Book excerpt: This article presents the research results of an extensive examination of 1893 Los Angeles County probate records, which are the earliest such records still remaining in the Los Angeles County Archives. This research was undertaken to determine what effect the 1861 California Married Women's Property Act, together with subsequent changes in California probate law that were implemented throughout the latter half of the 19th century, had on testate and intestate succession of women's property. The article first provides historical background information about Los Angeles as it was 1893 (including population figures, the racial and gender makeup of the inhabitants, issues related to communication, migration, and technology, and a snapshot of California probate law at the time). It then gives a brief factual overview of each of the decedents whose records were studied, followed by an analysis of testate distribution patterns (with particular attention to differences between male and female decedents). Finally, it provides additional information about so-called problem wills - those which gave rise to will contests and other litigation.

Book excerpt: Recognition of the potentially deleterious implications of inequality in opportunity originating in a skewed asset distribution has spawned considerable interest in land reforms. However, little attention has been devoted to the fact that, in the longer-term, the measures used to implement land reforms, especially rental restrictions, could negatively affect productivity. Use of state level data on rental restrictions, together with a nationally representative survey from India suggests that, contrary to original intentions, rental restrictions negatively affect productivity and equity by reducing scope for efficiency-enhancing rental transactions that benefit poor producers. Simulations suggest that, by doubling the number of producers with access to land through rental, from about 15 million currently, liberalization of rental markets could have far-reaching impacts.

Women in politics have the power to support constituent rights at critical junctures, such as marriage negotiations, when they can strike integrative solutions to intrahousehold bargaining. Yet there is a paradox: quotas are essential for enforcement of rights, but they generate backlash against women who gain rights without bargaining leverage. In this groundbreaking study, Brulé shows how well-designed quotas can operate as a crucial tool to foster equality and benefit the women they are meant to empower.

This exclusion was accomplished by a series of legal devices designed to nullify the common-law rules of inheritance under which--had they prevailed--40 percent of English land would have been inherited or held by women. Current ideas of family development portray female inheritance as increasing in the seventeenth and eighteenth centuries, but Spring argues that this is a misperception, resulting from an incomplete consideration of the common-law rules. Female rights actually declined, reaching their nadir in the eighteenth century. Spring shows that there was a centuries-long conflict between male and female heirs, a conflict that has not been adequately recognized until now.

It focuses on India, examining the legislative processes that led to the 2005 amendment of the Hindu Succession Act 1956, along with several interconnected welfare policies. Scholars have understood these Acts as a response to growing concerns about women’s property rights in developing countries. In re-reading these Acts and exploring the wider nexus of Indian society in which the legislation was drafted, this study considers how questions of family structure and property rights contribute to the creation of legal subjects and demonstrates the significance of the politico-economic context of rights formulation. On the basis of an ethnography of a village in West Bengal, this book brings the moral axis of inheritance into sharp focus, elucidating the interwoven dynamics of bequest, distribution of family wealth and reciprocity of care work that are integral to the logic of inheritance. It explains why inheritance rights based on the notion of individual property rights are inadequate to account for practices of inheritance. Mondal shows that inheritance includes normative structures of affective attachment and expectations, i.e., evaluatively-charged imaginaries of the future that coordinate present practices. These insights pose questions of the dominant resource-based conceptualisation of inherited property in the debate on women’s empowerment. In doing so, this work opens up a line of investigation that brings feminist rights discourse into conversation with ethics, enriching the liberal theory of gender justice.

Book excerpt: While female property ownership is associated with positive outcomes for women, their right to inherit property in male-dominated societies may also result in more constraining marriage and gender norms. I develop and test the following hypothesis: Where a woman inherits property, her male relatives are more likely to arrange her marriage within the same community in order to avoid fragmentation of the land. Arranging the marriage also requires controlling the woman's relations and mobility, which negatively impacts her economic participation. By analyzing datasets on pre-industrial societies and Indonesian individuals, I find that female inheritance is associated with a higher prevalence of cousin and arranged marriages as well as lower female economic participation and premarital sexual freedom. Using a difference-in-differences design that exploits exogenous variation induced by a reform of inheritance laws in India, I also provide evidence for a causal effect of female inheritance on cousin marriage and female economic participation rates. These findings have implications for the evolution of marriage and gender norms in Islamic societies, where female inheritance is mandated by Islamic law.
