Assuming that the Mexican conflict is a war, subsequent questions can be asked with respect to a classic of political theory. Alexis de Tocqueville observed the natural tendency of central governments to reach out for more power in times of war. He further specified this statement by claiming that particularly the executive branch gains power in such situations. A democratic nation would be subject to this behavior, because it perceives the central executive as "the only power which appears to be intrinsically sufficiently strong, enlightened, and secure, to protect [it] from anarchy." Here, the Mexican case provides the analyst with further particularities. Not only follows the country's executive the logic of presidential system, but also is it still on the democratic recovery from a long-term authoritarian one-party-rule. This paper briefly examines the drug war's impact on the Mexican constitutional reality and thus aims at answering the question: What effect does the conflict have on the power endowment of the Mexican executive? In order to validate the hypothesis, that the president's power is gradually strengthened, the author chose a rather linear approach. After first introducing key data about the Mexican drug war, the institutional legacies of more than 70 years of one-party-rule are discussed. With the president's power having been on decline since a process of democratization gathered pace in 2000, various aspects of today's situation are understandable only by scrutinizing the consequences of previous "arrangements"

During Calderón's administration, over 47,337 people have been killed and thousands of human rights complaints have been filed against the military. The Inter-American Court of Human Rights (IACtHR) has issued several binding rulings that obligate Mexico to strip the military of its jurisdiction to investigate and try soldiers accused of violating civilians' human rights. On July 12, 2011, Mexico's Supreme Court ruled that Congress must reform the Code of Military Justice so that human rights abuse cases always fall under civilian jurisdiction. The Arce Initiative, brought forward by Senator René Arce from Mexico's opposition party, is the only proposed reform that complies with the IACtHR rulings and international human rights law. The Merida Initiative, a US aid package designed to assist in the fight against the war on drugs, places too much emphasis on the military and law enforcement, and needs to be revised. Civilian rule of law in Mexico can be strengthened by donor governments who are willing to help implement measures to increase transparency, combat corruption and rampant human rights abuses, and ease the transition to an accusatorial oral justice system.

Over 10,000 individuals have been killed in drug related violence between January 2007 and June 2009, with many of the violent deaths concentrated in a few states such as Chihuahua and Sinaloa. I argue that the concentrated nature of the drug related violence is partially shaped by electoral politics. Furthermore, I theorize that the concentrated costs of the anti-narco campaign can be explained by the continued struggle between Calderon's PAN party and the once dominant PRI party. Using regression analysis and after controlling for the number of DTOs that operate in a given state, I find that the level of support that the PRI enjoyed in the July 2, 2006 Chamber of Deputies general election is positively correlated with the amount of drug related deaths subsequently experienced in that state between January 2007 through July 2009.
