Book Synopsis Post-legislative assessment of the Health and Social Care Act 2008 by : Great Britain: Department of Health
Download or read book Post-legislative assessment of the Health and Social Care Act 2008 written by Great Britain: Department of Health and published by Stationery Office. This book was released on 2013-05-20 with total page 48 pages. Available in PDF, EPUB and Kindle. Book excerpt: The 2008 Act falls into five main parts, whose main objectives were: to establish the Care Quality Commission; to change arrangements for regulation of health professionals and of the health and social care workforce; to update the Public Health (Control of Disease) Act 1984; to create the Health in Pregnancy Grant; and to make miscellaneous other changes in relation to health and social care. Most of the provisions of the Act are now in force (in some cases with amendments made by later legislation). The main exceptions include part 2 sections 124-126, which dealt with various matters in the remit of the General Social Care Council, and were not commenced. Instead, the Council was abolished, and its functions were transferred to the Health and Care Professions Council, in 2012. Part 3 provisions relating to port health have not yet been commenced, but the intention is that they will come into force at the same time as new port health regulations. The Act achieved its objectives (or in the case of port health, is in the process of doing so), with the exception of the creation of the Office of the Health Professions Adjudicator. The rest of the memorandum considers each Part of the Act in more detail, with information about: secondary legislation made under the powers created by the Act, and key guidance issued in relation to it; any legal issues that have arisen in relation to the Act, and other reviews of the Act, that the Department of Health is aware of
Book Synopsis Medical Treatment: Decisions and the Law by : Christopher Johnston
Download or read book Medical Treatment: Decisions and the Law written by Christopher Johnston and published by Bloomsbury Publishing. This book was released on 2022-07-04 with total page 851 pages. Available in PDF, EPUB and Kindle. Book excerpt: This leading textbook places medical decision-making in its legal context and provides practical guidance on the most ethically challenging cases that face the courts. It explains how the Mental Capacity Act works in practice and how the courts and lawyers wrestle with and resolve problems relating to the very essence of life: what is life? what is an acceptable quality of life? what treatment is so burdensome that it should not be attempted? These questions are posed, not in the abstract but, in real – often desperate, often urgent – situations. This is the essential guide for solicitors, barristers and judges specialising in Court of Protection work, clinical negligence, personal injury and human rights. Postgraduate medical ethics students and academics, NHS bodies and local authority professionals, health professionals and administrators in the NHS and private practice and those in Commonwealth countries with an interest in these topics will also find this book an invaluable resource. Medical Treatment: Decisions and the Law offers a readily accessible text for those dealing with the provision of medical treatment to those without capacity and related areas, providing a clear description of procedure as well as practical application of the law. Key developments for the Fourth Edition include: · The impact of the Covid-19 pandemic on decision making in the Court of Protection, particularly in relation to end of life decisions and vaccination · New chapters on two controversial issues: “the Right to Die?” and “Access to Healthcare: Choice” · Expanded chapter on Decisions for Children, covering recent high-profile cases such as Re Gard where continued provision of life sustaining treatment for babies or very young infants was at issue, and addressing the difficult issues around decision making by 16 to 17 year olds · Substantially updated chapter on Going to Court, covering how the incapacitous patient can be supported to participate in decisions about their treatment Discussion of “Escalation of Care” covering matters including NICE guidelines and care pathways and expanded coverage of issues concerning the funding of treatment. This title is included in Bloomsbury Professional's Clinical Negligence online service.

Book Synopsis Drafting Legislation by : Helen Xanthaki
Download or read book Drafting Legislation written by Helen Xanthaki and published by Bloomsbury Publishing. This book was released on 2014-10-16 with total page 402 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book constitutes the first thorough academic analysis of legislative drafting. By placing the study of legislation and its principles within the paradigm of Flyvberg's phronetic social sciences, it offers a novel approach which breaks the tradition of unimaginative past descriptive reiterations of drafting conventions. Instead of prescribing rules for legislation, it sets out to identify efficacy as the main aim of the actors in the policy, legislative and drafting processes, and effectiveness as the main goal in the drafting of legislation. Through the prism of effectiveness as synonymous with legislative quality, the book explores the stages of the drafting process; guides the reader through structure and sections in their logical sequence, and introduces rules for drafting preliminary, substantive and final provisions. Special provisions, comparative legislative drafting and training for drafters complete this thorough analysis of the drafting of legislation as a tool for regulation. Instead of teaching the reader which drafting rules prevail, the book explores the reasons why drafting rules have come about, thus encouraging readers to understand what goal is served by each rule and how each rule applies. The book is aimed at academics and practitioners who draft or use statutory law in the common or civil law traditions.

Download or read book Routledge Handbook of Complementary and Alternative Medicine written by Nicola K. Gale and published by Routledge. This book was released on 2015-04-10 with total page 598 pages. Available in PDF, EPUB and Kindle. Book excerpt: The provision and use of traditional, complementary and alternative medicine (CAM) has been growing globally over the last 40 years. As CAM develops alongside - and sometimes integrates with - conventional medicine, this handbook provides the first major overview of its regulation and professionalization from social science and legal perspectives. The Routledge Handbook of Complementary and Alternative Medicine draws on historical and international comparative research to provide a rigorous and thematic examination of the field. It argues that many popular and policy debates are stuck in a polarized and largely asocial discourse, and that interdisciplinary social science perspectives, theorising diversity in the field, provide a much more robust evidence base for policy and practice in the field. Divided into four sections, the handbook covers: analytical frameworks power, professions and health spaces risk and regulation perspectives for the future. This important volume will interest social science and legal scholars researching complementary and alternative medicine, professional identify and health care regulation, as well as historians and health policymakers and regulators.
