But because juries deliberate in secret, legal policymakers have made important decisions about the scope and conduct of jury trials on the basis of untested intuitions about how juries reach verdicts. In this review of research on jury behavior, the author emphasizes the use of mock jury experiments to test hypotheses and refine theoretical models of the decision process. Because jury decisionmaking involves two different phases--cognitive processing during the trial and deliberation in the jury room--the author reviews research on both the trial and deliberation phases of the judgment process. In keeping with the emphasis of most jury research, he focuses primarily on decisionmaking in criminal trials; the extent to which the findings can be applied to civil litigation is discussed in RAND/N-2671.

This is the question that my study attempts to answer. The topic of racial bias in jury decision making is a subject that is difficult to study, due to the problem of access. A researcher cannot sit in on an actual deliberation. In an attempt to answer my question, I conducted an experimental study on jury decision making among undergraduate students at Boise State University, by use of a survey. In the experiment, I varied the name, and thereby the perceived race, of the defendant. In the treatment group, participants were exposed to a black defendant, while in the control group, participants were exposed to a white defendant. There were 286 responses to my survey over a 12-day period in early 2017. In order to evaluate the results, I conducted a difference in means test between the treatment and control group (a t-test) in my analyses. Difference of means tests were appropriate since there were no differences between the treatment and control group in observed demographic characteristics. The 286 responses that were used were sufficient for data analysis, considering there were only two experimental groups. My hypothesis regarding the treatment alias (seemingly black) being convicted more often than the control analysis (seemingly white) was not supported. The analysis showed that the control alias was convicted more often. This study has implications regarding jury selection that can be used in real world situations. These recordings, along with responses to detailed questionnaires, yielded significant data, equally applicable to civil as to criminal cases. We learn their reactions to their fellow jurors; personal evaluations of the quality and effectiveness of delibera-tions; the degree to which religion, sex, social status, education, and like factors affect participation in and influence on the course of the deliberation; and the recounting of and reliance upon personal experience in seeking to reach a verdict, among other in-sights furnished by this study. Book excerpt: This report presents the findings from a mock sexual assault jury trial research project conducted on behalf of the New South Wales Attorney General's Department in 2005. The project aimed to investigate whether the impact of adult sexual assault complainant testimony on juror perceptions and decisions differs if presented via closed circuit television (CCTV), pre-recorded videotape or face-to-face in the courtroom. The study also investigated the impact of emotional versus neutral complainant testimony. Eighteen mock trials were held in a mock courtroom in which 210 members of the public participated as jurors. After watching the trial but before jury deliberation, jurors completed individual questionnaires which investigated their perceptions of complainant credibility, empathy with the complainant, overall impression of the complainant, empathy with the accused, overall impression of the accused and personal beliefs about guilt of the accused. After jury deliberation, jurors completed a questionnaire which asked again about their beliefs about guilt of the accused. Jurors also completed a questionnaire about their attitudes toward rape victims in general. The report outlines the methodology used, the key findings, issues arising from juror feedback and the difficulties encountered by jurors in trying to reach unanimous verdicts. The study finds, overall, that immediately following the trial but before jury deliberation, mode of presentation of testimony (face-to-face, CCTV or pre-recorded videotape) did not impact differentially on juror perceptions of the complainant or the accused, or guilt of the accused. The degree to which the complainant was upset while giving her testimony (emotional) or calm (neutral) was also not found to impact in any consistent pattern on juror perceptions or decisions. One of the key insights obtained during this study was the high degree to which many jurors believed many of the "myths" which surround rape in general. Acceptance of these myths means that many jurors have strong expectations about how a "real" victim would behave before, during and after an alleged sexual assault. These expectations impact on their perceptions of the complainant's credibility. Other key issues were the difficulty juries experienced in defining reasonable doubt, and the difficulty of understanding what was meant by "consent".
