Lesbian, Gay, Bisexual, Transgender, and Intersex rights are heavily contested across the globe, with over 70 countries criminalizing same-sex relations and at least 10 imposing the death penalty. The book details how the EU, based on different member state positions, attempts to jointly formulate and implement guidelines for the external promotion of LGBTI rights. It also problematizes the various normative and policy-based Eurocentric prescriptions to further these rights. Drawing on an international political sociology framework infused with queer theoretical thought, the author investigates the apparent normative tensions emerging from Europe’s promotion of LGBTI rights as liberal human rights and the ensuing pushback by culturally and politically conservative states. He examines the compatibility of EU institutional and member states’ conceptions of LGBTI rights and the more general question of the EU’s normative agenda-setting power on the world stage. He then explores the external policy areas in which LGBTI rights promotion is formulated and diffused – namely in development and foreign aid, in enlargement and neighbourhood policies, and in other international organizations. This statement is from one of the world’s most famous neurologist, Sigmund Freud, which developed psychoanalysis in 1935. Despite this statement it took 55 more years until the World Health Organisation (WHO) removed homosexuality from the list of mental disorders. Until 1993, homosexuality was classified as a harm of the body or mind, with the LGBT rights campaign still a young ‘discipline’, although achieving big successes in recent years. Nevertheless there is still a huge inequality between heterosexuals and LGBT peoples. Human rights in totality are more of a political issue than a legal issue. Only the collective understanding of human rights makes them universal, with citizens expecting their state to comply with them. This includes the rights of the LGBT peoples. Based on science a percentage, between 5 and 10 percent, of the human population identify as gay, this issue concerns between 350 to 700 million people. Not included are the estimated percentages of bisexual and transgender people, who also relate to these rights. Regardless of this it is surprisingly that the prosecution, discrimination and ostracism is not hidden, but rather operated in an open and partially aggressive way by religious communities, government bodies and individuals. This essay is going to answer firstly whether the LGBT rights could be classified as human rights. Secondly, there will be a discussion of the United Nation (UN) Declaration specifically the LGBT peoples. Thirdly, there is an overview of the global LGBT rights with particular focus on three selected countries: Uganda, Russia and South Africa, as these countries currently attract attention primary due to LGBT rights. Accordingly there is a critique and a conclusion.

The now twenty-one countries where lesbians and gay men can legally marry include recent or longstanding democracies, republics and parliamentary monarchies, and unitary and federal states. They all reflect different positions with respect to religion and the cultural foundations of the nation. Countries opposed to such legalization, and those having taken measures in recent years to legally reinforce the heterosexual fundaments of marriage, present a similar diversity. This diversity, in a globalized context where the idea of same-sex marriage has become integral to claims for LGBTI equality and indeed LGBTI human rights, gives rise to the following question: which factors contribute to institutionalizing same-sex marriage? The analytical framework used for exploring these factors in this book is neo-institutionalism. Through three neo-institutionalist lenses—historical, sociological and discursive—contributors investigate two aspects of the processes of adoption or opposition of equal recognition of same-sex partnerships. Firstly, they reveal how claims by LGBTIQ movements are being framed politically and brought to parliamentary politics. Secondly, they explore the ways in which same-sex marriage becomes institutionalized (or resisted) through legal and societal norms and practices. Although it adopts neo-institutionalism as its main theoretical framework, the book incorporates a broad range of perspectives, including scholarship on social movements, LGBTI rights, heterosexuality and social norms, and gender and politics.

Understanding LGBT human rights claims is impossible, Ryan R. Thoreson contends, without knowing the answers to these questions. In Transnational LGBT Activism, Thoreson argues that the idea of LGBT human rights is not predetermined but instead is defined by international activists who establish what and who qualifies for protection. He shows how IGLHRC formed and evolved, who is engaged in this work, how they conceptualize LGBT human rights, and how they have institutionalized their views at the United Nations and elsewhere.
