Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Initiative Referendum and Recall This volume represents a substantial contribution to the further careful and thoughtful discussion of a widely considered plan of reform. Professor Munro brings to his task as editor not only a comprehensive knowledge of the subject treated - direct legislation as it is popularly known - and a deep sympathy with the movement to correct the undoubtedly and undisputed evil results of representative government, but, what is of prime importance, a sound perspective and without local prejudice. Some of the chapters in the volume are new, having been specially prepared for it. Others have been taken from the substantial list of papers which have been presented to the National Municipal League during the past decade of years. Still others, like those of Colonel Roosevelt and Congressman McCall, have been selected from the current periodical discussion of the problem. All have been brought together by Mr. Munro in furtherance of the League's function as an open forum, to give both sides fairly, and to recount results fairly, so that the publicist and student may form an enlightened and sound opinion. Book excerpt: Excerpt from Documents on the State-Wide Initiative: Referendum and Recall This volume includes all of the constitutional amendments providing for a state-wide system of initiative and referendum now in force, several of the most significant statutes elaborating the constitutional provisions, all of the constitutional amendments now pending adoption, six important judicial decisions, and certain materials relative to the state-wide recall. While no attempt has been made to go into the subject of the initiative, referendum, and recall as applied to local and municipal government, some illustrative papers showing the system in ordinary municipalities and commission-governed cities have been included. We have published as an appendix the complete scheme of government suggested by Mr. W. S. U'Ren and a committee of Oregon citizens. This is one of the most suggestive documents to be found in recent American political literature, and it will be read with profit in connection with the chapters of Mr. Herbert Croly's Promise of American Life dealing with state government and administration. It is obvious that this volume will soon be partially out of date if the several projects for the initiative, referendum, and recall now pending are adopted. It is hoped, however, that new editions may be issued from time to time so that students of government may have readily accessible the primary materials for the study of these new institutional devices. We are indebted to Mr. H. H. Jones, of the Columbia Graduate School, for valuable aid in reading the proof. Teal, Practical Workings of the Initiative and Referendum in Oregon, Cin cinnati Conference for Good City Government, 1909, pp. 309, 310. Cf. Oregonian, Nov. 28, 1902, p. 6, col. 1 H. W. Scott, ibid., Oct. 16, 1907, p. 11, col. 3. Although it was adopted by a majority of eleven to one, a great many people did not know what they were voting for. The friends of the measure had been working judiciously for it for years, had secured the endorsement of the newspapers, many of the leading men of the state, and had by shrewd management got possession of the political parties, to the extent, at least, that all candidates printed 'vote for Initiative and Referendum' on all their election cards and bill posters and were all lined up to advocate the measure during election: Many did not know what they were voting for, simply following the rest. H. Denlinger, Arena, vol. 38, pp. 83 - 4 Such statements are repeated by Oregonians again and again, both in regard to the members of the legislature and the people, and are widely believed to be true. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Referendum in America: Together With Some Chapters on the Initiative and the Recall The names, the initiative and the referendum, have been known, of course, to a few students of government in this country and England for many years. It is, however, within only a very short time that these terms have conveyed a meaning even to otherwise intelligent and well informed men. The governments of the Swiss cantons were little understood by foreigners and it was not until the system of referring laws to popular vote was introduced into the practice of the Confederation that the subject began to claim anything like general consideration in the English speaking world. As for myself, I cannot remember that very much that was definite was known of this interesting democratic institution prior to the appearance of a popularly written work on the Swiss Confederation in 1889 by Sir Francis O. Adams, long the British Minister at Berne, and Mr. C. D. Cunningham. This book started discussion in this country, and it soon came to be recognized that law-making by the people was also no strange thing in the United States. Mr. James Bryce referred to the subject in a chapter in "The American Commonwealth" and during the ten years past this feature of the Swiss and American political systems has become familiar to a constantly widening circle of Americans. Our own experience with the referendum was brought to the notice of readers in university circles by the publication in 1891 of my essay on "Law Making by Popular Vote," by the American Academy of Political and Social Science, which was followed in 1893 by a somewhat more detailed treatment of the subject in a Monograph on the Referendum, included in the publications of the University of Pennsylvania, Political Economy and Public Law Series. The intent is simply to bring the essential points to the at tention of citizens, that they may have a full com prehension of the nature and tendencies of the system which they are asked to substitute for the system established by the founders of the Republic. Incompleteness must of necessity characterize such a work as this covering a movement in pro gross and changing in aspects, here and there, as it bounds on. The data are brought up to the spring of 1912, when measures for the introduc tion of the devices in whole or in part are pend ing in various States. Accordingly a supplement ary edition may later be brought out revising the present issue, and bringing the text to date.
