Book Synopsis Impacts of Mob [In]Justice on the Rule of Law in Ghana by : Mawuloe Koffi Kodah

Available in PDF, EPUB and Kindle. Book excerpt: Research Paper (undergraduate) from the year 2012 in the subject Politics - International Politics - Region: Africa, course: Governance and Public Policy, language: English, abstract: This paper studies the practice of mob violence in the name of justice, and its implication to the rule of law in Ghana. The study is divided into three major part parts. The first part examines a number of conceptual issues of justice which serve as framework for the study. The second part evaluates a number of possible causes that elicit recourse to mob violence as a way of seeking equity and fairness. It also brings out the possible impacts of the practice on the rule of law, good governance and sustainable democratic development in Ghana. The paper rejects mob violence, "mob justice", as an acceptable way of seeking justice, in the third part. This is done, taking cognizance of the conceptual framework set at the beginning. In effect, the paper turns the paradigm upside down, thus making of "mob justice" mob injustice. Consequently, the paper makes a number of recommendations that should be considered in an attempt to put an end to the practice in order to uphold the supremacy of the rule of law needed for the entrenchment of democracy and good governance in Ghana.

It defines and discusses the general nature of crime and criminal law, the scope and functions of criminal law, and the principle of legality. It similarly proposes definitions, theories, purposes and aims, and justification of punishment. The work covers criminal liability; the actus reus, the mens rea, and exceptions to these liabilities. A final section outlines causation theories, joint causation, contributory negligence and jurisdiction. The volume also includes articles on theoretical problems and extensive case notes.

Brobbey and published by Blackmask. This book was released on 2000 with total page 752 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work covers practice and procedure in the High Courts, the Regional Tribunals, the circuit courts, the circuit tribunals, the district courts and the community tribunals in Ghana. The author elucidates the structures of these institutions, and the relationships between them. He stresses the importance of the district courts, and community tribunals which remain for the most part unrecognised - undeservedly so, he maintains, since they form the building blocks of the Ghanaian legal system and a training ground for the country's lawyers. He discusses the role of the magistrate and the need for better magisterial guidance to make these courts effective.

Download or read book The General Part of Criminal Law written by Henrietta Mensa-Bonsu and published by Blackmask. This book was released on 2006-01-01 with total page 632 pages. Available in PDF, EPUB and Kindle. Book excerpt: The second volume of this study on criminal law sets out the substance and practicalities of criminal law for which the theory has been provided in the first volume; for example, specific matters such as defences and inchoate crimes. The subject of defences is organised into four chapters. The first considers general exemptions such as in cases of insanity and automatism. The second chapter covers partial defences, such as in cases of provocation or intoxication; and the third, complete defences as in a case of the preservation of public order, or prevention of, or defence against crime. A chapter on complete defence considers consent, revocation of consent, and ignorance or mistake of facts. The subject of inchoate offences is structured into two major sections; the first covering conspiracy, attempts and preparation; and the second outlining accessorial liability.
