Available in PDF, EPUB and Kindle. Book excerpt: The Council of Europe is convinced of the need to improve access to social rights as a key means of combating poverty and social exclusion and in promoting social cohesion. The report on access to social rights in Europe is mainly based on the results of the activities related to access to employment, social protection and housing, as well as relevant work carried out within the Council of Europe in the fields of health and education. This report analyses the obstacles impeding access to different social rights within and across a range of fields. It also gives examples of how obstacles are being overcome, examines integrated measures implemented in the member states of the Council of Europe and identifies the principles on which measures to improve access to social rights should be based. Finally, the report develops cross-sectoral policy guidelines aimed at facilitating access to social rights.

Book excerpt: This collection addresses the potential of the European Social Charter to promote and safeguard social rights in Europe. Drawing on the expertise of the ETUI Transnational Trade Union Rights expert network from across Europe, it provides a comprehensive commentary on these fundamental rights. Taking a two part approach, it offers an in-depth legal analysis of the European Social Charter as a new social constitution for Europe, investigating first the potential of the general legal frame in which the Charter is embedded. In the second phase a series of social rights which are related to the employment relation are examined in particular in light of the jurisprudence of the European Committee of Social Rights (ECSR), to demonstrate the crucial but difficult role of the Charter's supervisory bodies to secure the respect and promotion of social rights and national level, bearing in mind the reciprocal influence of other international social rights instruments. This examination is timely, given the pressure exerted on those rights during the recent period of economic crisis. Furthermore, in the light of the predominantly economic vision of Europe, such analysis is crucial. The collection is aimed at stimulating academic scrutiny and raising awareness amongst practitioners and trade unions about this important and equally necessary anchor of the social dimension of Europe in legal and political practice.

This debate is not new, but until now the notion of a 'social Europe' remained vague and elusive. To make progress, we need a coherent conception of the reasons behind, and the agenda for, not a 'social Europe', but a new idea: a European Social Union. We must motivate, define, and demarcate an appropriate notion of European solidarity. We must also understand the legal and political obstacles, and how these can be tacked. In short, we need unequivocal answers to questions of why, what, and how: on that basis, we can define a clear-cut normative and institutional concept. That is the remit of this book: it provides an in-depth interdisciplinary examination of the rationale and the feasibility of a European Social Union. Outstanding scholars and top-level practitioners reflect on obstacles and solutions, from an economic, social, philosophical, legal, and political perspective.

Available in PDF, EPUB and Kindle. Book excerpt: On 1 December 2009 the Treaty of Lisbon entered into force. Although often described as primarily technical, it significantly amended the Treaty on the European Union (TEU) and the old EC Treaty (now the Treaty on the Functioning of the European Union, TFEU). The authors' aim in this book is to explore what the Treaty means for social law and social policy at the European level. The first part of the book on the general framework looks - at a time of financial crisis - for new foundations for Europe's Social market economy, questions the balance between fundamental social rights and economic freedoms, analyses the role of the now binding Charter of Fundamental Rights, maps the potential impact of the horizontal clauses on social policy and addresses the possibilities for social partners to enlarge their role in labour law and industrial relations. The second part, on the social framework of the Treaty, focuses on the development of the Union's competences. In it the authors evaluate the consequences of the new general framework on social competences, analyse the evolution of the principle of subsidiarity and its impact in the new Treaty, look at the coordination of economic policies in the light of fundamental rights, and analyse the adoption in the Treaty of a new architecture for services of general interest.

Available in PDF, EPUB and Kindle. Book excerpt: In the 1990s, the Maastricht Treaty introduced the right to free movement for EU citizens. In practice, however, there are substantial barriers to making use of this right, particularly to integration and to accessing the social and welfare rights available. This is particularly true when it comes to accessing social rights, such as social assistance, housing benefit, study grants and health care. This book provides a detailed description and thorough analysis of these barriers, in both law and practice.

Available in PDF, EPUB and Kindle. Book excerpt: As the influence of labor unions declines in many industrialized nations, particularly the United States, the influence of workers has decreased. Because of the need for greater involvement of workers in changing production systems, as well as frustration with existing structures of workplace regulation, the search has begun for new ways of providing a voice for workers outside the traditional collective bargaining relationship. Works councils—institutionalized bodies for representative communication between an employer and employees in a single workplace—are rare in the Anglo-American world, but are well-established in other industrialized countries. The contributors to this volume survey the history, structure, and functions of works councils in the Netherlands, Germany, France, Spain, Sweden, Italy, Poland, Canada, and the United States. Special attention is paid to the relations between works councils and unions and collective bargaining, works councils and management, and the role and interest of governments in works councils. On the basis of extensive comparative data from other Western countries, the book demonstrates powerfully that well-designed works councils may be more effective than labor unions at solving management-labor problems.

Available in PDF, EPUB and Kindle. Book excerpt: Health care and its financing will not be harmonized within the European Union (EU). Therefore, the differences between the health systems of the member-states in a Single European Market are gaining in relevance. The process of economic integration also effects health. This book integrates economics, law, social, political and health sciences in the analysis of health care issues in the EU. It covers the development of health systems and policy in the community, the markets for pharmaceuticals and for medical devices, EU-trends in hospital financing, issues in the comparison of financing systems, especially in the field of private expenditures, reforms of health care financing in social security systems and national health services in the EU and cross-border health care between EU member-states. The results feature an up-to date overview on the European dimension of health care and its financing. The book is relevant to experts in health care organizations, policy, industry and research.

Available in PDF, EPUB and Kindle. Book excerpt: Social policy has become an increasingly prominent component of the European Union's policy-making responsibilities. Today, for example, a highly developed body of law regulates equal treatment in social security and co-ordinates national security schemes; national health services have opened up to patients and service providers from other states; and rules govern the translation of educational and vocational certificates across member states. This state of affairs is all the more remarkable given the relatively limited resources at the EU's disposal and the initial intentions of its founders. During negotiations for the Treaty of Rome in the 1950s, social policy was viewed as the exclusive provenance of the member states. There were to be provisions to facilitate labour mobility within the common market, but until the 1970s social policy making at the EU-level was modest. However, plans for the internal market moved social policy on the EU's decision-making agenda. The Social Chapter was adopted in 1989, and the Single European Act expanded EU competencies in social policy. The Treaties of Maastricht, Amsterdam and Nice all expanded competencies further, so that by the time the heads of government met in Lisbon in 2007 to sign the EU's latest treaty, the extent of supranational control over important aspects of social policy making was quite impressive. This important book provides a full account of the evolution of social policy in the EU and of its current reach. It examines the reasons for the increased role of the EU in the area, in spite of formidable obstacles, and details its effects in member states, where social provision is often the biggest item in government budgets and a crucial issue in national elections. Drawing on research done on welfare states around the world and on European integration, this book provides a distinctive and sophisticated account of social policy in Europe, showing how it must now be understood in the context of multi-level governance in which EU institutions play a pivotal role.

Available in PDF, EPUB and Kindle. Book excerpt: Europe's work force is subject to a dual convergence process: from the transnational spread of new management practices and from the political force of European union. Trade union rights, hours of work, working practices and training provisions are all being subjected to these twin pressures. Work and Employment in Europe assesses both the convergent and divergent developments taking place at both pan-European and cross-national levels. Comparisons of British and French retailing, German and Italian manufacturing jobs, German and British youth training schemes, and small business strategies of Britain, France and Italy show simultaneous elements of convergence and national specifity.
