These selected paragraphs distill the contents and give you a quick look inside The Curiosities and Law of Wills: Look inside the book: The following words are used by an individual whoPg 12 died in London in June, 1791, in reference to his wife: “Seeing that I have had the misfortune to be married to the aforesaid Elizabeth, who ever since our union has tormented me in every possible way; that not content with making game of all my remonstrances, she has done all she could to render my life miserable; that Heaven seems to have sent her into the world solely to drive me out of it; that the strength of Samson, the genius of Homer, the prudence of Augustus, the skill of Pyrrhus, the patience of Job, the philosophy of Socrates, the subtlety of Hannibal, the vigilance of Hermogenes, would not suffice to subdue the perversity of her character; that no power on earth can change her, seeing we have lived apart during the last eight years, and that the only result has been the ruin of my son, whom she has corrupted and estranged from me. ...“And for the due and full accomplishment and performance of all other things conteined with the same in the form of an indenture, signed with our own hand, which shall be passed by way of covenant for that purpose between the said Deane and Cannons and our executors, if it pass not between us and the said Deane and Cannons in our liefe; that is to say, the said Deane and Cannons and their successours forever shall finde two prestes to say masses at the said aulter to be made where wePg 26 have before appointed our tomb to be made and stand; and also after our decease kepe yerely four solemne obites for us within the said College of Windesour, and at every of the same obites to cause a solemne sermon to be made, and also at every of the said obites to give to poor people in almes tenne poundes.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Handbook of the Law of Wills The first edition was so broad in scope that it has seemed unwise to deal with entirely new topics. In connection with the topics dealt with in the first edition, the editor has sought primarily to consider those cases which have been decided in the twelve years which have elapsed since the publication of that edition. Some changes and a large number of additions have been made, especially in the notes. Many cases in support of new text have been referred to, and a con siderable number of recent cases have been cited, because they con tain valuable discussions or deal with matters which are still in dis pute. Although realizing that defects in general statements are nu avoidable, the statements in the black-letter text have usually been re tained, but the fact that the authorities are in conflict has been made clear in many instances where this did not appear in the former edition. Book excerpt: Excerpt from The Law of Wills: For Students When asked some time ago to write a book on Wills for the Students' Series, I told my publishers, who are owners of the American copyright of Jarman on Wills, under the International Copyright Law, that I would try it if I could have free use of Jarman and my own notes to that work. How much the permission given has been used, the references to Jarman, scattered up and down the present volume, in part bear witness. But a word or two need now be said. This book agrees with those who find an important place for legal theory in education for the bar. Chapter I., largely on the theory of wills in relation to the State, and Chapter XIV., largely on the theory of construction, are only more express examples, because of their relative and intrinsic importance, of what more or less runs through the book. Whatever mode of instruction is pursued, whether the Harvard, which is powerfully modifying where it is not taking the place of other methods, or any other, the doctrines of the law should, I think, be taught in direct connection with and in the light of legal theory. Book excerpt: Excerpt from Principles of the Law of Wills: With Selected Cases It would be hardly justifiable to express a conviction that this book will prove as useful to practising lawyers as to the student. But it is believed that it will prove useful even to them as a com pact and careful review and summary of the important principles and doctrines in its field, and as a convenient means Of reference to the best and most telling authorities. The very wealth of material in the large treatises, -some Of which are beyond all need of praise for their great worth and practical value, - Often renders it difficult to determine which of the army Of 'cases cited are the best for reading or reference. Here the citations are, so to speak, few, but they are carefully chosen and important. For lawyers who have not convenient access to large libraries, the selected cases also constitute a reservoir of valuable original authorities. Book excerpt: Excerpt from Law of Wills and Administration The present volume contains the substance of my two former treatises on "Wills" and "Executors and Administrators," both of which have passed into three editions, now exhausted. This book is intended to supersede those two, by way of a new edition, so as to supply law students and members of the bench and bar with an elementary treatise for study and practical use, covering the whole jurisprudence of Wills and the Administration of Estates, testate or intestate, in England and the United States. For the citation of other series than the official reports, in cases of the former editions, I am indebted to Philip Nichols, Esq., author of a standard treatise on the "Power of Eminent Domain." The Table of Cases has been prepared by a member of the Boston bar, competent and experienced; though many other cases are cited in these pages by book and page only. In all other respects I have personally prepared the present volume, making a thorough revision of the former text and notes, while adding the latest cases upon a personal examination and comparison. Book excerpt: Excerpt from Ancient, Curious and Famous Wills "Let's choose executors, and talk of wills; And yet not so, -for what can we bequeath, Save our deposed bodies to the ground?" An addition to the fifteen millions of books of which the world is now possessed demands an explanation, if not an apology. In my experience as a lecturer on the Law of Wills, and in the practical administration of estates controlled by wills, in which I have been engaged for many years, it has been a subject of surprise to me that no one in America has seriously undertaken the collection of curious and famous wills. It has occurred to me that I might discharge the duty which every lawyer owes to his profession by making such a collection. The subject is very comprehensive, and the material required has been obtained, in most instances, from the original records of Probate and Court Registers in various parts of the world, by exhaustive research in libraries at home and abroad, and by reference to magazine and newspaper files. It has been my effort to select from this collection the wills which appeared most interesting and entertaining. I recognize quite fully the wisdom of Lord Coke's remark, that "Wills, and the construction of them, do more perplex a man than any other learning; and to make a certain construction of them exceedeth jurisprudentum artem." Perplexity has likewise beset me in an attempt to classify the wills in this work and place them under convenient and appropriate headings. It must not be forgotten that while all men may make wills, and should do so, yet all men have not done so. It is a remarkable trait in human character that wills are for the most part postponed, and that many men of wealth and distinction die without them. So great a man as Abraham Lincoln left no will, though he had a considerable estate. General Grant also died intestate, but his estate was small.
