Book excerpt: In India, a man spent 54 years behind bars in pretrial detention, waiting for a trial that would never happen because his file had been lost. In Nigeria, one study estimated that the average detainee waits over three years for his day in court. In Russia, pretrial detainees have begged for the chance to plead guilty, just so they can receive medical care. And in the United States, juvenile pretrial detainees have been forced to fight each other for their guards' amusement. Around the world, millions are effectively punished before they are tried. Legally entitled to be considered innocent and released pending trial, many accused are instead held in pretrial detention, where they are subjected to torture, exposed to life threatening disease, victimized by violence, and pressured for bribes. It is literally worse than being convicted: pretrial detainees routinely experience worse conditions than sentenced prisoners. The suicide rate among pretrial detainees is three times higher than among convicted prisoners, and ten times that of the outside community. Pretrial detention harms individuals, families, and communities; wastes state resources and human potential; and undermines the rule of law. The arbitrary and excessive use of pretrial detention is a massive and widely ignored pattern of human rights abuse that affects-by a conservative estimate-15 million people a year. The right to be presumed innocent until proven guilty is universal, but at this moment some 3.3 million people are behind bars, waiting for a trial that may be months or even years away. No right is so broadly accepted in theory, but so commonly violated in practice. It is fair to say that the global overuse of pretrial detention is the most overlooked human rights crisis of our time. Presumption of Cuilt examines the full consequences of the global overuse of pretrial detention. Combining statistical analysis, first-person accounts, graphics, and case studies of successful reforms, the report is the first to comprehensively document this widespread but frequently ignored form of human rights abuse. This "unacceptable level of fatalities" led to the commissioning of this inquiry, though Rita Donaghy remarks that there is no public sense of shock at the regular toll of fatalities in the industry and there is a need to raise the profile of these tragedies so that a construction fatality becomes socially unacceptable. The construction industry generally is modelled to provide maximum flexibility. Consequently the majority of functions are contracted out and at least 40 per cent of workers are self-employed or in the Construction Industry Scheme. The advantages are obvious in that it reduces overheads and some commentators argue that it improves profitability and productivity. The disadvantages are that it becomes more difficult for a safety culture to flourish, worker engagement is weak, employment security and continuity is minimal and skills training is at best patchy. The findings of the Review's investigation of a number of case studies reveal a combination of factors for each fatal accident of which the most frequently cited are: (a) the incidence of training factors, experience; (b) information and advice deficiencies; (c) risk perception; (d) rescheduling of work without planning; (e) minor / one-off jobs; (f) compliance; (g) equipment operability, space, personal protective equipment (PPE) issues and tools not designed to fit the user / task. 28 recommendations are made.

Book excerpt: On 10 June 2010, ministers announced the launch of a review of child protection, headed by Professor Eileen Munro. This is the first part of that review which sets out Professor Munro's approach and the features of the child protection system that need exploring in detail and that form the focus of subsequent stages of the review. The first aim is to understand why previous well-intentioned reforms have not resulted in the expected level of improvements. Moreover, there is a substantial body of evidence indicating that past reforms are creating new, unforeseen complications. This phase of the review looks at how we can refocus on the child's journey from needing to receiving the right help. In recent history, the child protection system has focused on imposing and meeting managerial targets and regulations, and in doing so has forgotten that the needs of children should be at its core. A dominant theme in the criticisms of current practice is the skew in priorities that has developed between the demands of the management and inspection processes and professionals' ability to exercise their professional judgment and act in the best interests of the child. The review has also made use of evidence that had previously been submitted to Lord Laming's 2009 progress report (HC 330, 2008-09, isbn 9780102958928). The observations made were grouped into three main categories: early intervention, frontline practice and transparency and accountability. Professor Munro notes 'there is much good practice and research for us to build on in our efforts to better protect children and young people.'

Book excerpt: This is the official report of the independent inquiry into the events leading up to the death of Victoria Climbiâ, an eight year old child who died in hospital in February 2000 of injuries sustained after months of abuse. The report by Lord Laming finds that the death represents a gross failure of the system of public agencies involved to protect vulnerable children from deliberate harm, and this failure is primarily due to 'widespread organisational malaise'. The agencies involved were under-funded, inadequately staffed and often showed a lack of even basic good practice. However, the key issue is one of lack of leadership and accountability shown by senior level management of the agencies involved, rather than just a structural or staffing problem. The legislative framework for child protection is judged to be basically sound; the problem lies more with its implementation. The report contains 108 recommendations for fundamental changes to the way social care, healthcare and police child protection services are organised and managed at national and local level in England, in order to establish a clear line of accountability in the provision of services for vulnerable children and the support of families. These include: i) the creation of a Children and Families Board within the government, to be chaired by a minister of Cabinet rank; ii) the creation of a National Agency for Children and Families with responsibility to advise the Board on policies that affect the well-being of children and families, and the discretion to conduct serious case reviews; and iii) the creation of a Management Board and a Committee at local authority level, involving senior management representatives. Other recommendations relate to improvements in the exchange of information within and between agencies; the feasibility of a national children's database to record any contact a child has with any key protection service; service funding issues; staff training and supervision.
