A rap sheet, or even a court appearance or background report that reveals a run-in with the law, can have fateful consequences for a person’s interactions with just about everyone else. The Eternal Criminal Record makes transparent a pervasive system of police databases and identity screening that has become a routine feature of American life. The United States is unique in making criminal information easy to obtain by employers, landlords, neighbors, even cyberstalkers. Its nationally integrated rap-sheet system is second to none as an effective law enforcement tool, but it has also facilitated the transfer of ever more sensitive information into the public domain. While there are good reasons for a person’s criminal past to be public knowledge, records of arrests that fail to result in convictions are of questionable benefit. Simply by placing someone under arrest, a police officer has the power to tag a person with a legal history that effectively incriminates him or her for life. In James Jacobs’s view, law-abiding citizens have a right to know when individuals in their community or workplace represent a potential threat. But convicted persons have rights, too. Jacobs closely examines the problems created by erroneous record keeping, critiques the way the records of individuals who go years without a new conviction are expunged, and proposes strategies for eliminating discrimination based on criminal history, such as certifying the records of those who have demonstrated their rehabilitation.

There remains a misconception that once an offender has served the penalty for an offence, his or her dealings with the law and legal system in relation to that offence is at an end. Criminal records are relied upon by key decision makers at all stages of the formal criminal process, from the police to the judiciary. Convictions can affect areas of policing, bail, trial procedure and sentencing, which the author discusses. Furthermore, with the increasing intensifying of surveillance techniques in the interests of security, ex-offenders are monitored more closely post release and these provisions are explored here. Even beyond the formal criminal justice system, individuals can continue to experience many collateral consequences of a conviction whereby access to employment, travel and licenses (among other areas of social activity) can be limited as a consequence of disclosure requirements. Overall, this book examines the perpetual nature of criminal convictions through the evolution of criminal record use, focussing on the Irish perspective, and also considers the impact from a broader international perspective.

There should be reasonable restrictions placed on how long employers can use criminal background information as a reasonable indicator of a persons character. This book will address these questions in depth, and will offer many reasonable suggestions on how to remedy this problem.

Book excerpt: After years of swelling prison populations, the reentry into society of people with criminal convictions has become a central criminal justice issue. Scholars, advocates, judges, and lawmakers have repeatedly emphasized that, even after prison, punishment continues from severe civil penalties that are imposed by federal and state statutes on anyone with a conviction. To alleviate the impact of these punishments, they have increasingly endorsed state legislation that creates certificates of rehabilitation. Seven states offer these post- conviction certificates, and six others proposed such legislation in 2011. Many look to New York's statute as the best model because it is the oldest and most robust. Yet no article has examined New York's experience with Certificates of Rehabilitation. This Article draws lessons from the fifty-year history of New York's Certificates of Rehabilitation to describe features of an ideal administrative mechanism that removes statutory barriers to reentry. I argue that a model Certificate of Rehabilitation statute will have a strong enforcement mechanism and clear directives for administering authorities. Successful implementation also requires committed administrative leadership and an effective means for making certificates accessible to the population they serve. Certificates of Rehabilitation do not erase a person's criminal history, but they offer legal and social recognition that after a criminal conviction, a person deserves a second chance.

Book excerpt: This Green Paper sets out plans for fundamental changes to the criminal justice system and addresses the three priorities of punishing offenders, protecting the public and reducing reoffending. It seeks to set out an intelligent sentencing framework, coupled with more effective rehabilitation. Despite a 50% increase in the budget for prisons and managing offenders in the last ten years, almost half of all adult offenders released from custody reoffend within a year as well as 75% of youth custody offenders. These proposed reforms will seek to make prisons places of hard work and industry. There will be a greater use of strenuous, unpaid work as part of a community sentence alongside tagging and curfews. There will also be a greater focus on the enforcement and collection of fines, and a much stronger emphasis on compensation for victims of crime. Six new rehabilitation programmes will be piloted on a payment by results basis. Treatment rather than prison will be the option for the less serious offenders with mental illness and drug dependency. The proposals also seek to introduce more straightforward sentencing alongside greater transparency from the courts. The publication is divided into seven chapters, covering the following areas: punishment and payback; rehabilitating offenders to reduce crime; payment by results; sentencing reform; youth justice and working with communities to reduce crime, along with two annexes.
