Available in PDF, EPUB and Kindle. Book excerpt: WTO Law and Direct Taxation are linked in numerous ways. The WTO Agreements, thereof especially the GATT and GATS Agreements, contain several explicit provisions on the subject of direct taxes or even on its delimitation from Tax Treaty Law. To some extent, the scope of application of WTO Law has been broadened by case law to comprise also direct taxes. This entails overlappings particularly with regard to the law of subsidies, prohibitions of discrimination, and most-favoured-nation obligations. This book highlights increasingly relevant interdependencies between WTO Law and Direct Taxation from the viewpoint of 21 States. Special emphasis is placed on the conformity of national taxes on profits with WTO Law as well as on specifics of interpretation in several Member States. 21 National Reports from nearly all EU countries as well as Colombia, Israel, New Zealand, Norway and the USA dealt with this topic and were compiled and published in this volume. Additionally, a General Report prepared by Servatius van Thiel summarises the results of the National Reports. Moreover, experts in this field joining the Conference among them Reuven Avi-Yonah, Michael Lennard and Raymond Luja have volunteered contributions dealing with specific problems of WTO and Direct Taxation.

Available in PDF, EPUB and Kindle. Book excerpt: This book presents a conceptual framework for analysing the definitions of State aid and subsidy in EC and WTO law. This is done through a comparative analysis, examining the coherence of the conceptual understanding of the crucial, but still elusive, issue of the definition of subsidy. The first, important finding is that the topic is not only technical but raises more fundamental questions about the objectives of subsidy control in a given legal system and, more radically, about the goals of that system itself. The analysis does not only concentrate on the state of the law but critically looks forward offering suggestions for new interpretations and law reform. The book focuses on the substantive provisions of the EC and WTO relating to what are identified by the author as the core properties of a notion of subsidy, ie a form of public action, the grant of an economic advantage and the ensuing impact on the competitive process. The current regulation in EC and WTO law is analysed, compared and assessed in depth, and tested against a baseline represented by of a notion of subsidy inserted in a subsidy regulation pursuing certain objectives. Drawing on the results of the comparative exercise, the book argues that both systems can learn valuable lessons from each other to achieve a greater coherence and a more efficient regulatory system.

Highlights include chapters on budgetary politics in a time of deep deficit, the impacts of campaign message and election mandates, veto bargaining, and the making of U.S. foreign policy over four decades. Case studies of budget battles, trade wars, and the war in Iraq lend concrete detail to political theory. Book excerpt: It would be difficult to find a more heated topic in American political circles than tax cuts. Do they help the economy, the rich, or the middle class? Or do they harm the economy? Do the rich benefit the most and should they? Tax cuts are closely tied to the Tax Code which very few people truly understand. The new book tries to make sense out of this impenetrable jungle of issues, projections and actual tax cuts. Contents: Preface; Tax Cut Bills in 2003: A Comparison; Across-the-Board Tax Cuts: Economic Issues; Tax Cuts, the Business Cycle, and Economic Growth: A Macroeconomic Analysis; Using Business Tax Cuts to Stimulate the Economy; Tax Cuts and Economic Stimulus: How Effective Are the Alternatives?; Economic and Revenue Effects of Permanent and Temporary Capital Gains Tax Cuts; The Individual Alternative Minimum Tax: Interaction With Marriage Penalty Relief and Other Tax Cuts; Major Tax Issues; Index.

Available in PDF, EPUB and Kindle. Book excerpt: This book, Principles of International Trade: Import-Export, is intended for students studying international trade and for business people who want to engage in international trade. This book covers the basic concepts and procedures that are required for starting and completing international transactions. All businesses, regardless of whether they do only domestic business or not, are affected by international trade and business. Consumers encounter imported products at most retail stores, and domestic businesses are exposed to stiff foreign competition. As a consumer or as a businessperson, all of us need to understand international trade for our own benefits. The draft version of this book, annually or biannually revised, had been used as a textbook at California State University, Los Angeles, California (Cal State, Los Angeles), and Pacific States University, Los Angeles, California (PSU), for over ten years before this book was first published in 1993 with the help and encouragement of my family, friends, students, and colleagues at both campuses. This book consists of thirty-seven chapters, a bibliography, websites, indexes, and endnotes. The text is divided into two parts. The first part, chapters 1 through 27, covers matters for importing goods from overseas and common topics related to both importing and exporting. The second part, chapters 28 through 37, is devoted to topics for exporting overseas. This new edition includes the latest Uniform Customs and Practice for Documentary Credits No. 600 (2007 Revision) and Incoterms 2010 published by the International Chamber of Commerce (ICC). Instructors teaching materials for international trade (import-export), such as PowerPoint slides and key points for examinations, are available at the authors website: http://www.internationaltraderesearch.com. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the ill-defined and oft-underestimated relationship between the World Trade Organization (WTO) and taxation. By adopting a two-pronged approach, the relationship is examined in terms of the extent to which the WTO legal framework exerts influence upon domestic tax law and international tax policy, and whether it is appropriate for the WTO to play a regulatory role in the field of taxation. The book begins with an examination of the historical development of international trade law and international tax law, and demonstrates that these two separate areas of law are closely linked in terms of their underlying principles and historical evolution. The work then goes on to offer a doctrinal analysis of the tax content found in the WTO legal texts and highlights ambiguities therein.
