Book excerpt: This book takes a critical approach to examining British and Italian occupational health and safety enforcement policies and questions the legal and political principles that underpin them. The book undertakes a comparative critical analysis of these two jurisdictions’ health and safety regulatory enforcement practices by focusing on the causes and consequences of the under-criminalisation of these crimes. It explores the fundamentals of these two jurisdictions' criminal justice systems and political practices, policies and traditions and exposes how these translate into pragmatic social inequality and injustice for victims of occupational health and safety crimes and, more generally, citizens. Findings are drawn from qualitative interviews conducted with front line occupational health and safety enforcement officers. This book offers an account of the challenges encountered when attempting to scrutinise public institutions responsible for policing crimes of the powerful. The comparison of the political and criminal justice system practices, polices and traditions of the British and Italian legal systems offer a valuable critical contribution to the anglophone literature on the subject and, more generally, on regulatory enforcement policies and practices.

Book excerpt: The Sovereign Grant Act 2011 which came into effect from 1 April 2012 consolidated the funding provided to support the official duties of the Queen and maintain the Occupied Royal Palaces that up to 31 March 2012 had been provided under the Civil List and the Grants-in-aid for the maintenance of the Occupied Royal Palaces, Royal Travel and Communications and Information. The Queen's official expenditure is met from public funds in exchange for the surrender by The Queen of the revenue from the Crown Estate. The Sovereign Grant was set at 31.0 million pounds for 2012-13. Official expenditure met by this Grant in 2012-13 amounted to 33.3 million pounds, an increase of 0.9 million (2.6 percent) in absolute terms and a decrease of 0.2 percent in real terms compared to the previous year. The equivalent of the excess of expenditure over the Sovereign Grant of 2.3 million in 2012-3 was drawn down from the Sovereign Grant Reserve. From 2013-14 the Sovereign Grant will be calculated based on 15 percent of the income account net surplus of the Crown Estate for the financial year two years previous. The Crown Estate surplus for the financial year 2011-12 amounted to 240.2 million pounds thereby producing a Sovereign Grant of 36.1 million for 2013-14

Available in PDF, EPUB and Kindle. Book excerpt: Care and support affects a large number of people: eight out of 10 people aged 65 will need some care and support in their later years; some people have impairments from birth or develop them during their working life; some 5 million people care for a friend or relative, some for more than 50 hours a week. The current system does not offer enough support until a crisis point is reached, the quality of care is variable and inconsistent, and the growing and ageing population is only going to increase the pressure. Consequently, two core principles lie at the heart of this White Paper. The first is that individuals, communities and Government should do everything possible to prevent, postpone and minimise people's need for formal care and support. The system should be built around the promotion of people's independence and well-being. The second principle is that people should be in control of their own care and support, with personal budgets and direct payments, backed by clear, comparable information and advice that will allow individuals and their carers to make the choices that are right for them. This paper sets out the principles and approach, with sections covering: strengthening support within communities; housing; better information and advice; assessment, eligibility and portability for people who use care services; carers' support; defining high-quality care; improving quality; keeping people safe; a better local care market; workforce; personalised care and support; integration and joined-up care.

This book was released on 2012-07-11 with total page 156 pages. Available in PDF, EPUB and Kindle. Book excerpt: This paper is published alongside the Government white paper "Caring for our future: reforming care and support" (Cm. 8378, ISBN 9780101837828). The draft Bill takes forward the recommendations of the Law Commission report on adult social care (Law Com. 326, HC 941, session 2010-12, ISBN 9780102971682) which concluded that existing care and support legislation was outdated and confusing, making it difficult for people who need care and support, and carers, to know what they are entitled to and for local authorities to understand their responsibilities. The Bill will: modernise and consolidate the law, clarify entitlements; support broader needs of local communities; simplify the care and support system and processes. Key provisions include: statutory principles which embed the promotion of individual well-being; clear legal entitlements; everyone, including carers, should have a personal budget as part of their care and support plan; duties to ensure care and support continues when a person moves to a different local authority area; a new statutory framework for adult safeguarding. Others sections cover the establishment of Health Education England and the Health Research Authority, and allow for the abolition (subject to consultation) of the Human Fertilisation and Embryology Authority and Human Tissue Authority.

Available in PDF, EPUB and Kindle. Book excerpt: When health and safety regulatory frameworks took their present form in the 1970s, they were seen as a triumph of welfare state intervention. Since then, as heavy industry has declined and office and retail employment have expanded, new ways of working have radically altered the context of health and safety policy. Many people have come to see health and safety interventions as an obstacle to innovation. This book aims to address the changing context of health and safety policy, exploring concerns arising within the profession and the appropriate responses. Its manifesto for reform promises to frame the debate within the professional and policy community for a generation. The result of a major research programme funded by the Institution of Occupational Safety and Health (IOSH), Health and Safety in a Changing World shows how health and safety policy has developed over time, how it is applied in practice and how best to make it fit-for-purpose in the 21st century. The book will be essential reading for professionals, practitioners and academic readers with an interest in the rapidly-evolving field of health and safety.
