The military reserves provide trained service members and units that are available for active military duty during peacetime and war. Over the past decade, the Department of Defense (DoD) has dramatically increased its reliance on the reserve forces, particularly since the terrorist attacks of September 11, 2001. The reserves are integral to current operations of service members deployed in November 2004 in Iraq and Afghanistan, about 33 percent were reservists and DoD foresees continued reliance on them. (Throughout my testimony, reserves refers to the individual services National Guard and reserve components: the Air Force Reserve, the Air National Guard, the Army Reserve, the Army National Guard, the Coast Guard Reserve, the Marine Corps Reserve, and the Navy Reserve.) Yet many reservists, when they joined the military, probably did not anticipate the increased frequency and duration of the activations that have occurred during the past several years and may be finding those mobilizations more disruptive than they might have expected. To alleviate difficulties with call-ups, the Congress has enacted legislation to provide civil and employment protections and financial relief. The Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA), the primary legislation governing service members employment rights, guarantees the right of reservists to be reemployed by their civilian employer after serving on active duty, prohibits employers from discriminating against individuals in any aspect of employment because of their service in the reserves, and mandates some continuation of benefits to reservists who have been activated.

Book excerpt: This study provides the analysis and research necessary to identify and recommend ways to support reservists' civilian employers. Employers are not able to support sustained reservist absences that are now more frequent and for longer periods of time. The need to support employers has increased with the new U.S. National Security Strategy. Adequate support from Congress to employers is necessary. Reservists must maintain employment and thus they encounter more issues surrounding their dual-status than they have in the past. Increased communication between DoL, DoD (ESGR) and employers on supporting the employment of reservists will assist in educating employers about the nation's reliance on them and reservists in maintaining national security. Governmental agencies at both state and federal levels must support and inform employers about the restructuring of the reserve forces from a strategic reserve to an operational reserve. This has not been done effectively. Making employers aware of this transformation within the reserve components is essential if an operational reserve is to be successful. Addition by Congress of tangible benefits that aid the employer in temporarily replacing the reservist during deployment will garner employer support. Recruitment and retention initiatives for the operational reserve component force are also essential. At the top of the initiative list is developing a strategy that will support employers. When reservists are absent from work, employers and businesses lose money. Today, concerns for employers are not addressed by monetary or other cost saving incentives which is a language employers and businesses understand. The study recommends such a policy be established which allows personnel replacements, other forms of reimbursement, and employer partnerships that when combined fully support the civilian employers of the operational reserve.

Book excerpt: To reduce costs and maintain as small an active peacetime force as possible, the Department of Defense (DOD) follows a total force policy that relies heavily upon reserve forces to augment active forces in wartime and peacetime operations and during national emergencies. With over 1.5 million members and a fiscal year 1996 budget of about $20 billion, the reserve forces are an essential component of the national defense strategy. Because of concern over the accessibility and responsiveness of reserve forces, the Congress required DOD to prepare a report with recommendations for improving the timeliness, adequacy, and effectiveness of reserve component responses to domestic emergencies and national contingency operations. Section 1231 of the National Defense Authorization Act for Fiscal Year 1997 (P.L. 104-201) required DOD to address whether: (1) the statutory limitation on the time period for involuntary activation of reservists needed in response to domestic emergencies should be expanded; (2) recommendations should be implemented from a 1995 RAND report on National Guard responsiveness to domestic emergencies; (3) changes are needed in the statutory authorities for activating reserve units and individuals to facilitate current and future use of the reserve components; and (4) statutory provisions are needed to help mitigate the effects of frequent mobilizations on reserve units and individual members, civilian employers, and employees of reserve member employers.
