Book excerpt: This book is the first systematic attempt to address emerging land markets and their implications for poverty, equity, and efficiency across a number of African countries. The high incidence of poverty and the need for increased agricultural productivity remain acute in rural areas of sub-Saharan Africa, where a lack of secure land rights and a growing scarcity of land relative to the size of the population are becoming increasingly critical issues. Indeed, land issues in the region are high on the international policy agenda. Yet our knowledge about land tenure security and other rural factor markets (such as labor, oxen, manure, purchased inputs, and credit) is far from adequate to formulate sensible policies. The case studies in the book show that, while land markets and especially informal markets have been rapidly emerging in densely populated parts of Africa - and have generally been to the benefit of the poor--their functions remain imperfect. This is due to policy-induced tenure insecurity and the fragmentation of agricultural land. Applying rigorous quantitative analyses, the book provides a basis for taking into account the role of land markets in national land policies. All too often, the authors argue, land policies have been extreme, either prohibiting all land transactions or giving unrestricted freehold rights to a small elite at the expense of the poor. From the long experience in Asia, it is known that such policies are detrimental to both production efficiency and equity of land use. The authors argue that future policies in Africa should work with the markets. Regulations should be imposed only with careful testing that they are having the intended effects. The Emergence of Land Markets in Africa is a resource for teaching in developed and developing countries, as it provides both comprehensive reviews of the literature and detailed case studies. It is intended to facilitate the dialogue between researchers and policymakers, as well as inspire researchers to go further in their investigations and build an even stronger basis for good policies. It also uses primary data comprising mainly interviews with policy makers, land professionals, academics, Civil Society Organisations (CSOs), donor organizations and the general public. This book is in four parts, with nine chapters. Part 1 provides the relevant context of the book and contains two chapters (chapters 1 and 2). Chapter 1 is the introduction and explains why land is so important; it discusses some of the issues land resources currently face, especially, in developing countries and why it should be managed and governed properly; it outlines why there is an urgent need for an improved land governance and land administration system or land tenure reform where this is not taking place, and it provides a summary of the importance of documenting Rwanda's LTR programme and explains why this book is timely and different from existing literature on land tenure reform. In chapter 2, the historical context of land tenure systems in Africa is summarized. Part 2 deals with the preparatory work that was carried out for land tenure reform and has one chapter (chapter 3). The chapter describes the key exercises that were undertaken as part of preparing the ground for the land tenure reform programme. Part 3 concentrates on implementation of the LTR programme and contains four chapters (chapters 4 to 7). Chapter 4 focuses on how the policy and regulatory frameworks were established which supported the LTR programme. Chapter 5 details the institutional framework that was developed to guide the LTR programme implementation, defining each institution's mandate and how they interacted with each other as well as how the capacity of these institutions was built to apportion responsibilities accordingly. Chapter 6 explains the whole process of rolling out the land tenure regularization process countrywide and the key steps that were involved, as well as the implementation process. In chapter 7, the key ingredients required to ensure that what has been achieved by the LTR would be properly maintained are assessed. The last part of the book (Part 4) assesses the impact of the LTR programme by discussing the socioeconomic benefits in chapter 8 where testimonies from various stakeholders and LTR beneficiaries are also presented. Chapter 9 concludes the book and a set of key success factors and lessons are also outlined for other countries wishing to follow a similar route as Rwanda in terms of land tenure reform.

Deininger and Castagnini use data from Uganda to explore who is affected by land conflicts, whether recent legal changes have helped to reduce their incidence, and to assess their impact on productivity. Results indicate that female-headed households and widows are particularly affected and that the passage of the 1998 Land Act has failed to reduce the number of pending land conflicts. The authors also find evidence of a significant and quantitatively large productivity-reducing impact of land conflicts. This suggests that, especially in Africa, attention to land-related conflicts and exploration of ways to prevent and speedily resolve them would be an important area for policy as well as research. This paper--a product of Rural Development, Development Research Group--is part of a larger effort in the group to explore the impact of land policies.

An overarching concern is the extent to which land rights are being commodified, through the conversion of land held under customary tenure systems into marketised systems. The consequences of this include growing land concentration, land tenure insecurities, diminishing access to land by various sections of society, including the poor, women and less dominant ethno-religious groups. This volume brings together different studies on Africa's land questions exploring emerging land issues on the continent in terms of the wider questions of development, citizenship, and democratisation. The chapters discuss the land question through a variety of themes. Some focus on the agrarian aspects of the land questions, while others elucidate the urban dimensions of the land question.
