Book excerpt: From 1978 to the present day, China has developed its economy through the strategic use of foreign direct investment (FDI). This thesis demonstrates how Chinese economic reforms since 1978 have led to an increase in FDI inflows and illustrates how the government channeled those FDI flows to prioritize a process of economic development evolving from low-skilled to high-skilled sectors of the economy, evidenced by the country's evolving export profile over time. Through the examination of three different time periods, this thesis shows how shifts in government policy affected the inflows of FDI and how the government channeled this FDI. Between 1978 and 1989, the Chinese government funneled resources into non-strategic sectors, such as the textile industry. From 1989 to 2001, China reoriented its resources toward strategic sectors, including telecommunications. Finally, from 2001 to the present, China shifted its focus toward high-value added sectors of the economy, including automobiles, information and communications technology (ICT), and semiconductors. Overall, between 1978 and the present day, FDI has increased dramatically, reflecting China's economic priorities. The Chinese government's decision to use FDI to promote high-value added sectors showcases its ambitious and strategic policymaking in the service of rapid and sustained economic success. I. FDI has contributed to higher investment and productivity growth, and has created jobs and a dynamic export sector. China's success, however, did not come without some pitfalls: an increasingly complex tax incentive system and growing regional income disparities. Accession to the WTO should broaden China's "opening up" policies and continue FDI's contributions to China's economy in the future.

But this FDI inflow corresponds closely to predicted FDI flows into China from a model that predicts FDI inflow based on government quality indicators and controls and is estimated across a sample of other weak-institution countries. The only real discrepancy is that, if government quality is measured by constraints on executive power, China receives somewhat more FDI than the model predicts. This might reflect an underestimation of the strength of these constraints in China, a unique institutional setting for FDI operations, FDI based on expected future institutional improvements, or a unique Chinese model of development. The authors conclude that Ockham's razor disfavors the last. They also note that FDI may be elevated because Chinese institutions protect foreign firms better than domestic ones.

Book excerpt: The economic and political rise of China has led to considerable controversy regarding potential repercussions for the current global governance architecture. At least two opposing scenarios are conceivable: China's adaptation to the rules and norms system shaped by developed countries or the pursuit of a distinctive policy approach, a possibility that involves the danger of clashing regulatory policies. A recent and increasingly dynamic trend giving substance to the phenomenon of China's rising importance is the growth of outward foreign direct investments (OFDI) by Chinese enterprises. Against this background, the present paper investigates the evolution and change of Chinese international investment policy-making, with a particular focus on bilateral investment treaties (BITs) as the most important legal instrument for the governance of global foreign direct investment (FDI) flows. China has been a committed signatory of BITs since the early 1980s (120 treaties up to 2007). It is thus the second most active contracting party to BITs worldwide, surpassed only by Germany. The traditional Chinese BIT approach, however, has only cautiously supported the legal protection of FDI. As a mere capital-importer, China concluded BITs that contained serious reservations and safeguards intended to preserve policy spaces for the regulation of incoming investments. Starting at the end of the 1990s the Chinese government initiated a decisive policy shift towards a liberal BIT approach characterized by high levels of substantive and procedural investment protection. Upon examining a representative sample of Sino-foreign BITs, this study concludes that the policy shift was a pro-active decision of the Chinese government intended to introduce liberal treaty provisions first and foremost with developing countries which are the main destination of Chinese OFDI. A further explanation for this development may be found in the great importance attached to the promotion of OFDI through the “Going Global” strategy announced by the Chinese government at the end of the 1990s. In sum, this paper concludes that China has adopted a complementary rather than a competitive approach in the field of global FDI governance. China has fully agreed to standards of the current international liberal regime for FDI protection and has become an important global player in this context. This policy shift will yield consequences for China itself by levelling the playing field for international investors. Furthermore, developing countries that have concluded BITs with China will face a further reduction of their legal and regulatory autonomy, which is already limited by treaties with developed countries. China's BIT policy, therefore, contradicts the widespread rhetoric of a mutual beneficial South-South cooperation. Lastly, the emerging complementarity of investment policies between China and developed countries at the bilateral level gives rise to the possibility of enhanced cooperation between both at higher levels, for instance as part of the Heiligendamm Process between G8 countries and emerging countries.

Abstract: Abstract of dissertation entitled The Changing Trends and Patterns of Foreign Direct Investment in China Submitted by Wong Wai Sze, Agnes For the Master of Arts in China Development Studies at the University of Hong Kong in June 2005 China has undergone a dramatic growth since 1978, when the "Open Door Policy" promoted a new era of modernization. The transition from a planned economy towards a market system has created new opportunities for Foreign Direct Investment (FDI) that was soon recognized as a powerful engine for China's economic development. The growing importance of the Chinese economy is evidenced by the high level of international interests in the Chinese market. The economic boom and liberalization make China a new focus of investment by multinational corporations (MNCs). However, the questions of how to enter this huge market and what entry mode should be taken remain poorly understood. Therefore, this paper is a study of the entry modes of MNCs into China from a socioeconomic perspective. This thesis examines two questions, namely "how" MNCs formulate their entry mode strategy for the Chinese market and "what" factors influence their chosen entry mode. The former involves the choice between Joint Ventures which includes Contractual Joint Ventures (CJVs) and Equity Joint Ventures (EJVs), and Wholly Foreign-Owned Enterprises (WFOEs) while the later involves host country and home country factors. After evaluating different indicators of investment environment such as host country policies, country risks, etc, it is found that there exists a positive relationship between the selection of entry modes and the investment environment of the target region. The better the investment environment is, the higher the level of resource commitment entry modes the MNCs are willing to adopt. MNCs prefer WFOEs rather than EJVs in some economically advanced regions like the eastern coast of China. On the other hand, lower resource commitment entry modes are usually found in the central and western part of China. The prioritized areas only play an important role in the early 1990s and their importance is fading, but these areas still maintain their status in the inland region. Host country specific factor is one of the key determinants in affecting MNCs' foreign market entry strategies.
