The first part of the volume relates to the subject of the limitation of armaments, and has heretofore been issued by the Division in English translation as No. 22 of this Pamphlet Series, the supply of which has been exhausted. The footnotes of the original have been enlarged by adding biographical and bibliographical data. It will be observed that the rush-bagot Agreement between Great Britain and the United States for the limitation of armament upon the Great Lakes of North America was not included among the documents submitted by the Nether land Government to the Hague Peace Conference. As the present publication consists solely of the documents laid before the Conference, it was not deemed advisable to insert it in the text. Inasmuch, however, as one of the documents included in the collection refers to the Agreement, it is, for the sake of complete ness, added in the form of an appendix. The reader interested in the Agreement will find it most conveniently perhaps in the second of the present series of pamphlets, entitled Limitation of Armament on the Great Lakes, being 'the report made under date of December 7, 1892, by the Honorable John W. Book excerpt: Excerpt from The International Union of the Hague Conferences IN studying the problem of obligatory arbitration the author became impressed with the conviction of the extent to which the proper solution of a separate problem of that kind is at the present day dependent upon the fact that a clear idea shall first have been obtained of the direction which the Hague work as a whole has given to the develop ment of international law. Neither the diplomats of the Hague Conferences nor the specialists in the theory of international law have thus far studied in detail this cardinal question. As a result of his investigation of this problem the author arrived at wholly new conclusions. But this fact has not troubled him. He who brings new ideas to light must in the nature of things stand at first alone. And this isolation will, in Germany, be all the greater in an age such as ours. The view which Nietzsche was the first to present strikingly, that the period of German unity and economic impetus must be followed by an unfortunate setback in the intel lectual life of Germany, is admitted as just by many persons at the present day. The voluntary barriers which a de cadent age has set for itself in respect to its ideas and its ideals must also have a fatal influence upon the German science of international law. But already the spring winds of a new age are blowing abroad, and those who hold to the ideas of 1875 are everywhere being forced to defend their position. Thus it has now become possible to obtain recognition for new standards in international law as well. It is true that the unfortunate political events of the past year have called forth in me serious doubts as to my individual attitude with respect to the value of the work of The Hague - doubts which to some extent persist down to the present day. Indeed, while I was writing this book there came into my mind many a time a sad story which is often told in Munster, the city of my birth. There lived there a leader of the Anabaptists who shortly after the founding of the millennium withdrew into solitude in order to write a great work in which he might portray to his contemporaries the grandeur of this ideal state and propagate its theories. But when he came out again before the populace, his face beaming with satisfaction upon the completion of his work, he found that the millennium had become a reign of terror and of wild disorder. In like manner let the author who writes his books from the heart, and who makes it his ambition to take a conscious part in the progressive development of his country and of all man kind, beware of a like experience. Book excerpt: Excerpt from A World Treaty of Arbitration As a result of the movement for arbitration in the nineteenth century an attempt was made at the First Hague Conference to incorporate 'into its Convention for the Pacific Settlement of International Disputes a universal system of obligatory arbitra tion. But, owing to the opposition of Germany, arbitration, though approved as a theory, was left on a voluntary basis. The articles accepted were declaratory of opinion, but without legal effect. The Permanent Court of Arbitration was established, but this also, owing to Germany's opposition, was put on a voluntary basis. Provision was made, however, that the nations might, if they desired, make arbitration treaties among themselves with a view to extending obligatory arbitration to all cases which they may consider it possible to submit to it. Book excerpt: Excerpt from The Hague Peace Conferences: And Other International Conferences Concerning the Laws and Usages of War, d104s of Conventions With Commentaries In 1904 I published translations of the Declarations of Paris and St Petersburg, the Convention of Geneva, 1864, the draft Brussels Declaration, 1874, and the Conventions signed at the First Peace Conference, together with a short introduction and a few notes. I did so chiefly for the sake of students attending my lectures in Cambridge, as, at that time, there was not to my knowledge any one book in which the English texts of these important international documents could be found. The present work contains in addition to the French texts of the foregoing (except the Brussels Declaration) the French and English versions of the Geneva Convention of 1906, the Final Act and Conventions of the Second Peace Conference, 1907, and the London Naval Conference of 1909. I have also included in my commentary on Convention No. 10 of the Hague Conference, 1907 (10 H. C. 1907), a translation of the Convention signed at the Hague on the 21st Dec. 1904, exempting hospital ships from state port dues and taxes in the ports of the signatory Powers. Great Britain is not a party to this Convention. The Conventions of the First Conference as amended by the Second are printed in parallel columns, the changes being shown in italics, and cross-references occur throughout. The French texts have been taken from the official sources, and in the case of the Hague Conventions of 1907 they have throughout been carefully compared with the texts contained in La Deuxieme Conference Internationale de la Paix published by the Dutch Government. As regards the translations, I have made the British official translations the basis of my work: I have however in nearly all cases compared them with those contained either in Mr E. A. Whittuck's International Documents, Professor James Brown Scott's d104s of the Peace Conferences at the Hague, 1899 and 1907 (which contains the official United States translations), Professor T. E. Holland's Laws of war on land, Dr Westlake's International Law, War, or General G. B. Davis's Elements of International Law. In the case of the Declaration of London, I have adhered to the official translation with a few exceptions.
