Performance will improve further when the government starts paying its own water bill on time and when the legislature authorizes the collection of unpaid bills from private consumers.In 1989 the government of Guinea enacted far-reaching reform of its water sector, which had been dominated by a poorly run public agency. The government signed a lease contract for operations and maintenance with a private operator, making a separate public enterprise responsible for ownership of assets and investment. Although based on a successful model that had operated in Cocirc;te d'Ivoire for nearly 30 years, the reform had many highly innovative features.It is being transplanted to several other developing countries, so Clarke, Meacute;nard, and Zuluaga evaluate its successes and failures in the early years of reform. They present standard performance measures and results from a cost-benefit analysis to assess reform's net effect on various stakeholders in the sector.They conclude that, compared with what might have been expected under continued public ownership, reform benefited consumers, the government, and, to a lesser extent, the foreign owners or the private operator.Most sector performance indicators improved, but some problems remain. The three most troublesome areas are water that is unaccounted for (there are many illegal connections and the quality of infrastructure is poor), poor collection rates, and high prices.The weak institutional environment makes it difficult to improve collection rates, but the government could take some steps to correct the problem. To begin with, it could pay its own bills on time. Also, the legislature could authorize the collection of unpaid bills from private individuals.This paper - a joint product of Public Economics and Regulation and Competition Policy, Development Research Group - is part of a larger effort in the group to promote competition and private sector development. This book argues and demonstrates that this can only be achieved by a better integration of the technical and social science approaches in the search for improved organization and delivery of these essential services. It presents a historical analysis of the development of water and sanitation services in both developed and developing countries, which provides valuable lessons for overcoming the obstacles facing the universalization of these services. Among the key lessons emerging from the historical analysis are the organizational and institutional diversity characterizing the development of water and sanitation internationally, and the central role played by the public sector, particularly local authorities, in such development. It also explores the historical role played by cooperatives and other non-profit institutions in reaching rural and peri-urban areas, as well as the emergence of new forms of organization and provision, particularly in poor countries, where aid and development agencies have been promoting the self-organization of water systems by local communities. Book excerpt: The topic of my attached paper is the effectiveness of institutional and legal frameworks for inducing government and multinational corporations to reduce/resolve conflicts and high incidences of renegotiation of World Bank financed contracts (between governments and water corporations) to the detriment of poor consumers. The paper asserts that institutional and legal deficiencies bedevil the private sector water supply services contracts process (financed with World Bank loans). The paper examines and highlights the key deficiencies. Particularly poor consumers who are the beneficiaries of the water contracts bear the brunt of the shortcomings in the legal and institutional framework. Consequently, the paper proposes effective measures to combat such deficiencies, including the use of consumer power and participation to influence the water contract negotiation process. The time is ripe for publishing the paper because there is an urgent need to address the upsurge in clean water supply crisis and rampant water privatization failures especially the impact of such problems on poor consumers in developing nations (in Africa, South America and South Asia). A 2005 World Health Organization report confirmed the discouraging statistics that in sub-Saharan Africa alone, some 769,000 children under 5 years of age die annually from water borne (diarrhea) diseases. Similarly, in South Asia, 683,000 children under 5 years of age die each year from such diseases. But the UN member states failed to achieve their goals of providing clean water supply access to most poor consumers in developing nations during the 1980s. The UN will also fail to achieve success of the current UN Millennium Development goals (MDG) of halving the number of poor people (in developing nations) without access to clean water supply by 2015. The paper demonstrates how success will not be achieved, if key institutional players (borrower governments, World Bank and private water companies) do not move beyond the rhetoric of promising to provide clean water supply access to the poor to implementing pragmatic and successful measures that work at the grassroots community level.
