Book excerpt: "It's not a casebook; it's not a hornbook; it's not a traditional study aid. It's a short and extremely readable introduction to the five essential concepts of contract law: consideration, offer and acceptance, parol evidence, conditions, and quasi-contract. Contracts: The Five Essential Concepts focuses on the ideas that first year contracts students are most likely to find confusing. Written in a relaxed, informal and nontechnical style, this book explains the five basic concepts using humorous anecdotes and familiar, relevant examples from daily life such as buying a laptop online, signing a lease, and taking out a student loan. It is the perfect supplement to a traditional casebook because it explains the logic underlying the most significant precedents without "hiding the ball" and in an intuitively appealing way. Contracts: The Five Essential Concepts will be of great interest both to professors wishing to assign or recommend readings to supplement an existing syllabus, as well as to students looking for assistance in deciphering the readings that the professor assigns. Recent graduates reviewing contract law for the bar exam will find it invaluable, as will foreign graduate students whose knowledge of American contracts law is limited. Members of the general public wishing to understand what contract law is all about will be delighted by the book's clear tone and engaging presentation. Totally unique in both ambition and realization, this book belongs on the shelf of every reader with some reason to understand the basics of the American law of contracts"--

Available in PDF, EPUB and Kindle. Book excerpt: This casebook presents a deep comparative analysis of property law systems in Europe (ie the law of immovables, movables and claims), offering signposts and stepping stones for the reader wishing to explore this fascinating area. The subject matter is explained with careful attention given to its history, foundations, thought-patterns, underlying principles and basic concepts. The casebook focuses on uncovering differences and similarities between Europe's major legal systems: French, German, Dutch and English law are examined, while Austrian and Belgian law are also touched upon. The book combines excerpts from primary source materials (case law and legislation) and from doctrine and soft law. In doing so it presents a faithful picture of the systems concerned. Separate chapters deal with the various types of property rights, their creation, transfer and destruction, with security rights (such as mortgages, pledges, retention of title) as well as with harmonising and unifying efforts at the EU and global level. Through the functional approach taken by the Ius Commune Casebooks this volume clearly demonstrates that traditional comparative insights no longer hold. The law of property used to be regarded as a product of historical developments and political ideology, which were considered to be almost set in stone and assumed to render any substantial form of harmonisation or approximation very unlikely. Even experienced comparative lawyers considered the divide between common law and civil law to be so deep that no common ground - so it was thought - could be found. However economic integration, in particular integration of financial markets and freedom of establishment, has led to the integration of particular areas of property law such as mortgage law and enforceable security instruments (eg retention of title). This pressure towards integration has led comparative lawyers to refocus their interest from contract, tort and unjustified enrichment to property law and delve beneath its surface. This book reveals that today property law systems are closer to one another than previously assumed, that common ground can be found and that differences can be analysed in a new light to enable comparison and further the development of property law in Europe.

Book excerpt: “Contract Law: A Commonwealth Caribbean Case Book” focusses on contract law, as articulated by the jurists of the Commonwealth Caribbean region. Case law from across the region has been combed to source the cases identified in this text. The jurisdictions from which the cases have emanated span the full breadth of the Commonwealth Caribbean region. The quality of the judgments referenced and the clarity of expression of the legal principles by our regional jurists should greatly assist the young law student in his journey through this interesting area of law. The Caribbean jurisprudence in the area of contract law operates within statutory and common law boundaries. The absence of statutory intervention in some situations and the presence of legislation in others, makes this area of law unique in its operation. While it is important for students to be able to conduct research, there is a need for Commonwealth Caribbean resource material. This book seeks to achieve this objective. The wide body of contractual principles have been categorised into identifiable elements of contract law so as to guide a student through this vast area of law. I hope to underscore the essential nature of contract law to not only the law student’s arsenal of legal expertise, but also to his eventual practice of law. It is hoped that this book can assist in developing a genuine interest and understanding of contract law.
