) the notion of jurisdiction in Article 1 ECHR; ii) the accession of the EU to the ECHR; iii) immunities under international law and the ECHR; iv) exhaustion of domestic remedies; v) criteria of inadmissibility for the individual application to the ECtHR; and vi) the application of the ECHR in domestic law. All pieces have been commented by specialists of the subject, practitioners, and present and former judges of the Strasbourg Court, including President Costa, judge Tulkens, judge Raimondi and Prof. Conforti. The section is closed by some final reflections on the future of the Strasbourg Court by President Costa. The notes and comments section contains a variety of contributions covering such topical issues as persecution in international criminal law; the role of human rights in international financial institutions; and the Hong Kong Convention for the Safe and Environmentally Sound Recycling of Ships. Surveys on the activities of the ICJ, ITLOS, ICSID, and international criminal courts and tribunals occupy the remaining part of this section. The second part of the volume covers the Italian practice of international law in the areas of i) judicial decisions; ii) diplomatic and parliamentary practice; iii) treaty practice; and iv) national legislation. The third part contains a systematic bibliographical index of Italian literature in the field of international law and reviews of recent books. Available in PDF, EPUB and Kindle. Book excerpt: This textbook offers for the first time a comprehensive analysis of the classic doctrines and main areas of international law from a European perspective, meeting the needs of the many European law schools teaching public international law in English. Special attention is devoted to the practice of the European Union, the Council of Europe and European States – both civil law and common law countries – with regard to international law. In particular the book analyses the interplay between international law, EU law and national law in the case law of the Court of Justice of the EU, the European Court of Human Rights and national jurisdictions in Europe. It provides the reader with insights into how the international legal practice of the EU and its Member States impacts the development of international law, both in terms of doctrines such as treaty-making and customary law, the exercise of (extraterritorial) jurisdiction, state responsibility and the settlement of disputes, as well as particular sub-fields of international law, such as human rights law and international economic law. In addition the book covers other important areas such as the use of force and collective security, the law of armed conflict, and global and regional international organisations. It provides European perspectives on all these issues and will be of great value to students, scholars and practitioners.
